HC dismisses plea seeking quashing of charge sheet against man accused of transporting beef

The Allahabad High Court today dismissed a petition seeking quashing of a charge sheet and a criminal case against a man accused of transporting 250 kg of beef for sale to Rampur.

Justice JJ Munir passed the order after hearing the petition filed by one Riyasat Khan against whom the police, after completing investigation, had filed a charge sheet in the case.

On April 19, 2016 an FIR was registered against Kashim and two unknown people for transporting 250 kg of beef for sale from Bareilly to Rampur in a bus.

After completing investigation, the police filed charge sheet against Kashim as well as Khan who was the driver of the bus in which the beef was being transported.

 

The plea of the petitioner's counsel was that the applicant was not named in the FIR and he was only driving the vehicle.

Justice JJ Munir after hearing concerned parties said, From perusal of the case diary and from petition, it is apparent that 250 kg of beef was recovered which prima facie makes out a clear case for trial.

No case for interference with the impugned charge sheet is made out. Looking at the aforesaid facts and circumstances this application fails and is dismissed in limine, he said.
