PM Modi's degree row: SC stays defamation proceedings against AAP leaders

The Supreme Court on Tuesday stayed the proceedings before a trial court on a defamation complaint filed by the Gujarat University against Delhi Chief Minister Arvind Kejriwal and AAP MP Sanjay Singh for their alleged remarks about Prime Minister Narendra Modi's educational qualification. A bench of Justices B R Gavai and Sandeep Mehta passed the order while hearing Singh's plea seeking a transfer of the case pending before a trial court in Gujarat outside the state, preferably in Kolkata. The apex court asked the Gujarat High Court to take a decision within four weeks on a plea filed by the Aam Aadmi Party (AAP) leaders seeking quashing of the summonses issued to them by the trial court. The bench said in the meantime, the proceedings before the trial court will remain stayed. Singh, in his plea filed in the top court through advocate Karan Sharma, had alleged bias in the proceedings before the trial court, saying while the plea was pending before the high court, the trial judge w

SC stays HC order for court-monitored survey of Shahi Idgah in Mathura

The Supreme Court on Tuesday stayed the Allahabad High Court order that allowed a court-monitored survey of the Shahi Idgah mosque adjoining the Krishna Janmabhoomi temple in Mathura. A bench of Justices Sanjiv Khanna and Dipankar Datta stayed the implementation of the December 14, 2023 order by which it had agreed to the appointment of a court commissioner to oversee the survey of the mosque premises which, the Hindu side claims, hold signs suggesting that it was a temple once. The bench said there are certain legal issues which have arisen and questioned the vague application made before the high court for appointment of a court commissioner for the survey. You can't file a vague application for appointment of court commissioner. It should be very specific on the purpose. You can't leave everything to the court to look into it, the bench told senior advocate Shyam Divan, appearing for Hindu bodies like Bhagwan ShriKrishna Virajman and others The bench said it is issuing notice to

The Supreme Court is scheduled to deliver on January 16 its verdict on former Andhra Pradesh chief minister and TDP chief N Chandrababu Naidu's plea challenging the high court order refusing to quash the FIR against him in the Skill Development Corporation scam case. Naidu was arrested on September 9 last year for allegedly misappropriating funds from the Skill Development Corporation when he was the chief minister in 2015, causing a purported loss of Rs 371 crore to the state exchequer. Naidu has denied the allegations. The Andhra Pradesh High Court had on November 20 last year granted him regular bail in the case. An apex court bench comprising Justices Aniruddha Bose and Bela M Trivedi had on October 17 last year reserved its verdict on Naidu's plea challenging the September 22, 2023 high court order refusing to quash the FIR against him in the case. During the hearing on the plea before the apex court, the counsel appearing for the state had argued that Naidu's petition for ...

SC refuses to stay Bill on appointment of CEC, ECs; issues notice to Centre

The Supreme Court on Friday refused to stay the new law that provides for appointment of the chief election commissioner and election commissioners by a panel excluding the Chief Justice of India. A bench of Justices Sanjiv Khanna and Dipankar Datta, however, agreed to examine a batch of petitions challenging the new law and issued notice to the Centre. The bench asked senior advocate Vikas Singh, appearing for Congress leader Jaya Thakur, who sought a stay on the new law, to serve a copy of the petition to the Centre's counsel. "Please stay this law. This is against the separation of powers," Singh said. The bench told Singh, "No, without hearing the other side, we can't. We will issue a notice." GM Mustard: Why reports of panel not considered by GEAC, SC asks Centre

The Supreme Court on Thursday questioned the Centre about why reports of the court-appointed Technical Experts Committee (TEC) on biosafety of genetically modified (GM) Crops were not looked into by the Genetic Engineering Appraisal Committee (GEAC). A bench of Justices BV Nagarathna and Sanjay Karol asked Attorney General R Venkataramani, appearing for the Centre, whether the GEAC or a sub-committee of experts ever considered the reports filed by TEC before the October 25, 2022 decision to approve the environmental release of transgenic mustard hybrid DMH-11. The attorney general said being a statutory body, the GEAC is not supposed to go into these reports but has considered every relevant scientific finding before giving the go-ahead for the environmental release. Responding to the top government law officer's contention, Justice Nagarathna said, "The reason why we are asking this is because GEAC was not working in a vacuum. It is not unguided. SC to hear union minister Pramanik's anticipatory bail plea on Friday

The Supreme Court on Thursday agreed to hear on January 12 a plea of union minister of state for home affairs Nisith Pramanik seeking anticipatory bail in an attempt-to-murder case lodged against him in 2018. A bench of Justices Bela M Trivedi and Pankaj Mithal issued notice to the West Bengal government and asked senior advocate PS Patwalia, appearing for Pramanik, to serve the copy of the petition on the counsel for the state. Money laundering case: SC extends NCP leader Nawab Malik's bail by 6 months

The Supreme Court on Thursday extended by six months the interim bail of former Maharashtra minister Nawab Malik in a money laundering case. A bench of Justices Bela M Trivedi and Pankaj Mithal extended the medical bail granted to Malik after Additional Solicitor General SV Raju, appearing for the Enforcement Directorate, said the probe agency has no objection to it. On October 12 last year, the top court extended by three months the interim bail of Malik in the case. Malik had moved the top court against the Bombay High Court's July 13, 2023, order denying him bail on medical grounds in the case being probed by the Enforcement Directorate (ED). The top court had earlier noted that Malik is suffering from kidney ailment and his condition has not improved since August 11 last year when he was granted interim bail for two months. The ED had arrested Malik in February 2022 in the case allegedly linked to the activities of fugitive gangster Dawood Ibrahim and his associates. Malik ha

Speaker's order is murder of democracy, will move SC: Uddhav Thackeray

Shiv Sena (UBT) chief Uddhav Thackeray on Wednesday said Maharashtra assembly Speaker Rahul Narwekar's decision holding that the faction led by Chief Minister Eknath Shinde was the real Shiv Sena was a murder of democracy, and his party will move the Supreme Court against it. Speaking at a press conference, Thackeray said the apex court had given clear guidelines, but those were ignored by the Speaker while giving his ruling on disqualification petitions filed by the rival Sena factions. The original case was about disqualification under the anti-defection law, but not one lawmaker from either side was disqualified, he said. "The foundation on which the order stands is wrong. This is a murder of democracy and an insult to the Supreme Court," he said, adding that neither the apex court nor the people will accept this decision. His party will approach the SC against the ruling, and will also examine if a contempt petition can be filed against the Speaker, Thackeray said. He would ..
