Go to trial court, HC tells woman in car hit-and-run case

A woman accused of fatally knocking down a man with her luxury Audi car in an inebriated condition was told by the Madras High Court today to move the trial court for getting bail.

Justice S Vaidyanathan, disposing of the bail petition, said "the petitioner has approached this court without availing the alternative remedy available in the lower court."

On July 2 early morning, Aiswarya Wilton had allegedly hit Munusamy, a carpenter, with her speeding Audi car on 'Rajiv Gandhi Salai here.

The victim was waiting to cross the road when the car hit him, killing him on he spot. The public gave a chase and managed to stop the car.
 

She was arrested and remanded to judicial custody the same day on the charges of rash driving and culpable homicide not amounting to murder under IPC read with Section 185 (drunken driving) of Motor Vehicles Act.

Counsel for Aiswarya submitted that even assuming that the petitioner had consumed alcohol, it would definitely have been less than the percentage prescribed.
