SC reserves order on Malayalam novel 'Meesha'

The Supreme Court on Thursday reserved its order on the petition seeking a ban on Malayalam novel 'Meesha'.The petitioner N. Radhakrishnan said that the book, written by S. Hareesh, contained some content which will hurt the religious sentiments.A three-judge bench of the court, headed by Chief Justice of India (CJI) Dipak Misra which also comprised Justices A.M Khanwilkar and D.Y. Chandrachud also instructed that objectionable contents or paragraphs must also be removed from the novel.The CJI also maintained the banning books should not be a culture unless it violates the section 292 of the Indian Penal Code (IPC).The apex court also asked another Malayalam weekly, 'Mathrubhumi" to produce before the court the translation of three objectionable paragraphs of 'Meesha' in five days.

Madras HC suspends sentence of ex-DMK MLA, family in disproportionate assets case

The Madras High Court today suspended the sentence awarded by a lower court to a former DMK MLA and his family in a disproportionate assets case and granted them bail. In June, A Marimuthu, his wife Thulasiammal and son Prakash were sentenced to four years' rigourous imprisonment by a Special Court in Villupuram under the Prevention of Corruption Act, 1988. The trio then filed an appeal before the high court seeking suspension of sentence. The plea came up before Justice G Jayachandran who granted them bail and directed each of them to execute a bond for Rs 5 lakh and two sureties of the same amount. Jayachandran also ordered Marimuthu and his family to appear before the trial court on the first working day of every month until further orders. According to the prosecution, Marimuthu acquired assets worth Rs 12.66 lakh, disproportionate to his known sources of income, during his tenure as MLA between 1996-2001. Ex-BSP MLA held in cheating case

Former Bahujan Samaj Party (BSP) MLA Banwari Lal Kushwaha was arrested by Maharashtra police from a Rajasthan jail in an alleged cheating case pending against him in Aurangabad, police said today. Kushwaha was produced before a court in Aurangabad today which remanded him in police custody till August 7, a senior police officer said. "We arrested Kushwaha on July 31 in connection with the cheating case registered against him Aurangabad," said Dipali Dhate-Ghadge, Deputy Commissioner of Police (Crime). Another official said the Kushwaha had been wanted in connection with the alleged cheating case of Rs 10 crore. However, he didn't share details of the case. Kushwaha was lodged in the Rajasthan jail in connection with an alleged murder case. His wife Shobharani Kushwah currently represents Dholpur seat on the BJP ticket.

Man arrested for stealing Rado watch to gift his girlfriend in Delhi

A 22-year-old man was arrested for allegedly stealing a branded watch worth Rs 90,000 to gift his girlfriend, police said today. The accused, identified as Vaibhav Khurana, is a B.Tech graduate and was working as a supervisor at a hotel in Gurugram, they added. The stolen Rado watch and a motorcycle used in commission of the crime was recovered from him, officials said. On July 23, a complainant informed police that an unknown customer had booked a ladies Rado watch worth Rs 90,000, which was available for Rs 67,000 after discount, using a mobile phone. The complainant, a delivery executive, alleged that when he reached gate no.3 of the Kashmiri Gate Metro Station here to deliver the consignment, he met the alleged customer who then took him on his motorcycle on the pretext of paying him, Deputy Commissioner of Police Nupur Prasad said. SC laments absence of provisions on children of jailed mothers, says pragmatic policy needed

The Supreme Court today expressed concern that there were no provisions to address the issue of children who have to be released from jail on attaining the age of six after staying with their incarcerated mothers and said a pragmatic policy was needed to address the issue.. Terming the issue of children staying in jail with their imprisoned mothers as an "extremely serious problem", the apex court said there was nothing to indicate as to how such minors were looked after following their release from the prison. "Surely, these children cannot be left to fend for themselves," a bench comprising justices Madan B Lokur and Deepak Gupta said. "We have expressed to the amicus curiae that it might be appropriate if a committee is appointed to look into this issue in great depth so that a viable and pragmatic policy can be made about these children," the bench said. Chief Justice of India (CJI) Dipak Misra on Thursday observed that both men and women are equally responsible for act of adultery."Both the parties have to be equally responsible for their act," said Justice Misra during the course of the hearing on a petition filed by a businessman, Joseph Shine, which sought to make men and women equally liable for the offence of adultery, under Section 497 of the Indian Penal Code (IPC).The five-judge Constitution Bench of the top court, headed by CJI Misra and comprising Justice Rohinton Fali Nariman, Justice D. Y. Chandrachud, Justice Indu Malhotra and Justice A. M. SC directs improvement of infrastructure, appointment of management professional in courts

The Supreme Court today issued a slew of guidelines, including appointing management professionals as court masters, for effective administration of judicial works and improvement of infrastructure in courts across the country. The apex court said that a sound infrastructure is the linchpin of a strong and stable judicial system and directed a number of measures, including professionally qualified court managers, electronic case display, CCTV cameras at proper locations within the court complex, video conference equipments, electricity, sufficient parking space, connectivity to jails and dispensary etc. A bench comprising Chief Justice Dipak Misra and justices A M Khanwilkar and D Y Chandrachud said that court masters, preferably with an MBA degree, be appointed in judicial districts to assist in court administration. The apex court directed Chief Secretaries of all the states to constitute a committee, which will include a members of Secretary of the Department of Law and an officer .

Germany arrests suspect over alleged Sri Lanka war crimes

German authorities have arrested a Sri Lankan man suspected of involvement in killing captured government soldiers as a member of the Tamil Tigers rebel group a decade ago. Federal prosecutors said a judge ordered Thursday the 36-year-old, identified only as Sivatheeban B. because of German privacy rules, detained pending a potential indictment. He was arrested Wednesday in the Duesseldorf area, suspected of committing war crimes and membership in a foreign terrorist organisation. Prosecutors say he belonged to the Tamil Tigers from 2006-2009. They allege that, in 2008, he tied up 16 soldiers and guarded them as they were driven to a site where they were shot. Sri Lanka's civil war ended in 2009 when government forces defeated the rebels, who fought to create a separate state for ethnic minority Tamils.

Man held in Noida for circulating video targeting a community on WhatsApp

A 22-year-old man was arrested in Changoli village here today for allegedly circulating a video against a specific community on WhatsApp, police said. A complaint was received by police in Dankaur area on Tuesday about the video doing rounds on the instant messaging platform, an official said. Working on a tip-off, Sundar Prajapati, the main accused in the case, was arrested, Dankaur police station house officer (SHO) Farmood Ali Pundir said. Prajapati has been booked under Indian Penal Code sections 153A (promoting enmity between different groups and doing acts prejudicial to maintenance of harmony), 504 (intentional insult with intent to provoke breach of the peace), among others, he said. Four others, identified as Bittu, Priyank, Saurabh and Anshu, of Changoli village, have been booked in connection with the case, the SHO said. Raghupathy panel: HC declines to grant more time to Karuna's counsel

The Madras High Court today declined to accede a plea of DMK president M Karunanidhi's counsel that he needed time to present arguments over vacating the stay on a probe panel looking into "illegalities" in the construction of a new secretariat during the DMK rule in 2010. Justice S M Subramaniam, before whom a memo was filed by counsel R Neelakandan citing Karunanidhi's hospitalisation and seeking more time to get instructions for making arguments, said he would begin the final hearing on the petition tomorrow. "Everybody prays for everybody's well being. We respect everyone, but the court should continue performing its duties," the judge said. Legal Metrology dept books 54 cases against multiplexes

Cracking the whip on multiplexes and cinema houses in the city selling food items and other packaged goods allegedly at more than maximum retail price, the Legal Metrology Department today booked 54 cases against them. According to officials, the department had issued rules and regulations to theatre and multiplexes as per Legal Metrology Department Packaged Commodities Act. Selling goods at more than MRP was illegal and violation of rules will result in penalty and imprisonment, they had earlier said. Special checks were conducted today at 20 multiplexes in the city out of which 18 multiplexes were found violating the rules and 54 cases were booked, the officials said. Controller for Legal Metrology Department Akun Sabharwal earlier said from August 1, cinema theatres and multiplexes should compulsory sell food items, water bottles and cool drinks at MRP only.

Girl dies after being hit by school bus

An eight-year-old girl died after being hit by a school bus here today. Kulsum, the victim, was playing along the road in Arif Nagar area when the speeding bus hit her, said Superintendent of Police Hemant Chouhan. The girl died on the way to hospital, he added. As the driver fled from the spot after the incident, angry residents of the area set the bus on fire, the SP said. There were no students inside as the bus was returning after ferrying them to the school. Police have registered a case against the driver.

Plea to quash FIR for submitting forged DL: HC notice to city govt, Delhi top cop

The Delhi High Court has sought response from the NCT government and the city police commissioner on a plea filed by a candidate seeking job as a driver in the police department for quashing of an FIR filled against him for allegedly submitting forged driving license. Justice Sanjeev Sachdeva issued notices to the AAP government and the top cop while directing the Delhi Police to file a status report of the investigation in the case. "Issue notice. Notice is accepted by Additional Public Prosecutor for the State who submits that the IO has written to the authorities to verify the factum of renewal of the disputed driving licence... Status report be filed before the next date of hearing," the court said. MP: Whatsapp 'admin' among 3 held for rumour-mongering

A Whatsapp group administrator was among three persons arrested today for allegedly spreading rumours about a non-existing crime in Singrauli district, police said. The main accused is identified as Surendra Dwivedi who is the 'admin' of the Whatsapp group: "Evil of Urjanchal", police said. Dwivedi allegedly posted a message that villagers in Khutar village, about 15 kms from the district headquarters, had chopped off the private parts of a man after he was found in an objectionable position with a woman, a police official said. He said no such incident had ever occurred in the village. "Two of the group members, identified as Gulam Raza and Rajesh Dwivedi, allegedly forwarded Dwivedi's post on July 30," said Kotwali police station in-charge Manish Tripathi. Girls rescued from brothels, were given hormonal injections

In the second such case in three days, four minor girls were today rescued from brothels in neighbouring Yadadri Bhongir district and six people, including five women, besides a registered medical practioner arrested, police said today. Acting on a tip-off, police teams raided the brothel houses at Yadagirigutta and arrested the six people on suspicion of trafficking. The medical practitioner, who used to administer hormonal injections to the children, all below ten years, to aid their growth, was also arrested, they said. The man, who was hired by the gang, confessed about administering hormonal injections to the children during interrogation, police said. On July 31, eight human traffickers, including six women were arrested, and 11 minor girlse rescued from brothels at Yadagirigutta.

Women's commission seeks report on gang rape case in Sangli

Taking serious note of alleged gang rape of a pregnant woman in Sangli district, the Maharashtra State Commission for Women today sought a report from the police. According to local police, a woman was allegedly raped by eight men at Tasgaon in the district, 380 km from here, on July 31. The victim was said to be eight months pregnant. The commission, in its letter to the district Superintendent of Police, cited local media reports and sought to know what action police had taken to arrest the accused. "Taking into consideration the seriousness of the crime, you (the SP) should personally intervene in the matter and take suitable action. Also submit the report of action taken at the earliest," the letter said. When contacted, SP Suhel Sharma said that police were probing the case, and would send a report to the commission soon. Nobody has been arrested in the case so far, a local police official told PTI.
