No bar on re-arrest after procedural lapses of first arrest cured: Delhi HC

The Delhi High Court has said procedural lapses by the police in the first arrest does not hinder a subsequent arrest once legal requirements are fulfilled. Justice Swarana Kanta Sharma on July 15 held an accused's rearrest if carried out after curing such defects was permissible. The court, therefore, dismissed a petition filed by four alleged members of an organised crime syndicate. "In criminal law, procedural safeguards are essential to protect liberty, but they cannot be turned into a shield to defeat lawful investigation into heinous crimes. A lapse by the police in the first arrest does not create a bar against subsequent arrest once the legal requirements are fulfilled," the court said. Anwar Khan, Hasim Baba, Sameer, and Zoya Khan sought a declaration that their rearrest on June 10 for the murder of one Sunil Jain was "unlawful and unconstitutional". The petitioners, represented by advocates Anurag Jain, M M Khan, Amit Chadha and Atin Chadha, argued their first arrest was

S Korean court approves new arrest of former Prez Yoon over martial law

A South Korean court early Thursday approved the new arrest of former President Yoon Suk Yeol on charges related to his brief imposition of martial law in December, accepting a special prosecutor's claim that he poses a risk of destroying evidence. The arrest warrant issued by the Seoul Central District Court sent Yoon back to a detention centre near the capital, four months after his release in March, when the same court overturned his January arrest and allowed him to stand trial for rebellion without being held in custody. His criminal case is being handled by a team of investigators under special prosecutor Cho Eun-suk who are pursuing additional charges over Yoon's authoritarian push, including obstructing official duties, abuse of power and falsifying official documents. Cho's team questioned him twice before submitting a request for his arrest warrant to the court on Sunday. Yoon's lawyers had described the arrest request as excessive and unsubstantiated. They didn't ...

Teen indicted for murder in fatal stabbing at Texas school track meet

A teen accused of fatally stabbing another student at a high school track meet in suburban Dallas was indicted Tuesday on a murder charge, a prosecutor said. A grand jury indicted Karmelo Anthony in the death of 17-year-old Austin Metcalf, Collin County District Attorney Greg Willis said. Willis said the April 2 stabbing at the school stadium in Frisco struck a deep nerve here in Collin County and beyond. Anthony was 17 at the time of the stabbing and has since turned 18. With Trump as ally, El Salvador's President ramps up crackdown on dissent

Days before his arrest outside his daughter's house in the outskirts of San Salvador, constitutional lawyer Enrique Anaya called Salvadoran President Nayib Bukele a dictator and a despot on live TV. This week, lawyer Jaime Quintanilla stood outside a detention facility in El Salvador's capital with a box of food and clothes for his client, unsure if Anaya would ever be released. The Saturday arrest of Anaya, a fierce critic of Bukele, marks the latest move in what watchdogs describe as a wave of crackdown on dissent by the Central American leader. They say Bukele is emboldened by his alliance with US President Donald Trump, who has not only praised him but avoided criticising actions human rights defenders, international authorities and legal experts deem authoritarian. Authorities in El Salvador have targeted outspoken lawyers like Anaya, journalists investigating Bukele's alleged deals with gangs and human rights defenders calling for the end of a three-year state of emergency, .

Over 20 detained on first night of LA curfew amid protest crackdown

Police detained more than 20 people, mostly on curfew violations, on the first night of restrictions in downtown Los Angeles and used crowd-control projectiles to break up hundreds of protesters demonstrating against President Donald Trump's immigration crackdown, officials said Wednesday. But there were fewer clashes between police and demonstrators than on previous nights, and by daybreak, the downtown streets were bustling with residents walking dogs and commuters clutching coffee cups. Officials said the curfew was necessary to stop vandalism and theft by agitators after five days of protests, which have mostly been concentrated downtown. Demonstrations have also spread to other cities nationwide, including Dallas and Austin in Texas, and Chicago and New York, where thousands rallied and more arrests were made. The LA curfew, which is expected to last several days, covers a 1-square-mile (2.5-square-kilometre) section that includes an area where protests have occurred since Frid
