Legal profession will thrive depending on how we maintain integrity: CJI

Our profession will continue to thrive or it will self-destruct based on whether we do or do not maintain our integrity, Chief Justice of India Dhananjay Chandrachud said here on Sunday. Integrity is the core of the legal profession, the CJI asserted. Integrity is not eroded by one thunderstorm, it gets eroded by small, little concessions and compromises made by lawyers and judges, the CJI said while speaking at the an event on the theme 'Enhancing collaboration between Advocates & Judges: Towards strengthening legal system'. "Our profession will continue to thrive or it will self-destruct based on whether we do or do not maintain our integrity. Integrity is eroded not by one thunderstorm, it erodes by small little concessions and compromises which are made by lawyers and judges," he said. "We all sleep with our conscience. You can fool the whole world but can't fool your conscience. It keeps on asking questions every night. Integrity is the core of the legal profession. With ...

SC refers pleas challenging sedition law to bench of at least five judges

The Supreme Court on Tuesday referred to a Constitution bench of at least five judges a batch of pleas challenging the constitutional validity of the colonial-era provision of sedition under the Indian Penal Code (IPC). A bench headed by Chief Justice D Y Chandrachud declined the request of the Centre to defer the reference to a larger bench as Parliament is in the process of re-enacting the provisions of the penal code. The bench, also comprising Justices J B Pardiwala and Manoj Misra, directed the apex court registry to place the papers before the CJI so that appropriate decision can be taken on the administrative side for constitution of a bench of "strength of at least five judges". The apex court had on May 1 deferred the hearing on these pleas after the Centre had said it was at an advanced stage of consultation on re-examining the penal provision. On August 11, in a landmark move to overhaul colonial-era criminal laws, the Centre had introduced in the Lok Sabha three bills t

CJI cautions against misusing tech, social media, AI for harmful purposes

Technology, especially one fostering quicker communication to a larger spectrum of audiences such as social media, and artificial intelligence (AI) which has permeated all sectors, should create affordances against misuse because human values and individual privacy are of paramount importance, Chief Justice of India D Y Chandrachud said here on Saturday. Contending that "new technology cannot exist in a vacuum" and hence has to be made benign with safeguards for affable use, the CJI said technology should facilitate reliable use without causing any trepidation among the people about the possible breach of their personal liberty. "Social media has allowed us to connect with people, removing barriers of age and nationality. But this new communication tool has led to new behaviour like online abuse and trolling. Likewise, AI contains the potential for misuse, mislead, threaten, or even bully individuals. Curbing its misuse for harmful purposes will be among the key challenges for you,"

Full strength SC should not be aberration but regular feature: Chandrachud

Chief Justice of India (CJI) D Y Chandrachud has said a Supreme Court functioning at its full strength should not be an aberration but a regular feature and asked the in-house think tank --Center for Research and Planning (CRP)-- to collect data of top 50 judges in the country for selection as future apex court judges. With the swearing-in of Justices Rajesh Bindal and Aravind Kumar, on February 13, this year, the top court got the full strength of 34 judges including the CJI. The CRP was set up in 2018 by the then CJI, Ranjan Gogoi, to strengthen the knowledge infrastructure of Supreme Court and, apart from research, the think tank is mandated to focus on outreach that includes explaining key decisions of the SC as well as its contribution to law and justice, besides the working of courts. The CJI was speaking at a function organised by the Supreme Court Bar Association (SCBA) on Tuesday to felicitate justices Dipankar Datta, Pankaj Mithal, Sanjay Karol, Sanjay Kumar, Ahsanuddin .

Don't mess around with my authority, angry CJI Chandrachud warns lawyer

Don't mess around with my authority, an angry Chief Justice of India (CJI) D Y Chandrachud Tuesday warned a lawyer when he mentioned a case for early hearing before a Supreme Court bench presided over by him. The CJI, who rarely loses his cool during judicial proceedings, got irked when the lawyer first sought an early hearing of his case and, after being told that it will be listed on April 17, asked for liberty to mention it before another bench. I can mention before another bench if permitted, the lawyer said. Do not play these tricks with me. You can't mention it here and then elsewhere for an earlier date, the CJI, who was sharing the bench with justices P S Narasimha and J B Pardiwala, said. Sensing the mood of the bench, the lawyer expressed regret and said he should be be excused for his submissions. Yes, you are excused. But do not mess around with my authority, the CJI said sternly and proceeded to hear mentioning of other cases for urgent hearing. Every morning, the CJ

Glossary to stop use of inappropriate gendered terms to be unveiled: CJI

Chief Justice of India (CJI) DY Chandrachud has announced that a legal glossary to guide judges against the use of inappropriate gendered terms in the legal discourse will be unveiled in the near future. Speaking at an event organised by the Supreme Court Gender Sensitisation and Internal Complaints Committee on Wednesday to celebrate International Women's Day, the CJI talked about the ongoing exercise to come up with the legal glossary. A Supreme Court bench, which was assigned a case by another bench of equal strength has said orders pertaining to placing a case before benches can only be passed by the chief justice of India. A bench of Justices BR Gavai and Vikram Nath, which was assigned a case related to consumer protection by a bench of Justices MR Shah and CT Ravikumar, said, "If the particular bench in a particular situation finds that a matter be placed before another bench, the bench is required to direct the matter to be placed before the chief justice of India for obtaining appropriate orders."
