Crime against women on rise, stalking should be dealt with sternly: Court

Expressing concern over rise in crime against women in the national capital, a Delhi court has said the judiciary should sternly deal with issue of stalking as the perpetrator, "if not treated", becomes dangerous over time and poses threat to the lives of women. The court said the Indian society has been struggling to find ways to deal with the crime of stalking, which was made an offence in 2013, but there have been several shortcoming in the existing law and a stalker cannot be allowed to roam around freely as his activities could be dangerous for others. Special Judge Kamini Lau lamented that the society often blames women saying they failed to wear "modest clothes". However, it has been observed that even those wearing dresses which "society claims are decent", are also not spared but teased to a greater extent. "Eve teasing has not to be judged by men by their own parameters but by women as to how they feel about the same. To a pervert mind, it does not matter how a woman is ...

The Supreme Court has directed a Dehradun-based novelist to give a reasonable offer to film director Rakesh Roshan for settling a case related to alleged copyright violation in the 2013 Bollywood blockbuster 'Krrish 3'. Novelist Rupnarayan Sonkar had filed a police complaint in 2016 accusing Roshan of copyright violation and claimed that some scenes of the movie were based on his novel 'Suardaan'. In 2016, over 1 lakh children faced sexual assault: SC informed

Sexual assault cases involving child victims rose to over one lakh in 2016 across the country and only 229 of them were adjudicated upon by trial courts in that year, the Supreme Court has been informed. The figure were brought recently to the notice of a bench, headed by Chief Justice Dipak Misra, which asked the Registrar Generals of high courts across the country to collect and collate data on pending cases of sexual offences against children as victims lodged under stringent Protection of Children from Sexual Offences (POCSO) Act. The Act provides that such cases have to be decided within a year after the trial court takes cognisance of the charge sheet. Lawyer Alakh Alok Srivastava, who has filed a PIL in a rape case of an eight-month-old girl by her adult cousin, referred to the 2016 data of National Crime Records Bureau (NCRB) and said 229 cases, out of the total of 1,01,326 POCSO cases, were decided by trial courts that year. Man gets 14-year jail for raping minor girl

A 24-year-old man has been sent behind bars for 14 years for kidnapping and raping an 11-year-old girl, with a Delhi court observing he "ravished" a "helpless and naive" girl only to satisfy his lust. The court, while awarding the sentence, also empathised with the victim and her family over delay in lodging FIR, saying "fear of society and social stigmatisation" often puts people in a dilemma as to what should be done. "Convict was an adult at the time of commission of offence having a thinking mind. And, therefore, ravishing a helpless and naive 11 year-old victim only to satisfy his lust speaks volumes of his perversity. "I am, therefore, of the view that keeping in mind the young age of the convict and the fact that he is not a previous offender, maximum punishment may not be awarded. But seeing the gravity of the offence and the tender age of the victim, he cannot be let go by awarding only the minimum punishment," Additional Sessions Judge Seema Maini said. The court also ...

Don't segregate names sent by SC collegium for appointment: experts tell govt

Legal experts have cautioned the government against accepting one of the recommendations of the Supreme Court collegium for elevation to the apex court while keeping the other one on hold, pointing that a chief justice of India had told the law ministry not to "segregate" names sent for appointment together. Highly-placed sources in the government said the law ministry wanted to appoint senior advocate Indu Malhotra to the Supreme Court, but wanted to keep on hold the name of Uttarakhand High Court Chief Justice K M Joseph. The two names were recommended together by the SC collegium in January for elevation to the apex court. The government feels that while recommending the name of Justice Joseph, the collegium has disregarded seniority and regional representation. A previous recommendation of the SC collegium made in 2016 proposing transfer of Justice Joseph from Uttarakhand to Andhra Pradesh remains on hold with the government.
