Taking strong note of the recent fire incident in a posh Mumbai high-rise that claimed four lives, the Supreme Court said the people were dying in such illegally-constructed buildings which had no relevant certificates or clearances. It also referred to the incidents of Bawana factory in Delhi and the Kamala Mills in Mumbai and said unregulated constructions were being rampantly carried out with the hope that "some day such buildings will be regularised". A bench of Justices Madan B Lokur and Deepak Gupta expressed concern over illegal constructions and wondered how such high-rises were being allowed to be constructed with no clearances from the authorities. "People are dying in these unauthorised constructions. You see what happened in Mumbai's Parel where a fire broke out in high rise building two days back. We have read somewhere that the building did not have an occupancy certificate. How are these high rise buildings being allowed to be built," the bench said. The top court, ...

The Bombay High court has reduced the murder term of a 35-year-old man to a lighter sentence after he claimed he stabbed his friend in self-defence as the deceased had been forcing him to engage in "unnatural sex". In an order passed earlier this month, a bench of Justices BR Gavai and Sarang Kotwal observed that the appellant's claim was plausible and it was quite likely that he stabbed his friend in the heat of the moment, while trying to protect himself. The incident took place in Mumbai's Nagpada area in 2011. The bench set aside the man's conviction on the murder charge and held him guilty of the lesser charge of culpable homicide not amounting to murder. Thus, it also set aside his life imprisonment and considered the seven years that he had already spent in custody as the appropriate quantum of punishment. The court was hearing an appeal filed by the accused challenging his conviction on the charge of murder under section 302 of the IPC and the life term awarded to him by the ..
The Delhi High Court today sentenced to life imprisonment 12 members of dominant Jat community and 21 other convicts to varying jail terms in the 2010 Mirchpur Dalit killing case in which a 60-year-old man and his physically- challenged teenaged daughter were burnt alive. The high court said there was a "deliberate targeting" of the houses of Balmiki community members by the Jats and it was "an instance of caste-based violence meant to teach the Balmikis a lesson for perceived insults". In a 209-page verdict, a bench of Justices S Muralidhar and I S Mehta said 71 years after Independence, instances of "atrocities" against Scheduled Castes by those belonging to dominant castes have shown "no signs of abating". "The incidents that took place in Mirchpur between April 19 and 21, 2010 serve as yet another grim reminder of 'the complete absence of two things in Indian society' as noted by Dr B R Ambedkar when he tabled the final draft of the Constitution of India before the Constituent ...
The Mirchpur Dalits killings was a deliberate act of targeting Balmiki houses by the Jat community mob and involved a large scale conspiracy "to teach them a lesson", the Delhi High Court today said. The high court's observations came while overturning the acquittal of 20 persons and awarding life term to 12 out of 33 members of the dominant Jat community. A bench of justices S Muralidhar and I S Mehta said Balmikis houses were set on fire in a pre-planned and carefully orchestrated manner. "This was not a case of a fire spreading quickly as a result of any accidental fire catching on to the cow dung cakes or other flammable materials which were just lying around. This was an act of deliberate targeting of the Balmiki houses by the Jat community mob and setting them on fire in a pre-planned and carefully orchestrated manner. "The entire evidence, if read carefully, more than adequately demonstrates that there was a large scale conspiracy hatched by members of the Jat community to ...

A Delhi court would hear on August 31 the bail application of journalist Upendra Rai in a money laundering case related to alleged extortion and dubious financial transactions. Additional Sessions Judge Saurabh Kulshrestra fixed the matter after the counsel appearing for Rai sought time to advance the arguments on the application. In his bail application, Rai has claimed that he was not required for further custodial interrogation and no purpose will be served by keeping him in further custody. The application said that Delhi-based scribe was ready to abide by any condition imposed by the court. Rai, currently in judicial custody, had denied before the court all the allegations levelled against him by the Enforcement Directorate. The agency, through special public prosecutors N K Matta and Nitesh Rana, had claimed before the court that "top secret documents" were recovered from Rai's possession and the ED was trying to find out how he procured them. It alleged that the accused had ...
The government today suggested to the Supreme Court that live streaming of proceedings could be introduced as a pilot project for matters of constitutional significance but not on issues which could arouse passion, affect national security or concerned matrimonial disputes or juveniles. Attorney General K K Venugopal said the success of the pilot project will determine whether live streaming should be introduced in other courts in the apex court and in courts across the country. The Attorney General said that live streaming should be delayed by 70 seconds to allow the judges to mute the sound when a lawyer misbehaves or if the matter is sensitive, like one which involves individual privacy or national security. "Live streaming of court proceedings should be introduced as a pilot project in Court no 1 (of Chief Justice of India) and only in constitution bench references. The success of this project will determine whether or not live streaming should be introduced in all courts in the ..

Live streaming of court proceedings can soon become a reality, with the Supreme Court today saying it wanted to implement the concept of "open court" to decongest the courtrooms. A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud reserved its verdict on the issue after Attorney General K K Venugopal submitted suggestions on the guidelines for live streaming of court proceedings. "We don't perceive any difficulty in live streaming. Let us first start with it and see how it goes. We are just on a pilot project. We are not ruling out anything and will improve with time. We cannot have everything together," the bench observed. The Attorney General told the court that live streaming can be introduced as a pilot project in the Chief Justice of India's court in matters of constitutional importance. The success of this project will determine whether live streaming should be introduced in other courts in the apex court and in courts across the country, he ...
