HC dismisses Zakir Naik's plea challenging lower court summon

The Allahabad High Court today dismissed a petition filed by controversial preacher Zakir Naik challenging a lower court order summoning him and the subsequent non-bailable warrant issued against him in a case of hurting religious sentiments. The lower court's order on April 30, 2010 came on a complaint in 2008 filed by a man alleging that in a television programme telecast on January 21, 2006, Naik had allegedly hurt the religious sentiments of a particular community. Earlier on June 6, 2011, hearing Naik's petition, the high court had directed that till the next date of listing, no coercive action should be taken against the applicant pursuant to the order dated April 30, 2010 passed by the judicial magistrate. On March 28, 2018, Justice Amar Singh Chauhan reserved the judgement in the petition filed by Naik.

SC order on CJI's power to allocate cases evokes mixed response

The Supreme Court's ruling that Chief Justice of India (CJI) has the "exclusive prerogative" to allocate cases and set up benches today evoked mixed response from the legal fraternity with some terming it as "correct" while other criticising the order. A bench headed by CJI Dipak Misra today dismissed a PIL seeking evolution of a "set procedure" to constitute benches and allot cases to different benches saying the CJI was the "first among equals" and an institution in himself. While senior advocate and former Attorney General Mukul Rohatgi said the apex court's order was correct since the CJI is the "master of the roster" and it was improper to make allegations against any of the CJIs, advocate Prashant Bhushan said that CJI Dipak Misra should not have heard the matter as his own power was being questioned. Retired judges take charge as MCA administrators

Retired judges H L Gokhale and V M Kanade today took charge as the administrators of the Mumbai Cricket Association (MCA) at its office in South Mumbai. The MCA, which is yet to implement the Lodha panel reforms, had recently faced the wrath of the Bombay High Court. On April 4, the high court accepted the names of former Supreme Court judge H L Gokhale and former High Court judge V M Kanade as administrators of the MCA to regulate the functioning of the state cricket body. Sources said that the new administrators had a meeting with the top MCA brass today.

Kidnapped girl rescued, accused held in JK's Rajouri

A minor girl allegedly kidnapped by a youth a week ago was today rescued and the accused arrested during an operation in Jammu and Kashmir's Rajouri district, police said. Police launched a massive hunt after the parents of the girl, hailing from Bhawani village, lodged a complaint that she was abducted by a youth from Langer last week, the police said. The girl was rescued from Nowshera area of the district and handed over to her parents, the police said, adding the accused was arrested.

CJI an institution in himself, has exclusive prerogative to set up benches: SC

Asserting the superior authority of the Chief Justice of India, the Supreme Court today held that the CJI is an "institution in himself" and occupies a "unique position" having the "exclusive prerogative" to allocate cases and set up benches. Rejecting a plea for guidelines on the setting up of benches and allocation of work to judges, the bench headed by Chief Justice Dipak Misra also said there cannot be a "presumption of mistrust" against the CJI. The verdict assumes signficance as it comes against the backdrop of an unprecedented press conference on January 12 by the four senior most judges of the apex court where they targeted Justice Misra over what they called improper allocation of cases. UN judges today found radical Serb Vojislav Seselj guilty on appeal of crimes against humanity, but the firebrand politician will remain a free man because of time already served behind bars. Seselj told AFP after the ruling that he was "proud" of the crimes he was convicted of -- including inciting persecution -- and was willing to do the same again. Hit and run case: Bailable warrant against Salman stayed

A Mumbai court today stayed a bailable warrant issued against Bollywood superstar Salman Khan in the 2002 hit-and-run case, in which the government's appeal against his acquittal is pending before the Supreme Court. "Salman had to appear before the court here to furnish surety as per the direction of the Supreme Court which has admitted the government's appeal," said special public prosecutor Pradeep Gharat. The court had last week issued a bailable warrant against him after the actor did not complete the procedure of providing surety (a guarantor for good behaviour) on the past two dates, Gharat said. SC gives bail to RTI activist who complained against 2 Orissa HC judges

The Supreme Court has granted bail to RTI activist Jayanta Kumar Das, who had in 2016 complained to then Chief Justice of India T S Thakur, accusing two sitting judges of the Orissa High Court of wrongdoings, leading to an in-house inquiry against them. Das was in custody since August 8 for allegedly posting defamatory remarks against Lord Jagannath and Gajapati King Dibyasingha Deb on Facebook. A bench of Justices M B Lokur and Deepak Gupta granted bail to Das on April 9 after no lawyer for the Odisha Police appeared before it despite being called twice. 3 Indians sentenced to 517-year jail term in fraud case in UAE

Two Indian men and a woman have been sentenced to 517 years each in jail by a Dubai court for swindling thousands of people in a multi-million-dollar fraud case, the UAE media reported. Sydney Lemos, from Mapusa in north Goa, was the chief executive of Exential, a forex trading company in Dubai Media City. Investors lost over USD 200 million when Exential failed to pay out after promising 120 per cent returns on a USD 25,000 (Dirham 91,800) investment. Forced marriage: SC asks Centre, police to grant protection to woman

The Supreme Court today came to the rescue to a 26-year-old Karnataka woman, who alleged that she has been married off without her consent, asked the Centre and the Delhi Police to grant her protection. The woman, who is currently in Delhi and is being helped by Delhi Commission for Women, has sought striking down of sections 5 and 7 of the Hindu Marriage Act (HMA) to the extent that they fail "to prescribe free, fair, valid prior consent of the parties to a marriage". Sealing: SC takes umbrage to lack of protection for monitoring panel

The Supreme Court today took umbrage to the lack of police protection to the court-appointed monitoring committee for carrying out sealing drive in Delhi and warned it would be compelled to call the Delhi Police Commissioner for explanation.
