The Central Bureau of Investigation (CBI) has obtained a sanction to proceed against Yes Bank co-founder Rana Kapoor in a case pertaining to alleged fraudulent transactions between the bank and two Anil Dhirubhai Ambani group companies. The probe agency recently filed an application before a court here for submitting additional documents it is relying on, including the sanction for prosecution against Rana Kapoor, then managing director and chief executive officer of Yes Bank, under the Prevention of Corruption (PC) Act. The court is scheduled to hear both the defence and the prosecution on December 12 for taking cognizance of the charge sheet filed by the CBI. As per the probe agency, the alleged fraudulent transactions involving Reliance Commercial Finance Limited (RCFL) and Reliance Home Finance Limited (RHFL), Yes Bank, and the firms controlled by Kapoor's family caused a loss of Rs 2,796 crore to the bank. Yes Bank founder Rana Kapoor was released from a prison here on Friday evening, hours after being granted bail by a court in an alleged loan fraud case. Kapoor was first arrested in March 2020 in a money laundering case by the Enforcement Directorate. The Bombay High Court on Thursday refused to grant bail to Yes Bank founder Rana Kapoor in connection with the DHFL money laundering case, noting that he was one of main accused in the case and he faced a "serious charge" of having laundered public money. A single bench of Justice P D Naik in its order said Kapoor misused his official position to gain undue financial benefit for himself, his family members and associates. "He (Kapoor) is involved in bribery, corruption and money laundering activities. The proceeds of crime (POC) involved in this case are to the extent of Rs 5,333 crore. The CBI has filed a charge sheet against former Chief Executive and Managing Director of Yes Bank Rana Kapoor as well as Avantha Group promoter Gautam Thapar in the Rs 466.51 crore alleged fraud in the bank, officials said. Kapoor was not named a suspect in the FIR registered on June 2 last year in the case. His role, however, surfaced during the investigation, they said. In its charge sheet filed before the special CBI court in Mumbai, the probe agency has also named Thapar in the scam. The FIR was registered against Thapar, directors of Oyster Buildwell Pvt Ltd (OBPL) -- Raghubir Kumar Sharma, Rajendra Kumar Mangal and Tapsi Mahajan --, unidentified executives of Avantha Realty Pvt Ltd and Jhabua Power Ltd, on a complaint from Yes Bank CVO Ashish Vinod Joshi. Kapoor is also co-accused with Thapar in another case related to alleged diversion of public money in Yes Bank in exchange for a high-end property at an upscale neighbourhood of Delhi, they added.

Capital markets regulator Sebi on Wednesday imposed a penalty of Rs 2 crore on former Yes Bank MD and CEO Rana Kapoor for mis-selling the private sector lender's AT-1 bonds. He has been directed to pay the fine within 45 days, the Securities and Exchange Board of India (Sebi) said in its order. The case relates to mis-selling of the bank's AT1 bonds to retail investors by its officials. It was alleged that the bank and certain officials did not inform investors of the risk involved while selling the AT-1 (Additional Tier-1) bonds in the secondary market. The sale of AT1 bonds started in 2016 and continued till 2019. In its 87-page order, the markets regulator found that Kapoor was overseeing the entire activities relating to the secondary sale of AT-1 bonds, taking regular updates from the team and giving them further instructions to increase the sales, thus creating pressure on the officials to ramp up the sales.
