Order on ex-IPS officer Pandey's discharge plea on Feb 16

A special CBI court here today concluded the hearing on a discharge application filed by former Gujarat director general of police P P Pandey in the Ishrat Jahan "fake" encounter case with Judge J K Pandya reserving the order for February 16. Pandey, currently out on bail, had contended that the statements of two witnesses against him were contradictory and that none of the other 105 witnesses examined by the court had named him. The Central Bureau of Investigation (CBI) had named him as an accused in its chargesheet, without obtaining the mandatory sanction from the Centre, Pandey's lawyer told the court. He also referred to Pandey's elevation as the in-charge DGP (even when the case was pending against him) as one of the grounds for discharging his client from the case. Pandey had resigned in April last year after his appointment as the in-charge DGP was challenged in the Supreme Court. The CBI had opposed his discharge plea, saying it had enough evidence to prove ...

Government asks judge to toss suit by ex-Trump campaign head

The Justice Department is asking a judge to dismiss a lawsuit by Donald Trump's former presidential campaign chairman. Paul Manafort was indicted in October in special counsel Robert Mueller's (MUHL'-urs) Russia investigation. A suit Manafort filed last month challenges the scope of Mueller's appointment and authority. The government says in a court filing yesterday that a judge should throw out that suit. Justice Department lawyers say federal courts are prohibited from interfering with ongoing criminal prosecutions, and that Mueller's been operating properly and not exceeded his authority. The department says if Manafort believes he's being unfairly prosecuted, then he can file a motion in his criminal case to seek to have it dismissed. Miguel Roman, of Manchester, filed the federal lawsuit against the city and police officials in March 2011, alleging malicious prosecution, suppression of evidence and violation of his civil rights. City officials deny the allegations. His lawyers have been seeking information on the city's insurance policies since the lawsuit was filed nearly seven years ago. "Mr Roman is satisfied that the court granted him the relief that he sought," said his lawyer, Rosemarie Paine. "The court's ruling provides a timeline for taking the necessary steps to locate the missing policy
