HC upholds single-bench order nullifying Act

The Calcutta High Court today upheld a single bench order that nullified the West Bengal Madrasa Service Commission Act, 2008.

A division bench of Chief Justice Manjula Chellur and Justice Joymalyo Bagchi rejected an appeal by West Bengal government and held that the Act was unconstitutional.

The constitutionality of the Act was challenged by Contai Rahmania High Madrasa, an educational institution, in 2013 before the high court.

In 2014, Justice Sambuddha Chakraborti had in his judgement declared that the Act was unconstitutional.

Challenging the order, the state government had moved an appeal before the division bench.
