Polygamy out of bounds for Muslim men lacking means, says Kerala HC

The Kerala High Court has observed that it cannot accept multiple marriages of a Muslim man when he has no capacity to maintain his wives, and one of them approaches the court claiming maintenance. The observation was made by Justice P V Kunhikrishnan when a 39-year-old Perinthalmanna native approached the court seeking a monthly maintenance of Rs 10,000 from her husband, who survives by begging. Earlier, the petitioner had approached a Family Court, which dismissed her plea, stating that her 46-year-old husband from Kumbadi, Palakkad, who was surviving on begging, cannot be directed to pay maintenance. The court, in a satirical manner, referred to a Malayalam phrase implying: "Don't put your hand into a begging bowl". The judge noted that the husband was also not a saint. "Even though he is blind and a beggar, as stated by the petitioner, who is his second wife, he has been threatening her that he will soon enter into a third marriage with another woman," the court observed. The Congress-led opposition staged a walkout from the Kerala assembly on Friday after Speaker A N Shamseer denied them permission to move an adjournment motion to discuss the alleged disappearance of over 4 kg of gold from Sabarimala. The Speaker denied permission to the motion, saying that according to the rules of procedure of the House, a matter or issue which is sub-judice -- pending before the court -- cannot be discussed in the assembly. Leader of the Opposition in the state assembly V D Satheesan said that there was precedence of sub-judice issues being discussed in the House, to which the Speaker said, "Precedence cannot supersede rules, and someone has to bell the cat. Kerala minister warns govt hospitals against charging poor for equipment

Kerala Health Minister Veena George on Tuesday warned against the practice of government hospitals collecting money from poor patients belonging to free treatment categories for surgical equipment, saying it is a violation of the policy of the LDF government. She told the state Assembly that the government would view such instances with "utmost seriousness". The minister's remarks came following a raging political row over shocking disclosures made by a senior government doctor about the shortage of surgical equipment and delays in procedures at the state-run Medical College Hospital here. In a Facebook post, Dr Haris Chirakkal, the Head of the Urology Department, had said the shortage of essential medical equipment led to the postponement of surgeries. Announcing the decision at a press conference here, Chief Minister Pinarayi Vijayan said land disputes had been a serious concern in hilly regions and resolving them was one of the prime objectives of the LDF government. He recalled that since the government assumed office in 2016, a series of interventions had been made to address the issue, paving the way for the landmark amendment. A cabinet meeting held here approved the amendments to the Act, Vijayan said. The chief minister explained that the original Land Assignment Act, 1960, allowed land titles to be granted for agriculture, housing, neighbourhood amenities, and shop sites. However, many beneficiaries later diverted land for other uses or transferred ownership, creating "legal complications." "The construction of ...
