National Conference president Farooq Abdullah Saturday said annulling Articles 370 and 35-A will tantamount to a constitutional coup. He asserted that Article 370 is essential and unassailable until a final resolution of the issue of Jammu and Kashmir is reached. "Keeping in view the special circumstances (at the time of accession of J&K to India), Article 370 was added to the Constitution of India. The Article will remain as it is until the final resolution of the issue of Jammu and Kashmir is not reached to," Abdullah said addressing a party convention in Handwara area of Kupwara district. "So until the issue is solved, no power on earth can touch the article 370. The uneducated rants of those who want to obliterate Article 370 are far-fetched, fanciful and devoid of any genuineness," the former chief minister added. Referring to Article 35-A, the NC chief said that the special provision was the fallout of Article 370 and fiddling with it will upset all the successive amendments
He said the party would not support any violence or violation of human rights
His statement comes hours after the Supreme Court adjourned the title suit in the Ayodhya case to January 10
He also accused the BJP of following a divisive agenda
He said they wanted to discuss the issues with leaders of other political parties including Congress President Rahul Gandhi
The remarks come from NC president Farooq Abdullah who said that NC was not running away from polls but wanted the Centre to do justice with the people of J&K and protect state's special position
Abdullah said the NC would skip the polls until and unless the state government and the Centre take steps for protection of Article 35-A of the Constitution
National Conference president Farooq Abdullah Sunday denounced Additional Solicitor General of India (ASG) for saying in the Supreme Court that "there is an aspect of gender discrimination" in Article 35A of the Constitution. The Lok Sabha member from Srinagar was reacting to the stand taken by the ASG Tushar Mehta in the apex court last Friday. During the hearing, the ASG agreed to the contention that Article 35A and certain aspects needed to be debated upon and said, "It can't be denied that there is an aspect of gender discrimination in it (Article 35A)". "Such a statement, if made before the SC on behalf of Jammu & Kashmir government indicates that instead of defending Article 35-A and asking for the challenge to be dismissed based upon earlier constitution bench judgment, the state government has virtually conceded before the SC that some parts of Article 35-A deserve to be struck down," Abdullah said in a statement. The CBI today filed a charge sheet against former Jammu and Kashmir chief minister Farooq Abdullah and three others in a special court in Srinagar in connection with alleged irregularities and misappropriation of funds in the Jammu and Kashmir Cricket Association. The agency has levelled charges of criminal conspiracy and criminal breach of trust under the Ranbir Penal Code against Abdullah, the then president of JKCA, Md Saleem Khan - the then general secretary, Ahsan Ahmad Mirza - the then treasuer and Bashir Ahmad Misgar, an executive in the J&K Bank. The BCCI gave 112 crore to the JKCA between 2002 and 2011 for the development of cricket facilities in the state. Of this, Rs 43.69 crore was siphoned off and misappropriated by the accused, the agency has alleged.
