The hearing of a defamation case filed against Congress leader Rahul Gandhi in the district over his alleged statement linking the RSS with Mahatma Gandhi's assassination was deferred to August 3, his lawyer said here. The hearing was scheduled for Saturday but the magistrate at the Bhiwandi court was on leave, said Gandhi's lawyer advocate Narayan Iyer. The criminal defamation case was filed by local Rashtriya Swayamsevak Sangh (RSS) member Rajesh Kunte over the Congress leader's alleged statement at an election rally near Bhiwandi on March 6, 2014, that the RSS people killed (Mahatma) Gandhi. He defamed the RSS by making this false claim, the complainant said. In a related development, the Bombay High Court two days ago reserved its order on a petition filed by Rahul Gandhi against the admission of certain evidence by the Bhiwandi court, his lawyer said.

Thaksin indicted on charge of royal defamation as more cases stir Thailand

Former Prime Minister Thaksin Shinawatra was formally indicted on Tuesday on a charge of defaming Thailand's monarchy in one of several court cases that have unsteadied Thai politics. Thaksin, an influential political figure despite being ousted from power 18 years ago, reported himself to prosecutors just before 9 a.m. and the indictment process has been completed, Prayuth Bejraguna, a spokesperson for the Office of the Attorney General, said at a news conference. A car believed to be carrying Thaksin arrived at the Criminal Court in Bangkok but he did not come out to meet reporters, and it is unclear whether he went to the court or the nearby prosecutors' office. His lawyer Winyat Chatmontree told reporters that Thaksin was ready to enter the judicial process and that he has prepared a request for his release on bail. Rahul Gandhi reviews Congress performance in Karnataka in Lok Sabha polls

Congress leader Rahul Gandhi on Friday reviewed the performance of the party in the recent Lok Sabha elections in Karnataka. The ruling Congress won nine seats, while the BJP and JD(S), which is a part of NDA, bagged 17 and two seats, respectively, in the State which has a total of 28 Lok Sabha segments. Gandhi addressed the newly elected MPs and losing candidates of the party here, Congress sources said. Chief Minister Siddaramaiah, his deputy D K Shivakumar, who is also the party's state unit chief, and Congress general secretary in-charge of Karnataka, Randeep Singh Surjewala were also present at the meeting. Earlier in the day, Gandhi appeared before a special court here in connection with a case filed by the BJP's Karnataka unit for issuing "defamatory" advertisements in mainstream newspapers. A court here on Saturday directed Congress leader Rahul Gandhi to appear before it in a defamation case filed by the BJP, and granted bail to Karnataka Chief Minister Siddaramaiah and his deputy D K Shivakumar in connection with the matter. Rahul Gandhi was asked to appear before the court on June 7 in connection with the case. The defamation case on alleged false advertisements was filed by BJP general secretary Keshav Prasad. While Siddaramaiah and Shivakumar appeared in person before the Special Court for People's Representatives in Bengaluru, Gandhi, who was supposed to appear, did not turn up. BJP advocates raised objections and said Gandhi should not be given an exemption under CrPC 205 since he had skipped an appearance for the second time. Thai prosecutors on Wednesday said former Prime Minister Thaksin Shinawatra will be indicted for defaming the monarchy, three months after he was freed on parole on other charges. Thaksin will not yet be indicted because he had filed a request to postpone his original appointment on Wednesday with proof that he has contracted COVID-19, said Prayuth Bejraguna, a spokesperson for the Office of the Attorney General, at a news conference. The attorney general's office scheduled a new appointment for Thaksin's indictment on June 18, Prayuth said, adding that Thaksin will also be indicted for violating the Computer Crime Act. Thaksin had been in self-imposed exile since 2008, but returned to Thailand in August last year to begin serving an eight-year sentence. He was released on parole in February from the hospital in Bangkok where he spent six months serving time for corruption-related offenses.

Court convicts Medha Patkar in defamation case filed by Delhi L-G Saxena

A Delhi court on Friday convicted Narmada Bachao Andolan (NBA) leader Medha Patkar in a defamation case lodged against her by V K Saxena, the incumbent lieutenant governor of the national capital. Metropolitan Magistrate Raghav Sharma found Patkar guilty of criminal defamation. Under the relevant law, the activist may get a jail term of two years or fine or both as the punishment. Patkar and Saxena have been locked in a legal battle since 2000 after she filed a suit against him for publishing advertisements against her and the Narmada Bachao Andolan (NBA). Saxena was then the chief of Ahmedabad-based NGO National Council for Civil Liberties. Saxena had also filed two cases against her for making derogatory remarks against him on a TV channel and issuing a defamatory press statement.

LS polls: Rajeev Chandrasekhar accuses Tharoor of defamation, sends notice

Union Minister of State for Information Technology and Electronics Rajeev Chandrasekhar has sent a legal notice to Congress MP Shashi Tharoor accusing him of making defamatory statements against the BJP leader on a TV channel recently. Chandrasekhar, who is facing off against Tharoor in the Thiruvananthapuram Lok Sabha constituency in the upcoming polls on April 26, has alleged that the Congress MP disseminated "patently false information" regarding bribing of key voters and influential figures such as parish priests, among others, by the BJP leader. A case has been registered against Tamil Nadu Fisheries Minister Anitha R Radhakrishnan for his alleged derogatory remarks on Prime Minister Narendra Modi, at a recent meeting of the DMK party workers, police said on Monday. A case under section 294 B of the IPC (uttering obscene words in public) has been registered against Radhakrishnan by the Meignanapuram police following a complaint by the BJP Thoothukudi south district president R Sidhrangathan, a senior police official said. Delhi HC refuses to quash summons against CM Kejriwal in defamation case

The Delhi High Court on Monday upheld summons issued to Chief Minister Arvind Kejriwal as an accused in a criminal defamation case for retweeting an allegedly defamatory video circulated by YouTuber Dhruv Rathee in May 2018. Retweeting a social media post carrying defamatory content will amount to defamation under Section 499 of the IPC, Justice Swarana Kanta Sharma said while refusing to quash the trial court's 2019 order summoning Kejriwal. The court also said that some sense of responsibility must be attached while retweeting content on social media about which a person does not have knowledge. The AAP leader had challenged two orders of the trial court on the refusal to quash the summons. The high court had earlier stayed trial court proceedings in the case. SC reserves order on Tejashwi's plea seeking transfer of defamation case

The Supreme Court on Monday reserved its order on a plea filed by RJD leader Tejashwi Yadav seeking transfer of the criminal defamation complaint pending against him in a Ahmedabad court over his alleged "only Gujaratis can be thugs" remark to a place outside the state, preferably Delhi. A bench of Justices A S Oka and Ujjal Bhuyan took on record a fresh statement of apology filed by Yadav. "We will pass orders," the bench said. The top court on January 29 had directed Yadav to file a "proper statement" withdrawing his alleged remark that "only Gujaratis can be thugs". Yadav on January 19 filed an affidavit in the apex court withdrawing his alleged "Gujarati thugs" remark. The top court, while hearing the RJD leader's plea, had earlier stayed the proceedings in the criminal defamation complaint and issued notice to the Gujarat resident who had filed it. The complaint against Yadav was filed under sections 499 and 500 of the Indian Penal Code (IPC) for alleged criminal defamation.
