Advocates can't be held liable under Consumer Protection Act, says SC

The Supreme Court on Tuesday held that advocates are not liable for deficiency of services under the Consumer Protection Act 1986 and cannot be sued for poor service before consumer courts. A bench of Justices Bela M Trivedi and Pankaj Mithal said the legal profession is sui generis (unique) and the nature of work is specialised and cannot be compared with other professions. "Advocates have to respect client's autonomy, not entitled to make concessions without express instructions from client and transgress authority. Considerable amount of direct control is with client of advocate. This strengthens our opinion that contract is of personal service and excluded from definition of service under Consumer Protection Act," the bench said. Bihar announces 10% reservation for EWS in judicial services, law colleges

The Nitish Kumar government in Bihar on Tuesday announced 10 per cent reservation for economically weaker sections (EWS) in the judicial services, and the state-run law colleges and universities. The decision was taken at a cabinet meeting chaired by the chief minister. "The cabinet approved amendments in the guidelines of the State Judicial Services, 1951, allowing 10 per cent reservation for EWS category in judicial services and also in state-run law institutes and universities," said Additional Chief Secretary (Cabinet Secretariat) S Siddhartha. A notification with the details will soon be issued by the department concerned, he said. The state cabinet also gave its approval for the construction of 100 veterinary hospitals in the state, Siddhartha said. "A total of 100 first-class veterinary hospitals will be constructed in different districts of the state. Besides, there will be training centers at all these hospitals. For this, Rs 225 crore will be spent in 17 districts," he .

Govt extends deadline to apply for judicial posts at NCLAT till Sept 1

The Ministry of Corporate Affairs (MCA) on Thursday said it has extended the deadline for submitting applications for the post of judicial and technical members at NCLAT till September 1. Earlier, the deadline to submit the applications was July 5, according to a notice issued by the MCA. "To widen the participation of candidates and attract the best talent, it has been decided to accept further applications, with the last date for submission of the online application being extended to September 1, 2023," the notice said. All other terms and conditions of the vacancy circular, including eligibility criteria, age limit, and qualification, for the posts remain unchanged, it added. In June this year, the government invited applications for three judicial members and two technical members at the National Company Law Appellate Tribunal (NCLAT). The principal bench of NCLAT is in the national capital, while another bench is in Chennai.

Nearly 6 million cases pending in HCs, more than 69,000 in the SC: Govt

Over 69,000 cases are pending in the Supreme Court while there is a backlog of over 59 lakh cases in the country's 25 high courts, Rajya Sabha was informed on Thursday. Citing details available on the SC website, Law Minister Kiren Rijiju said in a written reply that 69,511 cases were pending in the top court as on February 1. "There are 59,87,477 cases pending in the high courts across the country as per the information available on National Judicial Data Grid (NJDG) on February 1, 2023," he said. Out of these, 10.30 lakh cases were pending in the Allahabad High Court -- the biggest high court of the country. The Sikkim High Court has the least number of 171 cases. The government, Rijiju said, has taken several initiatives to provide "suitable environment" for expeditious disposal of cases by the Judiciary.

The government has been pushing for an all-India judicial service on the lines of IAS and IPS to select judges or judicial officers for subordinate courts.
