Gyanvapi mosque row: HC judge recuses from hearing plea against court order

Allahabad High Court judge Justice Manish Kumar Nigam on Wednesday recused himself from hearing a plea challenging the Varanasi district court's refusal to direct the Archaeological Survey of India (ASI) to undertake a survey of the 'wazukhana' area except the 'Shivling' inside the Gyanvapi mosque complex. The court said the matter be placed before the court of chief justice for nomination of another judge and fixed January 31 as the next date of hearing. The revision petition was filed by Rakhi Singh, who is one of the plaintiffs in the Shringar Gauri worshipping suit which is presently pending before the Varanasi district court. In her application before the Varanasi court, which was rejected on October 21, 2023, the primary contention raised by Singh was that the survey of the wazukhana, excluding the 'Shivling' is necessary to ascertain the religious character of the property in question. Varanasi court acquits Uttar Pradesh Congress chief in 27-year-old case

A court here on Saturday acquitted Uttar Pradesh Congress president Ajay Rai in a 27-year-old case of holding a protest in violation of prohibitory orders. Rai's lawyer Anuj Yadav said, "The MP-MLA Court of Judge Ujjawal Upadhyay acquitted Rai after the prosecution failed to prove the allegations." Yadav said that the case was lodged in 1996 and it was alleged that Rai held a protest with his supporters in violation of prohibitory orders.

Hand over keys of basement in Gyanvapi complex to Varanasi DM: Court

A district court has ordered that the keys of the basement located in the Gyanvapi complex here, known as "Vyas ji ka tehkhana", be handed over to the district magistrate. District Judge AK Vishwesh said in his order on Wednesday that there is a need for taking proper care of the basement of Vyas ji located at the southern end of the complex, Hindu side's counsel Madan Mohan Yadav said. "Therefore, district magistrate of Varanasi is appointed receiver of Vyas ji's basement," the court said. Yadav had earlier said that authorities had barricaded and locked the basement in 1993. Prior to it, the basement was used for worship by Somnath Vyas, a priest, Yadav had claimed in his plea.

Court to rule Friday on making ASI survey report on Gyanvapi mosque public

A Varanasi court would decide Friday whether to open the sealed ASI survey report on the Gyanvapi mosque complex and provide copies to the Hindu and Muslim sides. The Archeological Survey of India (ASI) had on Wednesday urged the court not to make its report public for at least four more weeks, according to the lawyer for the Hindu side, Madan Mohan Yadav. Varanasi district court judge A K Vishvesh then adjourned the matter till Thursday. However, on Thursday, he could not take up the matter as he was engaged at an event, his office said and added that the matter was then posted for Friday.

Gyanvapi case: HC rejects all five suits challenging maintainability plea

The Allahabad High Court on Tuesday dismissed all five suits challenging the maintainability of a civil suit pending before a Varanasi court seeking restoration of a temple at the site where the Gyanvapi mosque exists. Pronouncing the judgment, Justice Rohit Ranjan Agarwal said the suit filed in 1991 before a Varanasi court is maintainable and not barred by the Places of Religious Worship Act, 1991. The court directed a comprehensive survey of the Gyanvapi mosque site. The petitions filed by the Anjuman Intezamia Masjid Committee (AIMC) and the Uttar Pradesh Sunni Central Waqf Board had also challenged a Varanasi court order of April 8, 2021 to conduct a comprehensive survey of the Gyanvapi mosque. The AIMC, which looks after the management of Gyanvapi mosque located adjacent to the Kashi Vishwanath temple at Varanasi, has challenged the maintainability of a suit filed before a Varanasi court, wherein the Hindu petitioners have sought restoration of a temple at the site where the .
