Money laundering case: AAP to move SC against stay on Kejriwal's bail order

The Aam Aadmi Party (AAP) on Tuesday said it disagrees with the Delhi High Court order staying the bail granted to Chief Minister Arvind Kejriwal by the trial court and will challenge it in the Supreme Court. The Delhi High Court earlier in the day stayed the trial court order granting bail to Kejriwal in the money laundering case stemming from the alleged excise policy scam in Delhi. A vacation bench of Justice Sudhir Kumar Jain said the trial court failed to appreciate the material placed before it by the Enforcement Directorate and did not apply its mind while deciding the AAP leader's bail plea. The judge also said the trial court ought to have given adequate opportunity to the agency to argue its case. Reacting to the development, the AAP said they will approach the apex court. SC fixes Jun 26 for hearing Delhi CM's plea against HC's stay order on bail

The Supreme Court on Monday fixed June 26 for hearing Chief Minister Arvind Kejriwal's plea against the Delhi High Court order putting interim stay on his bail in the money laundering case linked to the alleged excise scam. A vacation bench of Justices Manoj Misra and SVN Bhatti said it would like to wait for the pronouncement of the high court order on the issue. Senior Advocate Abhishek Singhvi, appearing for Kejriwal, sought vacating of the interim stay on the bail order. ASG SV Raju, appearing for the ED, opposed the plea of Kejriwal, and said the high court is about to pronounce the verdict on its stay application. The Aam Aadmi Party (AAP) national convener, who was arrested by the Enforcement Directorate (ED) on March 21, could have walked out of Tihar jail on Friday last had the high court not granted the interim stay relief to the federal anti-money laundering agency.

Unusual for HC to reserve verdict: SC during Kejriwal's bail hearing

The Supreme Court on Monday termed as "unusual" the Delhi High Court's decision of reserving the order while granting interim stay on the operation of the trial court's order granting bail to Delhi Chief Minister Arvind Kejriwal in a money laundering case linked to the alleged excise scam. A vacation bench of Justices Manoj Misra and SVN Bhatti, which fixed June 26 for hearing Kejriwal's plea against the interim stay granted by the high court at the time of reserving its verdict on ED's plea said, "Normally, on stay applications, orders are not reserved. They are passed at the hearing itself, on the spot. So, it is a bit unusual." The Enforcement Directorate on Monday told the Delhi High Court that the trial court order granting bail to Chief Minister Arvind Kejriwal was based on "perverse" findings as it did not consider the material demonstrating his "neck deep involvement" in the offence of money laundering linked to the alleged excise scam. In a written note filed in relation to its plea seeking a stay on the trial court's decision, the agency contended the order suffers from a "jurisdictional defect" since it was not given a proper opportunity to argue its case. It also said the trial judge did not record her satisfaction that there are reasonable grounds for believing that he is not guilty of such offence as per section 45 of the Prevention of Money Laundering Act (PMLA). Excise policy scam: Kejriwal moves SC against HC's stay on bail order

Delhi Chief Minister Arvind Kejriwal has moved the Supreme Court against the Delhi High Court's interim stay on a trial court's order granting him bail in a money-laundering case linked to the alleged excise scam. The high court on Friday paused the release of the embattled chief minister after the trial court granted him bail on June 20. The Aam Aadmi Party (AAP) national convenor, who was arrested by the Enforcement Directorate (ED) on March 21, could have walked out of Tihar Jail on Friday had the high court not granted the interim relief to the federal anti-money laundering agency. Swati Maliwal case: Court extends Bibhav Kumar's custody till July 6

A court here on Saturday extended till July 6 the judicial custody of Chief Minister Arvind Kejriwal's aide Bibhav Kumar. Kumar is accused of assaulting AAP Rajya Sabha MP Swati Maliwal on May 13 at the chief minister's official residence. Kumar was produced through video conferencing before Metropolitan Magistrate Gaurav Goyal who extended his judicial custody till July 6. Kumar was arrested on May 18. He was sent to police custody for five days the same day by a magisterial court, which observed that his anticipatory bail plea had become infructuous because of his arrest. On May 24, he was sent to four days judicial custody, following which he was again remanded in police custody for three days. An FIR was registered against Kumar on May 16 under various Indian Penal Code provisions, including those related to criminal intimidation, assault or criminal force on a woman with the intent to disrobe and attempt to commit culpable homicide.

The Delhi High Court on Friday granted interim stay on the trial court's order giving bail to Chief Minister Arvind Kejriwal in the money laundering case linked to the alleged excise scam. The high court also issued notice to Kejriwal seeking his response on ED's plea challenging the trial court's June 20 order by which he was granted bail. "Till the pronouncement of this order, the operation of the impugned order shall remain stayed," a vacation bench of Justice Sudhir Kumar Jain said. ED failed to give evidence linking CM Kejriwal to proceeds of crime: Court

The Enforcement Directorate (ED) failed to furnish direct evidence linking Delhi Chief Minister Arvind Kejriwal to the proceeds of crime in the money laundering case against him, a Delhi court has said while ordering his release on bail. The order passed on Thursday has, however, been stayed by the Delhi High Court on an appeal by the ED. The trial court order was made available to the media on Friday. In the order granting relief to Kejriwal, Special Judge Niyay Bindu held that prima facie his guilt was yet to be established. "It may be possible that some persons known to the applicant are having involvement in an offence....but ED has failed to give any direct evidence against the applicant in respect of the proceeds of crime," the judge said.
