Delhi HC says GNIDA not carrying out commercial activity for profit

The Delhi High Court today exempted the Greater Noida Industrial Development Authority (GNIDA) from paying Income Tax, saying it was not carrying out any commercial activity with any profit motive. A bench of Justices Sanjiv Khanna and Pratibha M Singh allowed the plea of the GNIDA seeking to set aside a 2015 order of the Central Board of Direct Taxes (CBDT) rejecting its application for grant of exemption under Section 10 (46) of the Income Tax Act 1961. Section 10(46) of the IT Act deals with the exemption of 'specified income' of certain bodies or authorities. It says that any specified income arising to a body or authority, constituted by or under a central or state Act with the object of regulating or administering an activity for the benefit of general public and which is not engaged in any commercial activity, shall be exempted. Cow smuggling incidents in Alwar, Bharatpur on decline: Raj govt

Special outposts set up in Alwar and Bharatpur had led to a significant decline in cases of cow smuggling, Rajasthan government informed the state Assembly today while adding that a proposal to depute two Superintendents of Police in Alwar was under consideration to curb crime in the district. During the Question Hour, state Home Minister Gulab Chand Kataria, while responding to concerns raised by legislator Banwari Lal Singhal, said the crime rate in Alwar was high as compared to other districts. A proposal to depute two SPs in Alwar was under consideration but the government would take a decision according to the availability of budget and resources, he added. Kataria informed the house that as many as 17,405 cases were registered in Alwar in 2017. 77 mobile phones recovered; 5 minors among 7 of gang held

The police have recovered 77 stolen mobile phones after arresting seven members, including five minors, of a gang from places in and around Jamshedpur, the police said today. Of the seven gang members, two are from West Bengal, Senior Superintendent of Police Anoop Birthare said. The arrests were made since yesterday following the capture of one of the gangmembers by a person at Govindpur on the outskirts of Jamshedpur yesterday afternoon. The person chased two members of the gang who picked his mobile phone from his pocket and managed to capture one, Birthare said. He was handed over to the police and following his interrogation, others were arrested from places in and around Jamshedpur, the SSP said. Two of the arrested hailed from Ranigunj and Jamuria area of West Bengal's Paschim Burdwan district.

Magistrates should exercise caution in applying judicial minds: SC

The Supreme Court has termed as "unfortunate" that in a number of cases, magistrates across India are not guided by concrete precedents set by it in exercising caution while applying their judicious mind. Talking about the maxim that justice should not only be done, but should manifestly and undoubtedly be seen to be done, the top court said the magistrates are expected to apply their independent mind while taking cognisance of a matter and such a view, should be reflected in the order. A bench of Justices N V Ramana and S Abdul Nazeer termed it as "unfortunate" that a number of cases which are brought before the top court, reflect otherwise. "We may note that the magistrates across India have been guided on a number of occasions by concrete precedents of this Court to exercise utmost caution while applying their judicious mind in this regard. Controversy on land acquisition orders: SC sets up constitution bench

A five-judge constitution bench of the Supreme Court would hear on March 6 a contentious issue that had cropped up after a three-judge bench had raised concern over "judicial discipline" and propriety arising due to conflicting views of different benches of the apex court in matters relating to land acquisition. The issue had came to fore on February 21 when a three-judge bench had virtually stayed the operation of a verdict delivered on February 8 by another three-judge bench of the top court, which had held that compensation not availed within a stipulated five year period would not be a ground for cancellation of land acquisition. 'Cow smuggler' killed while being chased by police in Alwar

A suspected cow smuggler was crushed to death under the wheels of a truck carrying bovines when he allegedly tried to flee the vehicle, which was being chased by police in Rajasthan's Alwar district, an official said today. "Police were chasing the truck yesterday when 35-year-old Aas Mohammed, a resident of Haryana, tried to flee by jumping off the vehicle, but got crushed under the same truck," Banwari Lal, station house officer at the Reni police station, said. Out of the 23 cattle recovered, five were found dead and the rest shifted to a cow shelter nearby, Lal said. Police are searching for the other alleged smugglers, who managed to escape. Mohammed's body was handed over to his family today after post-mortem examination, the SHO added.

Cal HC lawyers' ceasework extended till Mar 5

Lawyers associations at the Calcutta High Court today extended till March 5 their ceasework to press for immediate appointment of judges to fill up vacant posts, leaving litigants in the lurch. Claiming that the Centre is yet to respond to their demand for filling up the vacancies for judges in the high court, three lawyers bodies took separate resolutions to extend the ceasework which they had launched on February 20. "The Supreme Court collegium has cleared five names for appointment as judges, but the Union law ministry is yet to clear these," Bar Association president Uttam Majumdar said. "We also want appointment of a permanent chief justice to the high court, which has been headed by acting chief justices for the last three years except for just three months when Justice Girish Gupta was elevated to the post," he said. Man dies after jumping off police vehicle

A man died on Monday after he jumped off a police vehicle in Uttar Pradesh.The deceased was arrested for smuggling of alcohol in Gautam Budh Nagar district's Jewar.Speaking to ANI, the circle officer confirmed the incident, and said, "Police had arrested a man for smuggling of alcohol, he was being taken to the police station when he jumped off the police van in an attempt to run and met with an accident and died".Meanwhile, Jewar MLA Dhirendra Thakur said that a case will be registered against the responsible police personnel."The body has been sent for post-mortem. NGT notice to Haryana on plea alleging encroachment on drain

Sand mining in Jodhpur: NGT appoints court commissioners

The National Green Tribunal today appointed court commissioners to verify allegations made in a plea regarding illegal sand mining in the Jodhpur district of Rajasthan. A bench headed by Justice Jawad Rahim appointed advocates Gaurav Bansal and Rahul Khurana as court commissioners in the case and directed them to submit the inspection report by March 30. "The report shall state the extent of illegal mining, if any, and it should also ascertain whether the area is supplied electricity for domestic purposes only or commercial use," the bench said. The tribunal directed the District Magistrate of Jodhpur and the police commissioner to provide assistance to the court commissioners during the visit to village Mandore in Jodhpur district. Prison reforms: SC seeks details of jails having over 150 pc occupancy

The Supreme Court has asked the National Legal Services Authority (NALSA) to look into the issue of overcrowding of prisons and furnish figures before it regarding the population in the jails where occupancy was over 150 per cent as on December 31 last year. A three-judge bench headed by Justice Madan B Lokur also asked an advocate, who is assisting the court as an amicus curiae in the matter, to look into the issue of rehabilitation and welfare of women prisoners as well as their children, including the aspect of education of such kids. A city court has slammed the Delhi Police for its probe into the mysterious death of a 23-year-old man last year, saying it had "deliberately attempted" to portray it as a case of suicide. The court, which directed the registration of an FIR to probe the "tragic death" of the man, a manager at a high-end hotel here, said the case also required thorough investigation to unearth the "blatant attempt" of the police to give it the colour of suicide. Vietnam cops seize $2.5 mn heroin in China border drug bust

Five men were arrested in Vietnam for allegedly attempting to smuggle $2.5 million worth of heroin into China after police shot at their drug-packed vehicle as they tried to flee, local media reported today. The men were caught in northern Cao Bang province on the border with China with nearly 100 kilograms (220 pounds) of heroin from Laos in their truck, state-run Thanh Nien newspaper reported. Rs 20L compensation for kin of engineer killed in accident

The Motor Accident Claims Tribunal (MACT) here has awarded a compensation of Rs 20 lakh to the family of an engineer killed in an accident in January, 2002. The member of the MACT at Kalyan, S P Gogarkar, ordered the respondents -- the erring lorry's owner and The New India Assurance Company Limited -- to jointly and severally make the payment, along with an 8 per cent interest per annum, from the date of the filing of the claim. The order was passed earlier this month. The claimants, residing in the Ulhasnagar township of Thane district, informed the tribunal that the deceased, Vinod Ramashankar Pandey (32), was a self-employed civil engineer earning Rs 72,851 per annum. On January 13, 2002, Pandey and a friend were going towards Hazira from Thane in a car.
