Gupta urges Kejriwal to follow procedures

Leader of Opposition in Delhi Assembly, Vijender Gupta today said that the Arvind Kejriwal-led government was misleading the public by claiming that its decisions do not require approval of the Lt Governor Najeeb Jung.

In a letter to the Chief Minister, Gupta noted that most of the government's decisions "have not been referred for statutory approval of the Lt Governor and it has made them vulnerable to judicial scrutiny and subsequent annulment".

Referring to the reversal of government's order on management quota in private schools by the Delhi High Court, Gupta said it was set aside "primarily because it was not approved by the Lt Governor".
 

"These are specific statutes where the Constitution has entrusted the power to the administrator or LG to regulate the issues as per laid down procedure and manner," Gupta said.

"The government has been misleadingly claiming that the government's decisions do not require approval of the Lt Governor. More than 50 important notifications issued in the name of Lt Governor and Delhi government are pending and have not been referred to the LG for his approval," he said, adding, "It has potential for judicial annulment and consequent serious setback to public interest issues."

The matters which have not been referred to the Lt Governor for his approval pertain to notifications, constitution of Commissions, revenue, appointments, induction of personnel etc, Gupta said and urged the CM to "follow due procedures.
