Families of two chefs get total of over Rs 50 L compensation

The family members of two chefs, who died after being run over by a rashly driven dumper last year, have been awarded a total compensation of over Rs 50 lakh by a Motor Accident Claims Tribunal (MACT) here.

The tribunal directed Cholamandalam MS General Insurance Company Ltd, with which the offending dumper was insured, to pay Rs 50,05,900 to the families out of which Rs 34,29,100 and Rs 15,76,100 would be given to the family members of victims Manish Kumar and Anish Singh respectively.

"On considering the testimony of witnesses coupled with the documents on record, I am of the view that Manish Kumar and Anish Singh received fatal injuries due to rash and negligent driving of Dumper by Mohd. Safi, respondent no.1," MACT Presiding Officer K S Mohi said.
 

The tribunal decided two petitions together as they arise out of the same accident.

Manish, 25, and Anish, 25, were working as chefs with a popular restaurant here, Pizzeria Rossa, and were earning Rs 23,000 and Rs 8,900 per month respectively.

According to the petitions, the accident took place on March 4 last year at around 2.30 AM at AIIMS flyover here when Manish and Anish were returning home towards Dhaula Kuan from the restaurant on a motorcycle.

While Manish was riding the motorcycle, Anish was a pillion rider.

When they reached AIIMS flyover, a speeding dumper, being rashly and negligently driven by driver Mohd Safi, hit the motorcycle from behind due to which they fell down.

Safi had run the dumper over the two victims resulting in their deaths on the spot. They were taken to JPN Apex Trauma Center and their postmortem was conducted at AIIMS, the petitions said.

An eye witness told the tribunal that he was the victims' colleague and they all were going home together after closing the restaurant. When they reached AIIMS flyover, the dumper hit them from behind leading to their deaths on the spot, he said.

He had informed the police and the driver of the dumper was caught near Hyatt Hotel here and a criminal case was registered against the dumper driver at Safdarjung Enclave police station.
