Delay in listing live issues affects quality of justice: Ex-SC judge Lokur

Prolonged delay in listing of "live issues" like matters pertaining to demonetisation and abrogation of Article 370 of the Constitution, and predictable pronouncements affect the quality of justice and create a perception that there is "something wrong" with the judicial system, former Supreme Court judge Madan B Lokur said on Saturday. Speaking at a seminar organised by the Campaign for Judicial Accountability and Reforms (CJAR) here, he said the problem with listing of cases is not something new and has been there for a very long time, particularly in the Supreme Court. "But today we are talking about it because the stakes today are much higher than what they were many years ago," Justice Lokur said while addressing the seminar's first session titled 'Supreme Court Administration and Management-? Issues and Concerns'. He said matters like demonetisation, Article 370, and electoral bonds for political funding were listed in the apex court for hearing after many years. "We have h

Article 370 was biggest hurdle in J-K's development: PM Modi in Jammu

Prime Minister Narendra Modi on Tuesday said Article 370, which granted special status to Jammu and Kashmir and was abrogated in 2019, was the biggest hurdle in the development of the erstwhile state. Modi also said that after the abrogation of Article 370, Jammu and Kashmir, which is now a Union Territory, has witnessed balanced development across regions and in all sectors. Addressing a rally after launching multiple projects worth over Rs 32,000 crore for Jammu and Kashmir and projects worth Rs 13,500 crore for other parts of the country, he also said the government has reached people's doorstep in Jammu and Kashmir the first time. "This is Modi's guarantee and this will continue," he said. The prime minister said Article 370 was the main hurdle in bringing all-round development in Jammu and Kashmir and the BJP government has abrogated it. "The government whose priority is the welfare of just one family cannot think of the welfare of the common people. I am happy to see Jammu a

Azad promises to re-implement Roshni scheme if elected to power in J-K

Democratic Progressive Azad Party chairman Ghulam Nabi Azad on Sunday promised to reintroduce the Roshni scheme if his party wins the assembly elections in Jammu and Kashmir. He also promised to grant five marlas of land to people residing along the India-Pakistan border in Jammu and Kashmir. "The Roshni Act, created by me, will be implemented again if our party comes to power," Azad said at a public rally in Samba district. On November 1, 2020, the Union Territory administration cancelled all land transfers that took place under the JK State Land (Vesting of Ownership to the Occupants) Act, 2001 - also known as the Roshni Act - under which 2.5 lakh acres of land was to be transferred to existing occupants. Over 10 lakh kanals (1 acre is equal to 8 kanals) of land was retrieved in Jammu and Kashmir after the Revenue Department directed all deputy commissioners to ensure 100 per cent removal of encroachments from state land. J&K 2023: SC nod to Article 370 abrogation, key G20 meet in valley

It was a momentous year for Jammu and Kashmir as the Supreme Court gave its stamp of approval to the revocation of its special status and the bifurcation of the erstwhile state into two union territories, and the Narendra Modi-led government scored a diplomatic victory by holding a key G20 meeting in Kashmir Valley. However, another year has passed by without elections being held for the Jammu and Kashmir Legislative Assembly while urban local body and panchayat polls, which were due this winter, have been put off for the time being. The BJP-ruled Centre got a massive shot in arm when a five-judge bench of the Supreme Court upheld the government's decision taken in August 2019 on Jammu and Kashmir's special status under Article 370 of the Constitution. Regional parties like the National Conference, which was one of the petitioners against the Article 370 abrogation before the Supreme Court, and the PDP have vowed to carry on the struggle for the restoration of special status. Article 370 verdict doesn't affect China's claims over border: Official

China on Wednesday said the Indian Supreme Court's verdict on Article 370 upholding the centre's decision to carve out the union territory of Ladakh from the erstwhile state of Jammu and Kashmir does not have any bearing on its claim on the western section of the China-India border. India's Supreme Court on Monday unanimously upheld the central government's decision to abrogate provisions of Article 370 bestowing special status to the erstwhile state of Jammu and Kashmir. The apex court also upheld the validity of the Centre's decision to carve out the union territory of Ladakh from the erstwhile state of J&K and directed restoration of statehood at the earliest as well as holding elections to the assembly by September 30 next year. Asked about the court verdict upholding the validity of the decision of the Indian government to carve out the union territory of Ladakh, Chinese Foreign Ministry spokesperson Mao Ning told a media briefing here that China has never recognised the ...

Centre rejects OIC's comments on SC verdict on revocation of Art 370 in J-K

India on Wednesday strongly rejected the comments by the Organisation of Islamic Cooperation (OIC) expressing concern over the Supreme Court's verdict upholding the 2019 revocation of Article 370 of the Constitution that gave special status to Jammu and Kashmir. External Affairs Ministry spokesperson Arindam Bagchi said the OIC's action at the behest of a "serial violater of human rights and an unrepentant promoter of cross border terrorism" makes its action even more questionable. Though Bagchi did not name any country, it was clear that the reference was towards Pakistan. "India rejects the statement issued by the General Secretariat of the Organisation of Islamic Cooperation (OIC) on a judgement of the Indian Supreme Court. It is both ill informed and ill intended," Bagchi said. "That OIC does so at the behest of a serial violater of human rights and an unrepentant promoter of cross border terrorism makes its action even more questionable. India's SC verdict on Art 370 would further complicate Kashmir issue: Imran

Pakistan's jailed former prime minister Imran Khan has said that India's Supreme Court verdict upholding the abrogation of Article 370 would "further complicate" the Kashmir issue. The Supreme Court on Monday unanimously upheld the Centre government's decision of August 2019 to abrogate Article 370, which bestowed a special status on the erstwhile state of Jammu and Kashmir. Khan, who has been incarcerated in the Adiala jail of Rawalpindi, in a message said that the Indian top court's ruling was a sheer violation of the UNSC resolutions, his Pakistan Tehreek-e-Insaf party said in a post on X. Khan made it clear that the controversial and unlawful decision of the Indian top court would further complicate the Kashmir issue instead of helping to solve the decades-long conflict, it added. He vowed that his party would continue to provide full diplomatic, moral and political support to the Kashmiri people.
