In order to reduce litigation, the CBEC today decided not to file any review appeals in 63 cases where Supreme Court, High Courts and CESTAT have ruled against the department. The Central Board of Excise and Customs (CBEC) has compiled a list of 63 orders so that cases pending in the field can be expeditiously decided, if the questions of law or facts involved are identical, an official statement said. In 14 of these orders, High Courts have decided various questions of law. In the rest 49 cases, the High Courts have delivered judgments on the basis of some settled case law or have decided points of facts or have dismissed the appeal on monetary grounds. Advocate Ajay Agrawal, who contested the 2014 Lok Sabha election from Rae Bareli against the then Congress president Sonia Gandhi, moved the plea before Chief Metropolitan Magistrate Ashu Garg, claiming that serious miscarriage of justice will occur if permission is not granted to the agency in view of new evidence emerging in the case. Suspected Maoists today shot dead a contractor in Bijepur police station area in Kalahandi district, the police said. A group of armed men stormed into the workers' camp located near Pajibahali village and fired at contractor Siba Shankar Das (53) who had gone there to pay the staff members. When he fell down, they slit his throat leaving him dead on the spot. Maoists had earlier demanded ransom from Das, who was executing a road construction project from Bijepur to Pajibahali, the police said. The contractor had been threatened and asked to stop work a few years ago when he was undertaking another project. Several earthmoving equipment were also torched at that time, the police said.
The Bombay High Court today asked the CBI to confirm whether the four police officials, who had accompanied Tulsiram Prajapati, an aide of Sohrabuddin Shaikh, to Ahmedabad just days before his death in an alleged encounter, had gone with him as his escort team on previous occasions as well. The court's question came after Rajasthan IPS officer Dinesh M N, one of the discharged accused in the encounter case of Sohrabuddin Shaikh, a gangster, his wife Kausar Bi, and their aide Prajapati, denied all charges against him. Dinesh claimed he had no role in choosing the escort team officials who had accompanied Prajapati to Ahmedabad for a court hearing. The Supreme Court today delivered a crucial verdict to resolve the decades-old dispute between southern riparian states over Cauvery river water sharing by hiking Karnataka's share by 14.75 tmcft and reducing Tamil Nadu's quantum while compensating it by allowing extraction of 10 tmcft groundwater from the river basin. Maintaining that the issue of drinking water has to be placed on a "higher pedestal", the top court enhanced Karnataka's share from 270 tmcft to 284.75 tmcft on account of water for drinking and domestic requirements, while lowering Tamil Nadu's share of water from 419 tmcft to 404.25 tmcft but allowing it to extract 10 tmcft of groundwater from the river basin. A Railway court today sentenced three constables to three years in jail for looting passengers on board the Jan Nayak Express five years ago. Bettiah Railway Judicial Magistrate Sriram Jha held Navin Kumar, Uday Narayan Singh and Uday Prasad Choudhary guilty of looting passengers. On August 27, 2012, the three constables, who were part of an escort party on the train, had forcibly taken money from a traveller after beating him up for failing to provide identity card, Additional Public Prosecutor (APP) Balkrishna Dubey said. The escort party forcibly took money and misbehaved with another passenger, he added. An FIR was filed at the Narkatiyaganj rail police station in this regard. A Catholic priest, accused of raping a Bangladeshi woman, today surrendered before a court in Vaikom in the district. Thomas Thanninilkkumthadathil (36) had gone into hiding after the woman filed a police complaint on Wednesday. As police intensified the search, the priest surfaced in the magistrate court in Vaikom with his lawyer and surrendered. The court remanded him in 14-day judicial custody. In her complaint, the 42-year-old UK-based Bangladeshi woman alleged that the Syro-Malabar Catholic Church priest raped her after befriending her on Facebook, police said. The Jharkhand High Court today granted four-week provisional bail for treatment to former Bihar chief minister Jagannath Mishra, who is in jail after being convicted in a fodder scam case last month. Justice Aparesh Kumar Singh granted provisional bail to Mishra till March 15 after a medical report said he is suffering from cancer and required a treatment which is not available here. The 80-year-old former chief minister, who surrendered on February 5 to serve the jail term, was directed by the high court to surrender on or before March 16 this year. German authorities have arrested a 20-year-old Somali man on suspicion of being a member of the extremist militia al-Shabab. Federal prosecutors say the man was detained on Thursday in the central state of Hesse. Prosecutors said in a statement that the suspect, identified only as Abduqaadir A. in line with German privacy laws, is suspected of attempted murder and accessory to murder. He is alleged to have joined al-Shabab in Somalia in 2012, undergone weapons training and then taken part in the killing of a person at a mosque. The suspect is alleged to have later attempted to kill a member of the Somali government, who survived the attack. After being detained by al-Shabab for failing to carry out the killing, the suspect fled Somalia and reached Germany in 2014.
Karnataka Chief Minister Siddaramaiah today said that though the Supreme Court verdict on the Cauvery issue was not as per the state's appeal, he was happy with it as "we have got some relief". Siddaramaiah also said he did not want to say that the verdict was a defeat for any state and noted that the apex court had only responded to "our difficulties." The Pakistan government today informed the high court here that it is working on a legislation to introduce strict punishment for false accusations of blasphemy. According to the blasphemy law, which is part of the Pakistan Penal Code, the punishment for blasphemy ranges from several years in prison to death. The Islamabad High Court (IHC) last year in a verdict related to online blasphemous content had tasked the government with enhancing punishment for those falsely accusing others of blasphemy. The interior ministry submitted a draft of the proposed amendments to the Prevention of Electronic Crimes Act (PECA) 2016 to the court which makes the punishment for a false accusation of blasphemy equal to the punishment for committing actual blasphemy. But maximum punishment for a false accusation is only six months in jail or a minor Rs 1,000 fine, which makes the misuse of blasphemy laws easier. A district court has acquitted four persons including two women of the charge of trying to convert people by offering inducements. Magistrate Dharmendra Tada acquitted Ramesh Kothe (59), Chandramohan (47), Janki Verma (41) and Maya (36) yesterday. "The case had been registered against these four on the complaint of Shivraj Singh under the Madhya Pradesh Religious Freedom Act on November 7, 2014," defence lawyer Shailendra Dwivedi told reporters. Singh had alleged that the accused were trying to lure people to convert to Christianity by offering government jobs and interest-free loans of Rs 5 lakh. However, most of the prosecution witnesses didn't support the charges, the defence lawyer said.
The rate of juvenile offenders executed in Iran has surged this year, the United Nations said today, demanding an "immediate halt" in death sentences for crimes committed by those under 18. According the UN human rights office, Iran has already put three juvenile offenders to death in 2018, compared to a total of five such executions in all of 2017. There are currently 80 people on death row for crimes allegedly carried out when they were minors, the rights office said in a statement. Iran should "abide by international law and immediately halt all executions of people sentenced to death for crimes committed when they were under eighteen", UN rights chief Zeid Raad Al Hussein said, noting the "surge" in capital punishments. "No other State comes even remotely close to the total number of juveniles who have been executed in Iran over the past couple of decades", Zeid said. An NGO, which had challenged the allocation of 2G spectrum during the erstwhile UPA regime, today moved the Supreme Court against the appointment of Additional Solicitor General Tushar Mehta as the special public prosecutor in the case, claiming it amounted to contempt of the court. The NGO Centre for Public Interest Litigation said Mehta's appointment as CBI prosecutor was in violation of the apex court orders passed in 2011 and 2014 which made senior advocate Anand Grover as the special public prosecutor in the case relating to 2G scam. The apex court had in 2011 appointed then senior advocate U U Lalit as the special public prosecutor for the 2G cases. However, due to his elevation to the top court, it appointed Grover on September 2, 2014 on the suggestion of then senior lawyer K K Venugopal, who is now the Attorney General.
