"Today is a black day for Indian democracy," TMC general secretary Abhishek Banerjee said as he and other party leaders were released by the police on Tuesday night, hours after being detained during a sit-in at the Union Rural Development Ministry office here. Banerjee said Tuesday's incident will stand as an example of 'New India' as public representatives were "dragged and manhandled" by Delhi Police and journalists questioning the government were booked under the anti-terror law UAPA. The development came as the tug-of-war between the Centre and the West Bengal government over the release of funds to the state intensified with the TMC holding protests in the national capital for the second consecutive day. Banerjee, along with party lawmakers, state ministers and supporters including MGNREGA workers, protested at Jantar Mantar here, a day after they held a two-hour sit-in at the Rajghat on Mahatma Gandhi's birth anniversary before being evicted by the police. Union Information and Broadcasting Minister Anurag Thakur on Tuesday said probe agencies in the country are independent and work as per law, referring to the raids conducted at the premises connected with online portal NewsClick in Delhi. I need not justify the raid. If someone has done something wrong, probe agencies work on it... Nowhere is it written that if you have got money through illegal manner or done something objectionable, then probe agencies cannot investigate that, Thakur said. Delhi Police's Special Cell Tuesday morning conducted raids at 30 premises connected with online portal NewsClick as well as its journalists' houses, triggering outrage against the action among scribes. The prosecution concluded its arguments on Friday against the applications filed by some of the people accused of hatching the conspiracy behind the 2020 northeast Delhi riots, seeking to know the status of the probe in the case, saying those were not maintainable. Additional Sessions Judge Amitabh Rawat posted the matter on October 3 for rebuttal by the counsel for the accused applicants. During the proceedings, Special Public Prosecutor Amit Prasad cited a judgment and said, "A different and not less well-recognised rule, namely, where a power is given to do a certain thing in a certain way, the thing must be done in that way or not at all. Other methods of performance are necessarily forbidden." He said this doctrine of law is settled and has been followed by the Supreme Court and all other courts consistently. "So when the right is not given to the accused in the garb of this application, they cannot design a new procedure. Therefore, the maintainability of the application goes
The Supreme Court Thursday asked Delhi police not to issue temporary licences for sale and storage of any kind of firecrackers, saying when the city government has banned all firecrackers no distinction can be made on the basis of whether it is green or not. A bench of Justices AS Bopanna and MM Sundresh reserved its verdict on a plea seeking ban on firecrackers containing barium to curb pollution levels including in the Delhi-NCR region. "We have to see what level of work has been done over the years and whether any additional directions are required to be issued. We see that most of the aspects have been taken care of by various orders passed by this court from time to time," the bench observed as it reserved its verdict on a batch of pleas.
