In a historic verdict, the Supreme Court on Friday ruled that besides the State, a victim of a criminal offence can also file an appeal under the Code of Criminal Procedure (CrPC) in superior courts challenging acquittal of the accused without prior nod of the appellate court. In a 2:1 majority judgement, a three-judge bench headed by Justice M B Lokur held that section 372 of CrPC (which deals with provision of appeals in criminal cases) has to be given "realistic, liberal, progressive" interpretation to benefit the victim of an offence. Justice Lokur, who wrote the judgement for himself and Justice S Abdul Nazeer, said "there is no doubt that the proviso to Section 372 of the Cr.P.C. must be given life, to benefit the victim of an offence" and also referred to the United Nation's General Assembly's resolution to hold that besides the State, the victims are also entitled to appeal against the acquittal of the accused. The Supreme Court on Friday agreed to examine a plea by a woman judicial officer, who had resigned in the wake of enquiry on her complaint of alleged sexual harassment against a sitting high court judge, seeking reinstatement in service. The High Court judge was given a clean chit in December 2017 by a Rajya Sabha appointed panel which probed the charges of sexual harassment against him. A bench of Justices A K Sikri and Ashok Bhushan issued notice to registrar general of Madhya Pradesh High Court as also the state government and sought their response in six weeks. Senior advocate Indira Jaising, appearing for the petitioner, said that issue of reinstatement in service needs to be looked into by the court and the high court's administrative order of January 11, 2017 set aside. Three persons were arrested on Friday for allegedly trying to extort Rs 1 crore from a nursing home operator, police said. The accused were identified as Babu Hasan, Arman Ansari and Fardeen Khan and were arrested from different localities, they said. On September 29, one Muslim Ali, who runs a nursing home in Navada area, received an extortion letter demanding that he pay Rs 1 crore or face dire consequences, they said. Ali lodged an FIR against unknown persons on October 1, they added. During interrogation, the trio revealed that a fourth person, Ashraf Ali, was involved in the extortion bid, the police said, adding that efforts are underway to nab him.
A Turkish prosecutor on Friday asked a court to end the house arrest and foreign travel ban of US pastor Andrew Brunson, reports said, raising the prospect he could be freed after two years of detention. The prosecutor requested that Brunson be sentenced to up to 10 years in jail on charges of membership of a terror group at the latest trial hearing in the western town of Aliaga in Izmir province, state-run TRT Haber TV said. But crucially, he also requested for the court to lift the house arrest and travel ban imposed on the pastor, who was first detained in October 2016. If the court agrees to the requests, Brunson could return back to the United States immediately and thus end the friction over his case that caused a crisis in relations between NATO allies Ankara and Washington. A 22-year-old businessman died after he allegedly fell from rooftop of a five-storied hotel where he was staying, police said Friday. The man from Baran district had come here for some work and was staying at the hotel, Sub Inspector at Dadabari Police Station Ramesh Chand said. In CCTV cameras installed at the hotel, he was seen going to rooftop of the and then jumping from there, circle in charge Chuttan Lal said. It looks like a case of suicide, however, no note was recovered from his possession. His parents have alleged he was pushed down from the rooftop, the circle in charge said. On a complaint filed by the father of the deceased youth, police has lodged a case of murder against the unidentified person and initiated the investigation into the matter, Lal said. The body was handed over to the family members after post-mortem, he added.
A Nawada court Friday sentenced two brothers to life imprisonment for throwing acid on a girl. Mohammad Amir Hasan and Mohammad Ahsan Alam were held guilty of the crime by Additional District and Sessions Judge (ADJ) Kaushalesh Kumar. The court also slapped a fine of Rs 3,20,000 on both of them, Additional Public Prosecutor (APP) Anil Kumar said adding, that Rs 3,20,000 will be paid to the victim's family. The incident occurred on September 19, 2015 in Pachrukhi village of the district. Amir wanted to marry the girl who refused his proposal after which he with the help of his brother and another person Mohammad Bilal threw acid on her while she was sleeping at her home in Pachrukhi village, the APP said. The victim's face and parts of her body were badly burnt while her younger sister too received burn injuries, the APP added. Bilal, the third accused in the case, is still absconding, APP said.

Two suspected drug peddlers, belonging to an interstate narcotic cartel, were nabbed from near Commonwealth Games village with six kilogram of heroin worth Rs 24 crores in the international market, police said on Friday. According to police, the two accused, Ikram (30) and Arvind Rana (35), have been supplying heroin to their clients in Delhi and Uttar Pradesh's Meerut and Saharanpur for the last 10 years. In they last one year, they have supplied over 80 kg of heroin to drug peddlers in Delhi, a police official said. "Do you want everybody in this country to be vegetarian?," the Supreme Court Friday asked a petitioner who has challenged export of meat from India. A bench of Justices Madan B Lokur and Deepak Gupta made this observation while hearing a public interest litigation (PIL) which said that export of meat cannot be encouraged or promoted in the country. "We cannot pass an order that everyone should become vegetarian," the bench told the counsel appearing for the petitioner organisation. The counsel told the court that this matter should be heard after which the bench posted it for hearing in February. The court also dealt with a separate petition filed by the organisation on the issue of promoting organic farming in the country. At the outset, the bench said that this issue was for the government to decide. The Delhi High Court on Friday directed the AAP government to notify the names of family court judges, which was being delayed due to lack of LG's view on it amid the vexed issue as to who is the administrative head of the national capital despite a Supreme Court ruling on the issue. The AAP government had approved the names for notification but the decision was held up by the Principal Secretary, Law Department, as the Lieutenant Governor's view had not been sought. A sub-inspector of the traffic police here was nabbed Friday for allegedly demanding and accepting a bribe to issue a vehicle no-objection certificate, a Maharashtra Anti-Corruption Bureau official said. Sub-inspector Atmaram Patil (54) had demanded Rs 8,000 from a person who wanted an NOC for a transport vehicle ferrying over-dimensional cargo, the ACB said in a release. The amount was brought down to Rs 5,000 and Patil was caught while accepting the money in a trap laid by the ACB following a complaint, said the official. Patil has been arrested under relevant sections of the Prevention of Corruption Act and further probe was underway, the ACB official said.
A 55-year-old man died on Friday, a day after he was thrashed by his neighbour over a parking dispute, his family members claimed, even as police said there were no injury marks on his body and he was suffering from hypertension. The deceased, identified as Bhopal Singh, was a resident of Baljit Nagar in central Delhi, the police said. At around 7.15 am on Thursday, Singh asked his neighbour Vipin not to park his motorcycle in front of his house, police said, citing another neighbour of the deceased. This led to an argument between Singh and Vipin, police said. Singh, who had some health issues, collapsed at a police station later. In a major crackdown on drug peddlers, the Haryana Police Friday arrested one person and seized 100 kg cannabis leaves allegedly being smuggled in a carin Jhajjar district, officials said. On a tip-off, a police team signalled a car bearing Delhi registration number to stop. On checking, the team found five bags of cannabis leaves weighing 100 kg, a spokesman of the state police department said. Police arrested the driver who was later identified as Rajesh, a resident of Basai Enclave in Gurgaon, he said. During preliminary investigation, it was revealed that Rajesh and his accomplice were also engaged in illegal trade of liquor smuggling, he said. "A case under the Narcotics Drugs and Psychotropic Substances Act had been registered against them in city police station, Bahadurgarh," he said. The accused was produced before the court from where he was sent in judicial custody.

A court here on Friday directed the Delhi police to hand over certain documents to Congress leader Shashi Tharoor, accused in a case related to the death of his wife Sunanda Pushkar. Additional Chief Metropolitan Magistrate Samar Vishal passed the directions after he was told by senior advocate Vikas Pahwa, appearing for Tharoor, that certain electronic evidence, provided by the prosecution, was not in good condition. The police, represented by public prosecutor Atul Srivastava, told the court that fresh copies will be given to Tharoor, after which the court fixed the mater for further hearing on October 23.
