Non-recovery of cash cannot be a prima facie proof that no corruption has taken place as the offender's mind uses new technology to commit offences without leaving behind any trace, the Delhi High Court has held while denying bail to AAP leader Manish Sisodia in the excise policy scam cases. The high court said it cannot accept the argument put forth by Sisodia about non-recovery of cash from him in view of the statements of some hawala dealers and other witnesses recorded during the investigation. The Delhi High Court on Wednesday dismissed with Rs 1 lakh costs a public interest litigation by a lawyer seeking appropriate arrangements for Chief Minister Arvind Kejriwal to run the government from jail. The petitioner also sought to restrain Delhi BJP president Virendra Sachdeva from exerting any "undue pressure" for resignation of Kejriwal. A bench headed by Acting Chief Justice Manmohan observed that since the AAP leader has already approached the Supreme Court against his arrest, "no orders were called for" with regard to providing him any facilities while in judicial custody. The Delhi High Court on Friday sought response of the CBI and ED on former deputy chief minister Manish Sisodia's pleas seeking bail in the corruption and money laundering cases lodged in relation to the alleged excise policy scam. Justice Swarana Kanta Sharma issued notices to the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) on Sisodia's pleas challenging a trial court's April 30 order by which his bail petitions were dismissed. The high court listed the matter for further hearing on May 8. Sisodia, in an interim application, urged the court to continue the trial court's order allowing him to meet his ailing wife once a week in custody, during pendency of his pleas. As the counsel for the ED submitted that the probe agency has no objection if the trial court order is continued, Justice Sharma allowed the request. Former deputy chief minister Manish Sisodia on Thursday approached the Delhi High Court seeking bail in the corruption and money laundering cases lodged by the CBI and the ED in relation to the alleged excise policy scam. The plea was mentioned before a bench of Acting Chief Justice Manmohan and Justice Manmeet PS Arora for an urgent hearing and the court agreed to list on Friday. "Let the judge go through the file so let it come tomorrow," the bench said. Advocates Rajat Bhardwaj and Mohd Irshad, representing Sisodia, submitted that the petitioner is an MLA and urged the court to list both the pleas seeking bail for an urgent hearing. A court here on Friday extended the judicial custody of AAP leader Manish Sisodia, co-accused Vijay Nair and others till May 8 in a money laundering case related to the alleged Delhi excise policy scam. The accused persons were produced before Special Judge Kaveri Baweja through video conferencing on the expiry of their judicial custody granted earlier. The judge also directed the Enforcement Directorate (ED) to submit a report on how much time it was likely to take to digitize the documents related to the charge sheet. During the proceedings, ED's special public prosecutors Naveen Kumar Matta and Simon Benjamin alleged that the accused persons were delaying the proceedings and that they were not willing to expedite the hearing. Delhi minister Saurabh Bharadwaj will meet Chief Minister Arvind Kejriwal in Tihar Jail on Wednesday afternoon, officials said. The Delhi chief minister who was arrested by the Enforcement Directorate (ED) in a money laundering case on March 21 has not stepped down and the Aam Aadmi Party has asserted that he will continue to run the government from jail. Earlier, Punjab Chief Minister Bhagwant Mann and AAP's national general secretary (organisation) Sandeep Pathak met Kejriwal in Tihar Jail on April 15. After the meeting, Pathak told reporters that Kejriwal will meet two ministers each week and review the progress of work under their respective departments. After his arrest, Kejriwal had sent messages to his ministers to address issues such as water supply and availability of medicines in government hospitals. He also asked party MLAs to visit their constituencies and offer help to the people there.
Senior AAP leader and Rajya Sabha MP Sanjay Singh on Saturday claimed that Delhi Chief Minister Arvind Kejriwal was not being allowed to meet his family at mulakat jangla' in Tihar jail. Addressing a press conference, Singh said, "There is an attempt to break the morale of CM Kejriwal. His family has not been allowed in-person meetings with him. They are only allowed to meet him through the jangla. This is inhuman. Even hardcore criminals are allowed in-person meetings," the AAP leader said. The 'mulakat jangla' is an iron mesh which separates the inmate from the visitor in a room inside the jail. A visitor and an inmate can talk to each other by sitting on different sides of the mesh. There was no immediate reaction from the Tihar administration. AAP MP Sanjay Singh on Friday said the senior leadership of the BJP hatched a conspiracy to put Delhi Chief Minister Arvind Kejriwal behind bars in the excise policy case. Addressing a press conference two days after coming out of jail, Singh accused the BJP of pressurising Raghav Magunta, who is an accused-turned-approver in the Delhi excise policy case, into giving a false statement against Kejriwal.
