Anticipatory bail in serious offences must not be given mechanically: SC

The Supreme Court has said anticipatory bail in cases involving serious offences should not be given in a mechanical manner. A three-judge bench of Justices Vikram Nath, Sanjay Karol and Sandeep Mehta made the observation while setting aside an order of anticipatory bail to four accused in a murder case. "The order of the High Court (Patna) does not disclose any reasoning for granting anticipatory bail in a matter involving serious offences under Sections 302 and 307 IPC," the bench said in its May 1 order. It continued, "The impugned order is cryptic and lacking in judicial analysis. In cases involving serious offences, the grant of anticipatory bail in such a mechanical manner cannot be sustained and is liable to be set aside." On a plain reading of the FIR and accompanying material, the court noted that the appellant's father was assaulted and killed in the presence of the appellant, who was also the informant. "The incident appears to have stemmed from a dispute regarding ...

Mangione wants murder case dropped, cites double jeopardy in CEO killing

Luigi Mangiones lawyers urging a judge Thursday to throw out his state murder charges in the killing of UnitedHealthcare CEO Brian Thompson, arguing that the New York case and a parallel federal death penalty prosecution amount to double jeopardy. If that doesn't happen, they want terrorism charges dismissed and prosecutors barred from using evidence collected during Mangione's arrest last December, including a 9 mm handgun, ammunition and a notebook in which authorities say he described his intent to wack an insurance executive. Mangione's lawyers also want to exclude statements he made to police officers who took him into custody at a McDonald's restaurant in Altoona, Pennsylvania, 230 miles (about 370 kilometers) west of New York City, after a five-day search. Among other things, prosecutors say the Ivy League graduate apologised to officers for the inconvenience of the day, and expressed concern for a McDonald's employee who alerted them to his whereabouts, saying: A lot of peop

HC upholds life term for 2 Chhota Rajan gang members in 2010 murder case

The Bombay High Court on Tuesday upheld the conviction and life sentence of two members of the Chhota Rajan gang in a 2010 double murder case, stating that the trial court's judgment was "well-reasoned and legally sound ". A court here in August 2022 convicted Mohammed Ali Shaikh and Pranay Rane for murder, criminal conspiracy and offences under the Arms Act while acquitting Rajan and two others for lack of evidence. A division bench of justices Neela Gokhale and Revati Dere on Tuesday dismissed the appeals filed by Shaikh and Rane. "The evidence on record, when assessed in its entirety, establishes the guilt of the appellants beyond reasonable doubt, " the bench said. As per the police, represented by special prosecutor Pradeep Gharat, four men opened fire on Asif Khan, an alleged aide of fugitive gangster Dawood Ibrahim, at a spot near the J J Marg police station in the city on February 13, 2010. Khan managed to escape, but Shakeel Modak and Asif Qureshi, who were there to meet

2020 Delhi riots: Court acquits 12 in murder, criminal conspiracy charges

A court here has acquitted 12 men accused of murdering two persons during the 2020 northeast Delhi riots, saying there was no evidence on the record to show that any of them was a member of the culprit mob. Additional Sessions Judge Pulastya Pramachala, who was hearing two cases registered by the Gokalpuri police station against the men, observed that the WhatsApp chats of one of the accused, Lokesh Kumar Solanki, confessing to the two murders were not "substantive evidence". According to the chargesheets, the victims, Aamin and Bhure Ali, were killed by rioters and their bodies were thrown into drains on February 25 and 26, 2020, respectively. In two orders dated March 28, the court said that the prosecution's evidence about the messages being exchanged by the accused confessing to the murders in a WhatsApp group could not be used as substantive or primary evidence. "Such posts may be put in the group solely to become a hero in the estimation of other members of the group. It coul

Luigi Mangione wants laptop in jail as he awaits trial in CEO's murder

Luigi Mangione is asking for a laptop in jail, but just for legal purposes not for communicating with anyone as he awaits trial in the killing of UnitedHealthcare's CEO. In a court filing made public late Monday, Mangione's lawyers proposed that he get a laptop configured solely to let him view a vast amount of documents, video and other material in the case surrounding the shooting of Brian Thompson. Similar limited-laptop provisions have been made for some other defendants in the federal lockup where Mangione is being held. The Manhattan district attorney's office, which is prosecuting Mangione on a rare New York state charge of murder as an act of terrorism, didn't immediately respond to a request for comment. According to Mangione's lawyers, prosecutors are frowning on the laptop request, saying that some witnesses have been threatened. Defence lawyer Karen Friedman Agnifilo wrote that there's no connection to Mr. Mangione for any of said alleged threats. Mangione, 26, is ...
