The Supreme Court of Nepal on Thursday cleared the way for the implementation of the newly amended Citizenship Bill which was recently certified by President Ram Chandra Paudel. A division bench of Justice Ananda Mohan Bhattarai and Justice Kumar Regmi paved the way for the bill's implementation as it decided not to give continuity to the interlocutory interim order earlier issued by a single bench. The short-term order issued by Justice Manoj Sharma earlier blocked the way for the implementation of the amended provisions of the Citizenship Act, allowing thousands of children of parents, who got citizenship by birth, to acquire citizenship by descent. An estimated 500,000 such people are waiting for their citizenship certificates. However, the court is yet to issue its final verdict in this matter. The AAP government will move the Supreme Court against the appointment of former Allahabad High Court judge Umesh Kumar as the Delhi Electricity Regulatory Commission (DERC) chairman, Power Minister Atishi said on Thursday. Addressing a press conference, she said the government had recommended the name of Justice (retd) Sangeet Lodha for the post on June 21. However, it was "sidelined and former Allahabad High Court judge Umesh Kumar was appointed as the chairman by the BJP-led Centre. This has been done to 'trouble' the elected government of Delhi. In the coming days, we will approach the Supreme Court against this 'illegal' appointment," she said. In a relief to arrested Tamil Nadu Minister V Senthil Balaji, the Supreme Court Wednesday refused to stay a Madras High Court order allowing to shift him to a private hospital for treatment notwithstanding fervent request by the Enforcement Directorate. The Enforcement Directorate, which arrested Balaji in connection with an alleged cash-for-jobs scam in the state's transport department, had moved the apex court against the Madras High Court order. Balaji, 47, underwent a coronary bypass surgery at a private hospital in Chennai on Wednesday and was said to be doing fine. The Supreme Court agreed to hear on Tuesday a plea challenging an order of the Calcutta High Court directing the State Election Commission (SEC) to requisition and deploy central forces across West Bengal for the panchayat elections. The matter was mentioned on Monday before a vacation bench of Justices Surya Kant and M M Sundresh by senior advocate Meenakshi Arora who sought an urgent hearing. Arora, who was appearing for the SEC, told the appeal against the order was filed on Friday last but was not taken up. The high court on June 15 had directed the SEC to requisition and deploy central forces across West Bengal for the panchayat elections within 48 hours. The court had noted that no appreciable steps have been taken ever since an order was passed by it on June 13 to deploy central forces in sensitive areas for the poll process. The Supreme Court on Friday imposed an interim stay on a Delhi High Court order granting bail to Preeti Chandra, the wife of Unitech promoter Sanjay Chandra, in a money laundering case. A vacation bench of Justices Hima Kohli and Rajesh Bindal issued notice to Preeti Chandra on Enforcement Directorate's plea challenging the Delhi HC order. Theft during a train journey is not a deficiency in service by the Railways and the public transporter cannot be held responsible if the passenger is not able to protect his own belongings, the Supreme Court has ruled. A bench of Justices Vikram Nath and Ahsanuddin Amanullah made the observation while setting aside an order of the National Consumer Disputes Redressal Commission (NCDRC) which had directed the Railways to pay Rs 1 lakh to a businessman. The businessman had raised a claim before the District Consumer Forum stating he lost Rs 1 lakh cash he was carrying in a belt tied around his waist while travelling by a train, and sought reimbursement from the transport behemoth for his loss. "We fail to understand as to how the theft could be said to be in any way a deficiency in service by the Railways. Supreme Court judge Justice KM Joseph on Thursday pronounced two verdicts, a day ahead of his superannuation. Justice Joseph, who is set to retire on Friday, was accorded a warm farewell by the Supreme Court and lawyers bodies on May 19, the last working day before the top court closed for the summer vacation. On Thursday, Justice Joseph, along with Justice BV Nagarathna, pronounced two verdicts including one involving Coal India Limited in which the bench ruled that the Competition Act, 2002 also applies to the public sector company. Justice Nagarathna, after the pronouncement of the verdict said, "It was an honour to share the bench with Justice Joseph. I wish him a happy and active retired life."
