The Madras High Court on Thursday declared invalid the 2019 election of expelled AIADMK member O P Ravindhranath from Tamil Nadu's Theni constituency. Ravindhranath is the son of deposed AIADMK leader and former Chief Minister O Panneerselvam. Justice SS Sundar also declared the seat vacant. However, on a request made by the counsel for Ravindhranath, the judge suspended the operation of the order for a month to enable him to file an appeal before the Supreme Court. The ruling came on a petition filed by a voter from Theni constituency named P Milani. According to advocate V Arun, counsel for Milani, the petitioner contended that Ravindhranath while filing his nomination for the election had suppressed various materials including the particulars of his movable and immovable assets and liabilities, and those of his family members. A special court here trying cases against MPs and MLAs on Thursday acquitted Tamil Nadu Higher Education Minster K Ponmudy in a land grabbing case. Holding that the prosecution had failed to prove the case beyond any reasonable doubt, Special Judge G Jayavel acquitted Ponmudy, a senior DMK leader and six others. The prosecution case was that during the period 1996-2001 when Ponmudy was Transport minister in the then DMK regime, he had grabbed 3,630 sq. ft. of government land at Saidapet in the city and registered it in his mother-in-law's name. Following a complaint, the Directorate of Vigilance and Anti-Corruption filed the present case against Ponmudy and 9 others. During the pendency of the case, his mother-in-law and two others died.
Tamil Nadu Governor RN Ravi should not delay any further his sanction to prosecute former Ministers in the previous AIADMK regime and clear the 13 Bills pending with him for his assent, the State government urged Raj Bhavan on Tuesday. Writing to Ravi, Tamil Nadu Law Minister S Regupathy said no further steps could be taken in the case involving the Gutkha scam since no reply has been received from the Raj Bhavan on CBI's request for sanction to prosecute C Vijayabaskar and B V Ramana, former Ministers in the AIADMK regime (2016-21). On September 12, 2022, the CBI's plea for sanction was forwarded to the Governor by the state Cabinet. The central agency is probing the scam in which bribes were allegedly paid by the Gutkha firms. The Delhi High Court on Wednesday asked the Election Commission of India (ECI) to decide within 10 days a representation by the All India Anna Dravida Munnetra Kazhagam (AIADMK) to update in its record the party's amended bye-laws. The order was passed by Justice Purushaindra Kumar Kaurav on a petition filed by the AIADMK and its interim general secretary Thiru K Palaniswamy, which claimed that the records of the party were not being updated owing to certain internal disputes pending in the party. Lawyer Sidhant Kumar, appearing on behalf of the ECI, said the representation made by the petitioner on the issue was being actively considered and a final decision would be taken within 10 days. "In view of the stand by the ECI, the court deems it appropriate to dispose of the petition with a direction to the ECI to decide the representation of the petitioner within 10 days," ordered the judge. The Madras High Court on Sunday allowed the conduct of the long-awaited election to the AIADMK's general secretary post as scheduled on March 26. However, the court said the results shall not be declared as it will take up on March 22 the hearing of a plea by the O Pannneerselvam camp against the party's July 11, 2022 General Council decisions, that among others expelled them. The high court heard a plea by Pannnerselvam's (OPS) aides on Sunday against the election to the powerful General Secretary post, scheduled to be held on March 26.
