Court sends Delhi CM Kejriwal to 3-day CBI custody in excise policy case

A court here on Wednesday sent Chief Minister Arvind Kejriwal to CBI custody for three days after the probe agency arrested him in a corruption case linked to the alleged Delhi excise policy scam. Special Judge Amitabh Rawat passed the order on an application moved by the CBI. The probe agency formally arrested Kejriwal on Wednesday after getting permission from the court. The Aam Aadmi Party national convener is lodged in prison in an excise policy-linked money laundering case being probed by the Enforcement Department (ED). "CBI application is allowed for three days," the judge said. In the application seeking Kejriwal's custody, the CBI told the court that he was required to be quizzed to unearth the larger conspiracy in the matter. It also said that the Delhi chief minister was required to be confronted with evidence and other people accused in the case. Federal agencies had earlier claimed that a so-called "south lobby" dictated the formulation of the now-scrapped excise poli

Appeal to INDIA bloc to raise issue of Kejriwal's arrest in Parliament: AAP

AAP leader Sanjay Singh on Wednesday said he will talk to INDIA bloc leaders over Delhi Chief Minister Arvind Kejriwal's arrest and request them to raise the issue in Parliament as he accused the BJP-led Centre of misusing probe agencies to target opposition parties. Addressing a press conference here, Singh alleged that the Central Bureau of Investigation (CBI) is acting against the Aam Aadmi Party (AAP) with ill-will and political malice. The AAP leader said he will talk to leaders of the Indian National Developmental Inclusive Alliance (INDIA) over Kejriwal's arrest by the CBI in a corruption case linked to the alleged Delhi excise scam and request them to raise the issue in Parliament. Judge in hurry, didn't give time to oppose Kejriwal's bail: ED to SC

The ED on Wednesday told the Supreme Court that the trial court judge was in a "hurry" and did not afford a reasonable opportunity to the prosecutor to oppose Delhi Chief Minister Arvind Kejriwal's bail in a money laundering case linked to the alleged excise scam. The federal probe agency said the June 20 order of the trial court granting regular bail to Kejriwal was "perverse" for non-compliance of prerequisite mandatory conditions under section 45 of the Prevention of Money Laundering Act (PMLA). A vacation bench of Justice Manoj Misra and Justice SVN Bhatti took on record the Enforcement Directorate's reply affidavit filed in Kejriwal's plea challenging the interim stay granted by the Delhi High Court on June 21. The bench also allowed Kejriwal to withdraw his plea after senior advocate Abhishek Singhvi, appearing for him, said he would file a substantial appeal as the high court has pronounced the final order on June 25, staying the bail order. The top court granted liberty to

Whole system trying to ensure Delhi CM doesn't get bail: Sunita Kejriwal

Delhi Chief Minister Arvind Kejriwal's wife Sunita on Wednesday alleged the whole system was trying to ensure that her husband does not come out of jail and stressed that all this is akin to "dictatorship" and "emergency". The Aam Aadmi Party (AAP) said that when there was a possibility of Kejriwal getting bail from the Supreme Court in a money laundering case, the BJP panicked and got him arrested in a "fake case" by the CBI. The Central Bureau of Investigation (CBI) on Wednesday formally arrested Kejriwal in the alleged excise policy scam and sought five-day custody of the AAP national convener in the corruption case. In a post on X in Hindi, Sunita said her husband got bail on June 20 in the excise policy-linked money laundering case and the Enforcement Directorate (ED) immediately got a stay. "The very next day, the CBI made him an accused. And today he was arrested. The whole system is trying to ensure that the man does not come out of jail. This is not law. This is dictatorsh

Delhi Chief Minister Arvind Kejriwal withdrew from the Supreme Court on Wednesday his plea challenging the Delhi High Court order granting an interim stay on the operation of the trial court's bail order in a money laundering case linked to the alleged excise scam. A vacation bench of Justices Manoj Misra and SVN Bhatti, which allowed Kejriwal to withdraw his plea, was told by the AAP leader's counsel senior advocate Abhishek Singhvi that since the high court has passed a detailed order on June 25, he would like to file a substantial appeal. Singhvi informed the bench that new developments were taking place every day and Kejriwal has now been arrested by the CBI. "We would like to file a substantial appeal to bring on record all relevant details and challenge the June 25 order of the high court in which bail order was finally stayed," he said. Money laundering case: AAP to move SC against stay on Kejriwal's bail order

The Aam Aadmi Party (AAP) on Tuesday said it disagrees with the Delhi High Court order staying the bail granted to Chief Minister Arvind Kejriwal by the trial court and will challenge it in the Supreme Court. The Delhi High Court earlier in the day stayed the trial court order granting bail to Kejriwal in the money laundering case stemming from the alleged excise policy scam in Delhi. A vacation bench of Justice Sudhir Kumar Jain said the trial court failed to appreciate the material placed before it by the Enforcement Directorate and did not apply its mind while deciding the AAP leader's bail plea. The judge also said the trial court ought to have given adequate opportunity to the agency to argue its case. Reacting to the development, the AAP said they will approach the apex court. "We disagree with the Delhi High Court order. We will challenge it in the Supreme Court," the party said. The trial court had granted bail to Kejriwal on June 20 and ordered his release on a personal

SC fixes Jun 26 for hearing Delhi CM's plea against HC's stay order on bail

The Supreme Court on Monday fixed June 26 for hearing Chief Minister Arvind Kejriwal's plea against the Delhi High Court order putting interim stay on his bail in the money laundering case linked to the alleged excise scam. A vacation bench of Justices Manoj Misra and SVN Bhatti said it would like to wait for the pronouncement of the high court order on the issue. Senior Advocate Abhishek Singhvi, appearing for Kejriwal, sought vacating of the interim stay on the bail order. ASG SV Raju, appearing for the ED, opposed the plea of Kejriwal, and said the high court is about to pronounce the verdict on its stay application. The Aam Aadmi Party (AAP) national convener, who was arrested by the Enforcement Directorate (ED) on March 21, could have walked out of Tihar jail on Friday last had the high court not granted the interim stay relief to the federal anti-money laundering agency.

Unusual for HC to reserve verdict: SC during Kejriwal's bail hearing

The Supreme Court on Monday termed as "unusual" the Delhi High Court's decision of reserving the order while granting interim stay on the operation of the trial court's order granting bail to Delhi Chief Minister Arvind Kejriwal in a money laundering case linked to the alleged excise scam. A vacation bench of Justices Manoj Misra and SVN Bhatti, which fixed June 26 for hearing Kejriwal's plea against the interim stay granted by the high court at the time of reserving its verdict on ED's plea said, "Normally, on stay applications, orders are not reserved. They are passed at the hearing itself, on the spot. So, it is a bit unusual." The bench said it would like to wait for the pronouncement of the high court order before taking a call on the AAP national convenor's appeal. During the brief hearing, senior advocate Abhishek Singhvi, appearing for Kejriwal, sought vacation of the interim stay on the bail order, contending it was contrary to the well-established norm that a bail granted

Bail order perverse, Kejriwal neck deep in money laundering: ED tells HC

The Enforcement Directorate on Monday told the Delhi High Court that the trial court order granting bail to Chief Minister Arvind Kejriwal was based on "perverse" findings as it did not consider the material demonstrating his "neck deep involvement" in the offence of money laundering linked to the alleged excise scam. In a written note filed in relation to its plea seeking a stay on the trial court's decision, the agency contended the order suffers from a "jurisdictional defect" since it was not given a proper opportunity to argue its case. It also said the trial judge did not record her satisfaction that there are reasonable grounds for believing that he is not guilty of such offence as per section 45 of the Prevention of Money Laundering Act (PMLA). On June 20, Special Judge Niyay Bindu, who sat as the vacation judge, granted bail to Kejriwal in the money laundering case, saying the Enforcement Directorate (ED) failed to furnish direct evidence linking him to the proceeds of crime

Excise policy scam: Kejriwal moves SC against HC's stay on bail order

Delhi Chief Minister Arvind Kejriwal has moved the Supreme Court against the Delhi High Court's interim stay on a trial court's order granting him bail in a money-laundering case linked to the alleged excise scam. The high court on Friday paused the release of the embattled chief minister after the trial court granted him bail on June 20. The Aam Aadmi Party (AAP) national convenor, who was arrested by the Enforcement Directorate (ED) on March 21, could have walked out of Tihar Jail on Friday had the high court not granted the interim relief to the federal anti-money laundering agency. "Till the pronouncement of this order, the operation of the impugned order shall remain stayed," a vacation bench of the high court said and asked the parties to file written submissions by June 24. The high court said it was reserving the order for two-three days as it wanted to go through the entire case records. Bail to Kejriwal exposed BJP conspiracy, so ED challenged it: Sanjay Singh

AAP leader Sanjay Singh on Friday accused Prime Minister Narendra Modi of making a mockery of the justice system after the Delhi High Court put on hold a trial court order granting bail to Chief Minister Arvind Kejriwal in the money laundering case linked to the alleged excise scam. Singh said the trial court's bail to the Delhi chief minister "exposed" the conspiracy of the BJP and the party should apologise to the Aam Aadmi Party and Kejriwal. ED acting as if Kejriwal 'most wanted terrorist in India': Sunita Kejriwal

Delhi Chief Minister Arvind Kejriwal's wife Sunita Kejriwal lashed out at the ED for challenging her husband's bail order in the high court, accusing it of acting as if the AAP national convener was the "most wanted terrorist in India". Speaking in south Delhi's Bhogal where Delhi Water Minister Atishi began an indefinite hunger strike to press on her demand for getting more water from Haryana, Sunita Kejriwal said dictatorship in the country has crossed all limits. "It was only yesterday your chief minister got bail. In the morning, the order was supposed to be uploaded. Even before the order was uploaded, the ED approached the Delhi High Court. This happened as if Kejriwal is the most wanted terrorist in India," Sunita Kejriwal said. "Dictatorship in the country has crossed all limits. The ED does not want to give anyone liberty and has gone to the high court against the chief minister demanding a stay (on his bail). The high court's decision is yet to come. We hope the high court

ED failed to give evidence linking CM Kejriwal to proceeds of crime: Court

The Enforcement Directorate (ED) failed to furnish direct evidence linking Delhi Chief Minister Arvind Kejriwal to the proceeds of crime in the money laundering case against him, a Delhi court has said while ordering his release on bail. The order passed on Thursday has, however, been stayed by the Delhi High Court on an appeal by the ED. The trial court order was made available to the media on Friday. In the order granting relief to Kejriwal, Special Judge Niyay Bindu held that prima facie his guilt was yet to be established. "It may be possible that some persons known to the applicant are having involvement in an offence....but ED has failed to give any direct evidence against the applicant in respect of the proceeds of crime," the judge said. She also questioned the ED's silence on Kejriwal's assertion that he was arrested in the money laundering case related to the alleged excise scam without having been named in the CBI FIR or the ECIR registered by the anti-money laundering .
