Senior advocate Vivek Tankha, who appeared for the petitioner, on Friday accused former Haryana chief minister and Indian National Lok Dal (INLD) chief Om Prakash Chautala of misusing the Delhi High Court's grace granted on medical grounds.
Chautala, who has been convicted in the Junior Basic Trained (JBT) teachers recruitment scam case, was in September asked by the Delhi High Court to surrender on or before October 17 and was granted bail on medical grounds.
Criticising Chautala for using the bail given to him on medical grounds for election campaigning, Tankha said that the bail was a good gesture from the court but it shouldn't have been misused
"We moved an application on behalf of Hemant Sharma on October 1 when we noticed that he had a wholesome tour program of political campaigning and we said if he has been granted bail on urgent medical considerations, where is the question of a man campaigning for the whole day, that means he is a fit person and if he is so fit, why should he be granted this grace. So, that's why the court had issued notice," said Tankha.
"Since he was in custody in Tihar Jail, he has to report back there and they will take him back into the custody. If he is unwell the jail authorities would take that into consideration and if necessary he would be sent to AIIMS as directed by the court. I think this is an eminently fair and just order," he added.
The Delhi High Court had yesterday directed the Indian National Lok Dal (INLD) chief to appear before it.
The CBI had earlier moved the Delhi High Court seeking cancellation of interim bail granted to Chautala in the case, saying he violated bail conditions.
Chautala was sentenced to 10-year imprisonment by a Delhi court on January 22, 2013 for illegally recruiting 3,206 JBT teachers in the state in 2000.
