The Delhi High Court on Tuesday said it would hear on January 4 a plea by Trinamool Congress leader Mahua Moitra challenging cancellation of her government accommodation, noting that the Supreme Court is scheduled to hear on January 3 her plea against expulsion from the Lok Sabha. Justice Subramonium Prasad, before whom the plea came up for hearing, adjourned it. As the counsel for Moitra urged the court to direct the Directorate of Estates to file a reply to the petition before January 4, the high court said it would consider it on the next date only. The petition has urged that the Directorate of Estates' December 11 order be set aside or, in the alternative, Moitra be allowed to retain possession of the accommodation till the results of the 2024 Lok Sabha elections are declared. Delhi HC refuses to quash charges in 2017 Haryana judicial paper leak case

The Delhi High Court has refused to quash charges framed against a former Punjab and Haryana High Court official in a case relating to the alleged leak of the 2017 Haryana Civil Services (judicial) preliminary examination paper. The HC said that in cases where digital or electronic evidence is available, the prosecution's case cannot be thrown at the initial stage. The record indicated that petitioner-accused Dr Balwinder Kumar Sharma, who was then the registrar (recruitment) of the Punjab and Haryana High Court, was in possession of the question paper immediately before the alleged leakage. The Delhi High Court has sought the stand of the city police on a petition seeking enquiry and action against its officers for alleged illegal arrest, physical assault and torture of a man apprehended in a case of attempted murder last month. Justice Vikas Mahajan issued notice on the petition by the wife of the alleged victim claiming "police transgressions" and directed that relevant CCTV footage, including those from the police station concerned, be preserved and placed on record. Delhi High Court on Tuesday sought the Centre's response on a plea by the AAP seeking allotment of land in the national capital for construction of its offices, having been recognised as a national party. Justice Subramonium Prasad issued a notice to the Union Ministry of Housing and Urban Affairs and the Land and Development Officer, asking them to file their replies to the petition. The court listed the matter for further hearing on March 23. A person who chooses to help a person in distress should not be harassed for showing kindness and if he or she suffers in the process, the law must come to the rescue, the Delhi High Court has said. The court's observation came while granting interim payment of over Rs 5 lakh as compensation to the widow of a truck driver who died in 2018 while helping a victim of a road accident. "While he was returning back to his vehicle, which by all probabilities was properly parked on the side way, that he got struck by another unknown speeding vehicle and sustained injuries... We have to assume that being a 'Good Samaritan', he stopped his truck and responded to somebody in distress," said Justice Dharmesh Sharma in a recent order. The Delhi High Court on Monday sought the Centre's response on a public interest litigation against the unregulated use of artificial intelligence and deepfakes. Deepfakes are videos or images that are created using Artificial Intelligence (AI)-powered deep learning software that show people saying and doing things that they didn't say or do. A bench headed by Acting Chief Justice Manmohan observed that technology cannot be "reined in" and the issue raised by the petitioner required deliberations which only the government could undertake. "There is no easy solution. It requires a lot of deliberation. It is a very complicated technology," the bench, also comprising Justice Mini Pushkarna, said. SC already dealt with it: Delhi HC refuses to entertain pleas seeking UCC

The Delhi High Court Friday refused to entertain a batch of petitions seeking a Uniform Civil Code (UCC), saying the Supreme Court has already dealt with the issue and has rejected the pleas. The high court said it cannot direct the legislature to enact a law and referred to an order of the apex court in which it was held that framing of law lies exclusively within the domain of legislature. "The Supreme Court order is clear and categorical. We will not go beyond the Supreme Court order. They (Law Commission) don't need us. They are an authority constituted by the Constitution to do it.
