Indiscriminate arrests gross violation of human rights: Allahabad HC

The Allahabad High Court has held that "irrational and indiscriminate arrests" are gross violation of human rights and arrest should be the last option restricted to "exceptional cases". Justice Siddhartha, during an anticipatory bail hearing against a man accused in a cow slaughter case, observed that arrests should only be carried out when custodial interrogation of the accused is required. Granting anticipatory bail to Mohammad Tabish Raza, the judge said, "After considering rival submissions, this court finds that there is a case registered or about to be registered against the applicant. It cannot be definitely said when the police may apprehend him. "After the lodging of FIR the arrest can be made by the police at will. There is no definite period fixed for the police to arrest an accused against whom an FIR has been lodged," the court said in its order dated June 12. Seers in Karnataka oppose repeal of anti-conversion, cow slaughter laws

Heads of various mutts in Dakshina Kannada district have strongly opposed the decision of the Karnataka government to repeal anti-conversion law and the cow slaughter prevention Act. The meeting of the seers condemned the recent statements by some ministers on the move to withdraw Karnataka Protection of Right to Freedom of Religion Act and amend Karnataka Prevention of Slaughter and Preservation of Cattle Act, Gurudevananda Swami of Odiyuru Mutt told reporters here on Friday. The seers called upon Chief Minister Siddaramaiah and Deputy Chief Minister D K Shivakumar not to go ahead with any move to change the Acts as it will lead to social unrest in Dakshina Kannada and other districts of Karnataka. Chief Minister Siddaramaiah on Wednesday said he will review the anti-cow slaughter law and amendments to the Land Reforms Act and the Agriculture Produce Marketing Committee Act. The chief minister was speaking to farmer leaders who called on him to convey their apprehensions about corporate agriculture, a government press release said. "Farmer leaders expressed concern that the small and marginal farmers, who constitute more than 85 per cent of the total agriculturists in the state, will be affected due to the Union government's decision to introduce corporate agriculture," the statement said. The CM said he will hold a separate meeting to discuss in detail the policies and regulations required for the development of the agriculture sector, the release said. Cowhide transport does not amount to contravention of UP cow act, says HC

The Allahabad High Court has observed that the transport of cowhide does not amount to the contravention of provisions of the UP Prevention of Cow Slaughter Act. The observation was made by Justice Mohammad Aslam On August 17 allowing a criminal revision application filed by Manjeet Tanwar against a November 11, 2021, order of the chief judicial magistrate, Agra, rejecting the release of a vehicle allegedly used to transport cowhide. On March 24, 2021, acting on information that a truckload of cowhide was being transported from Rajasthan's Dhaulpur to Agra, the police stopped the vehicle near Saiyan and seized it. The High Court held that since transportation of cowhide is not specifically prohibited under the UP Cow Slaughter Act, the special magistrate, Agra, has the jurisdiction to decide over the release of the vehicle in question. It directed the chief judicial magistrate, Agra, to pass appropriate order on the release application of the applicant within a month.
