Family members of a 45-year-old man, who died after being hit by a rashly driven vehicle, have been awarded a compensation of around Rs 12 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Kiran Bansal directed HDFC Ergo General Insurance Co Ld, insurer of the offending vehicle, to pay Rs 11,99,619 to wife and five children of victim Kunwar Sain who was injured in January 2011.
"From the statement of Deen Dayal (deceased's brother and eyewitness to the incident) and in view of the criminal case record regarding the accident, it is proved that Kunwar Sain sustained fatal injuries in the accident which occurred on January 12, 2011 due to rash and negligent driving of offending vehicle," the tribunal said.

"I am of the opinion that respondent no 3 (firm) being insurance company is liable to pay the compensation on behalf of respondents no 1 (owner) 2 (driver)," tribunal's president said, adding, "the total compensation would amount to Rs 11,99,619".
According to the petition, on January 12, 2011, while Sain was crossing a road in Noida, a vehicle, being driven negligently, hit him from behind.
Due to the impact, he fell down and was immediately rushed to a hospital where doctors declared him brought dead.
The driver and the owner of the vehicle, however, submitted in their reply before the tribunal that the accident occurred due to negligent attitude of the deceased himself.
