The special NIA court that acquitted five accused in the 11-year old Mecca Masjid blast case rejected the confessional statement of Hindutva preacher Swami Aseemanand, holding that it was recorded when he was in police custody and that it was not "voluntary". The court also dismissed the prosecution's claim that Aseemanand had confessed to his guilt to two inmates of a prison here, saying the CBI, which initially probed the case had not provided any documentary evidence to prove this. A powerful blast, triggered by remote control, had ripped through the over four centuries-old mosque here during an assembly of devotees on May 18, 2007 when they had gathered for Friday prayers, killing nine people and wounding 58. Special Judge K Ravinder Reddy in his April 16 order said the confessional statement of Aseemanand was "hit by Section 26 of the Indian Evidence Act and the same is not a voluntary one which was recorded during the course of police custody." A three-judge bench headed by Chief Justice Dipak Misra said it would not deal with the facts of any case and would rather deal with the aspects of gender justice for married woman on one side and the right to life and personal liberty of husbands and in-laws on the other. "Two concepts are related to section 498A (subjecting married woman to cruelty by her spouse and in-laws) of the IPC. Eminent jurists like Soli Sorabjee and Fali Nariman and some ex-judges did not find fault with today's decision of Rajya Sabha Chairman M Venkaiah Naidu rejecting the impeachment notice against Chief Justice of India Dipak Misra but there was a political divide among lawyers associated with various parties on the outcome. Sorabjee and Nariman were of the view that Congress-led opposition had no chance to succeed as issues raised in the impeachment notice against the CJI were not of "sufficient gravity and rightly rejected" by Naidu. Identical views were expressed by former Supreme Court judge P B Sawant and retired Delhi High Court judge S N Dhingra, who said Naidu must have found that the move was politically motivated and without any proof. However, there was a political divide among lawyers associated with various parties over the Rajya Sabha Chairman's decision to reject the impeachment notice against the CJI, as they termed the move either as "most perfect" or "erroneous" and ...

A division bench, comprising Justices K K Sasidharan and R Subramanian, reserved orders on the plea by Nalini challenging the order of a single judge rejecting her prayer for premature release under a 1994 state government scheme under Article 161 (powers of Governor to grant pardon). Nalini in a February 22, 2014 representation to the state government had sought premature release under the 1994 scheme and had later moved the court. The state government had opposed the plea citing pendency of a similar matter in the Supreme Court then, following which the single judge had asked it to consider the representation subject to the outcome of the apex court proceedings. The Supreme Court in its March 2016 order had made it clear that for pre-mature release pleas under the CrPc Section 435,

A former Supreme Court judge and a retired high court judge found merit in Rajya Sabha chairman M Venkaiah Naidu's order today rejecting impeachment notice against Chief Justice of India Dipak Misra saying the move was politically motivated and charges levelled were not backed by proof. While Justice P B Sawant, who was a judge in the Supreme Court from 1989-1995, said the decision was "okay" as Naidu must have taken opinion of people concerned, former Delhi High Court judge Justice S N Dhingra termed it "absolutely right", saying there was no proof for charges levelled against the CJI. "I am sure he (Naidu) must have taken all opinions of various people. It looks like political move to me. Congress is definitely going to go to the Supreme Court if it is a political move.
