SC permits minor rape survivor for medical termination of 30-week pregnancy

The Supreme Court on Monday permitted a 14-year-old alleged rape survivor to undergo medical termination of her almost 30-week pregnancy. Exercising its powers under Article 142 of the Constitution which empowers it to pass any order necessary for doing complete justice in any case, a bench headed by Chief Justice D Y Chandrachud directed the dean of the Lokmanya Tilak Municipal Medical College and General Hospital (LTMGH) at Sion in Mumbai to set up a team of doctors immediately for terminating the pregnancy. It also set aside the Bombay High Court order declining the plea, filed by the father of the minor, seeking medical termination of her pregnancy. The top court had on April 19 ordered medical examination of the minor. It had sought a report from Mumbai's Sion hospital about the girl's possible physical and psychological condition if she undergoes medical termination of pregnancy or if she is advised against it. The Centre has amended the surrogacy rules 2022 allowing married couples to use an egg or sperm of a donor in case one of the partners is suffering from a medical condition. The District Medical Board has to certify that either the husband or wife is suffering from a medical condition necessitating the use of donor gamete. "In case when the District Medical Board certifies that either husband or wife constituting the intending couple suffers from a medical condition necessitating use of donor gamete, then surrogacy using donor gamete is allowed," the notification issued on Wednesday said. The surrogacy using donor gamete is allowed subject to the condition that the child to be born through surrogacy must have at least one gamete from the intending couple, it stated. Lupin gets approval from USFDA for pregnancy prevention drug 'Minzoya'

Pharma major Lupin Ltd on Friday said it has received approval from the US health regulator to market its generic 'Minzoya' tablets used to prevent pregnancy. The approval granted by the US Food and Drug Administration (USFDA) is for the abbreviated new drug application for Minzoya (Levonorgestrel and Ethinyl Estradiol tablets, and Ferrous Bisglycinate tablets) of strengths 0.1 mg/0.02 mg and 36.5 mg, Lupin said in a regulatory filing. The drug is a generic equivalent of Balcoltra (Levonorgestrel and Ethinyl Estradiol Tablets, USP and Ferrous Bisglycinate Tablets) 0.1 mg/0.02 mg and 36.5 mg, of Avion Pharmaceuticals LLC, it added. The product will be manufactured at Lupin's Pithampur facility in India, the company said. Minzoya tablets are indicated for use by females of reproductive potential to prevent pregnancy. A recent study on the level of awareness of medical termination of pregnancy has claimed that one of every three women it interviewed did not consider abortion as a health right or were unsure of it. The survey by the NGO Foundation for Reproductive Health Services India (FRHS India) also claimed 32 per cent of respondents were unaware of abortion as a legal right and that 95.5 per cent of Indian women were uninformed of the existence of the Medical Termination of Pregnancy (Amendment) Act, 2021. FRHS India, which provides clinical family planning services in the country, recently released the findings of its study on the level of awareness of the MTP Act and practices related to safe abortion.
