India, Bangladesh recognise their constitutions as living documents: CJI

Chief Justice of India D Y Chandrachud on Saturday said both India and Bangladesh share the tradition of constitutional and judicial systems largely aiming to ensure stability and both nations recognised their constitutions as "living documents." "Our shared tradition aims to ensure stability, but when stability is desired, the stability must never be confused with stagnation," Chandrachud said as he spoke at the valedictory function of a two-day conference here in the presence of Bangladesh Prime Minister Sheikh Hasina, who was the chief guest. We recognise our constitutions are living documents. The constitutions of Bangladesh and India proclaim that they are 'given to the people by the people themselves' as citizens of sovereign nations, Chandrachud said. Bangladesh's Chief Justice Obaidul Hassan chaired the event. Court issues summons to brewery, its MD, 8 others in money laundering case

A special court here has issued summons to Jogeshwari Breweries Private Limited (JBPL), its managing director and eight others in a money laundering case related to allegedly obtaining a loan of more than Rs 83 crore from United Bank of India through forgery. Special judge M G Deshpande hearing cases filed under the Prevention of Money Laundering Act (PMLA) on February 17 took cognisance of the Enforcement Directorate's chargesheet against 10 accused in the case, including JBPL's managing director Umesh Shinde. The prosecution's complaint also demonstrates such trail of money, its siphoning off by way of placing, layering and integration, the court said. Hence, prima facie there is ample material and evidence to hold accused for proceedings against them for offence punishable under relevant provisions of the PMLA, the court said while issuing summons to the accused. Convene daylong Parliament session to bring law on MSP: Farmer leader

Farmer leader Sarwan Singh Pandher on Tuesday said the Centre should convene a daylong Parliament session to bring a legislation on the minimum support price (MSP) for crops, a key demand of protesting farmers. He also asked the Centre to accept the other main demands of the farmers, including farm loan waiver. Pandher's statement came a day after the farmer leaders taking part in the "Delhi Chalo" agitation rejected the BJP-led Centre's proposal for procuring pulses, maize and cotton at the MSP by government agencies for five years, saying it was not in favour of farmers. WBIDC moves HC challenging arbitration award to TaMo over Singur plant

The West Bengal Industrial Development Corporation (WBIDC) on Monday moved the Calcutta High Court, challenging an arbitration award to Tata Motors Ltd on account of loss of capital in investments made in the abandoned car manufacturing plant at Singur. The court of Justice Mousumi Bhattacharya, before which applications by WBIDC for a stay on the award and an appeal challenging the arbitration award were listed for hearing, released both the matters on Monday. These will be placed before the Chief Justice of the high court for fresh listing before another bench. In its appeal, WBIDC claimed that it had been denied equal opportunity during the hearings before the arbitral tribunal. NCLT orders Mehul Choksi-promoted Gitanjali Gems' liquidation under IBC law

The National Company Law Tribunal (NCLT) has ordered liquidation of jewellery retailer Gitanjali Gems, promoted by absconding diamantaire Mehul Choksi, under Section 33 of the Insolvency and Bankruptcy Code, 2016. The bench also appointed Santanu T Ray as the liquidator, who will complete the liquidation process as per the provisions of the IBC, 2016, according to an NCLT order, filed on BSE. The resolution professional of the jewellery retailer, Vijay Kumar Garg, filed the application for liquidation in NCLT. Garg informed the tribunal that on account of the alleged fraud perpetrated by Gitanjali Gems and its officers, the affairs were under investigation by multiple law enforcement agencies like the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI). He said that the ED had issued orders attaching the properties of Choksi. Delhi court denies statutory bail to Sharjeel Imam in sedition case

A court here on Saturday dismissed the plea of student activist Sharjeel Imam seeking bail on the grounds that he had been in custody for the last four years, which was more than half of the maximum sentence prescribed for the offence. The court directed to continue Imam's custody, saying the present case was "different" from other cases because of the nature of allegations against Imam and his "disruptive activities which finally resulted in the riots". Additional Sessions Judge Sameer Bajpai was hearing Imam's plea seeking bail under 436A of the Code of Criminal Procedure (CrPC), saying he was in custody since January 28, 2020, while the maximum sentence for the offence under section 13 (punishment for unlawful activities) of the Unlawful Activities (Prevention) Act is seven years, if convicted. SC tags plea challenging Triple Talaq law validity with pending petitions

The Supreme Court on Friday ordered clubbing a fresh plea challenging the validity of certain provisions of the 2019 law, which make the practice of instant divorce through Triple Talaq a punishable offence, with those already pending with the court. Violation of the law entails imprisonment up to three years. A bench comprising Chief Justice D Y Chandrachud and Justices JB Pardiwala and Manoj Misra agreed to hear the plea along with pending petitions on which notices were issued to the Centre in 2019. 2020 Delhi riots: Court convicts son of rioting charges, acquits father

A court here has convicted a man of unlawful assembly and arson charges in a case related to the 2020 northeast Delhi riots, while acquitting his father of all alleged offences. Additional Sessions Judge Pulastya Pramachala was hearing a case against Jony Kumar and his father Mitthan Singh, who were accused of being part of a riotous mob that torched two houses in the Khajuri Khas area here on February 25, 2020 during the communal riots. SC to decide on validity of Centre's electoral bonds scheme on February 15

The Supreme Court is scheduled to pronounce its verdict on Thursday on a batch of petitions challenging the validity of the electoral bonds scheme. A five-judge Constitution bench headed by Chief Justice D Y Chandrachud had on November 2 last year reserved its verdict in the matter. The scheme, which was notified by the government on January 2, 2018, was pitched as an alternative to cash donations made to political parties as part of efforts to bring in transparency in political funding. According to the provisions of the scheme, electoral bonds may be purchased by any citizen of India or entity incorporated or established in the country. An individual can buy electoral bonds, either singly or jointly with other individuals. Only the political parties registered under Section 29A of the Representation of the People Act, 1951 and which secured not less than 1 per cent of the votes polled in the last elections to the Lok Sabha or a state legislative assembly are eligible to receive .

SC proposes to inspect closed Vedanta group's copper plant in Tamil Nadu

The Supreme Court on Wednesday proposed a panel of domain experts to inspect the closed Sterlite copper unit in Tamil Nadu's Tuticorin and suggest further compliances and way forward, saying shutting down a plant of national importance will not serve anybody's purpose. The plant is closed since May 2018 after 13 people were killed as police opened fire to quell a protest over alleged pollution caused by it. The top court, while hearing a plea by the Vedanta group company, mooted the idea of setting up of a panel of experts and sought views of the firm, the Tamil Nadu government and the state pollution control board. Ultimately, shutting down the plant of national importance will not serve anybody's purpose, a bench comprising Chief Justice DY Chandrachud and Justices J B Pardiwala and Manoj Misra observed.
