Raj HC seeks state's stand on a plea challenging Asaram's conviction

The Rajasthan High Court Tuesday sought the state government's stand on a plea challenging the conviction and jail term for life of self-styled godman Asaram for raping a teenaged girl in his ashram near here in 2013. A Jodhpur bench of the high court issued notice to the state government seeking its reply to Asaram's appeal. A bench of justices Nirmaljit Kaur and V K Mathur also summoned the records of the Asaram's case from the trial court for further proceedings on it. The controversial preacher had moved the high court in July this year, challenging his conviction and the life-long jail term. We had moved the high court praying for setting aside the conviction order. Since it has been admitted by the court, we would now file a bail application soon, said Asaram's counsel Mahesh Bora. Judges not answerable to people like elected representatives, Tiwari tells SC

Delhi BJP chief and MP Manoj Tiwari, who is facing contempt proceedings, said in the Supreme Court on Tuesday that judges were not answerable to people like the elected representatives. "Your lordships are sitting in a cosy area where nobody comes and questions you. But I have to answer the people on the ground," senior counsel Vikas Singh, appearing for Tiwari, told a bench of Justices Madan B Lokur, S Abdul Nazeer and Deepak Gupta. Tiwari, a Member of Parliament from the north-east Delhi constituency, is facing contempt proceedings for allegedly breaking the civic agency seal of an illegal premises here. HC asks UP govt to re-frame criteria for kin of deceased fair price shop dealers

The Allahabad High Court has directed the Uttar Pradesh Government to reframe within four months the criteria for appointment of kin of deceased fair price shop dealers to the job on compassionate grounds . The court also said that after the finalization of criteria, those entitled to it shall be appointed as fair price dealers. While issuing direction to Principal Secretary (Food and Civil Supplies) to reframe the criteria, it stayed the appointment of fair price shop dealers in village panchayatswhere applications for appointment on compassionate grounds are pending or where the kin of deceased fair price shop dealers are entitled to such dealerships. Regular appointment of fair price shop dealer in such cases shall be keptin abeyance, till the criteria for appointment of fair price shop dealers on compassionate grounds is finalized, Justice Ajay Bhanot said. CBI officer moves SC challenging transfer to Andamans(Lead)

Man orders phone, gets soap; Amazon India head, three others booked

Amazon's India head and three other persons have been booked after a customer claimed to have received a soap instead of a mobile phone that he had ordered from the e-commerce giant, police said Tuesday. The case was registered at the Bisrakh police station in Greater Noida Monday, they said. The company, however, said it takes all incidents of frauds seriously and was extending cooperation to police. "A matter has been reported from Bisrakh police station area. The complainant said he had ordered a mobile phone through Amazon website. When he got the delivery on October 27 and opened the parcel, he found a soap instead of the phone in it," Circle Officer at Bisrakh Nishank Sharma said. Based on a complaint from the man, an FIR has been registered against Amazon's country head Amit Agrawal, logistics firm Darshita Pvt Ltd directors Pradeep Kumar and Ravish Agrawal and delivery boy Anil, police said. CM seeks report from all SPs about rape incidents

Jharkhand Chief Minister Raghubar Das Tuesday sought reports from the Superintendent of Police of all the 24 districts in the state on rape incidents in their district. During his weekly 'Sidhi Baat' (Jan Samvad) with the people at the Suchana Bhavan here, Das directed the SPs of all the districts to submit report within a week on rape incidents and police action taken, an official release said here. The chief minister said he will review the action taken by the police to arrest the accused persons, charge sheet filed against accused persons and their convictions, the release said. He also expressed concern over a complaint in connection with no action being taken against the culprits who perpetrated a crime on a girl in Giridih district, it said. Ordinance on Ayodhya: Experts say propriety demands govt should wait for SC verdict

The demand by some saffron groups that the government should come out with an ordinance for constructing a Ram Temple at Ayodhya has not got support from legal experts who were of the view that propriety demands it should wait for the Supreme Court's verdict. According to senior jurists Rakesh Dwivedi and Ajit Kumar Sinha, there is no bar on the Centre to take the ordinance route but it should wait for the apex court's decision. But senior advocate Vikas Singh straightaway said no ordinance can be brought when the matter is pending before the top court and added that it was not about any provision but its propriety. "It's doctrine of separation of powers. Once it is before judiciary, it can't be done by any government," Singh, who is also the president of the Supreme Court Bar Association, said. SC protection to complainant in bribery case against Spl CBI Director; trial court sends DSP to JC

The Supreme Court on Tuesday directed the Hyderabad Police to provide adequate security to businessman Sathish Babu Sana, who has claimed threat to his life for filing a complaint in the alleged bribery case against CBI special director Rakesh Asthana. The apex court however did not accept his plea to stay the CBI's summon against him. CBI court sentences official to 3 years RI in graft case

A CBI court Tuesday sentenced a senior official of Directorate of Light Houses and Lightships to three years' rigorous imprisonment in a graft case. A CBI release said its Anti-Corruption Branch had registered a case in 2014 against K Shakthi, Deputy Director, Directorate of Light Houses and Lightships, Chennai, under the Prevention of Corruption Act, 1988, alleging he demanded Rs 25,000 as bribe from contractor K Mani for issuing certain additional contract work. Mani had filed a complaint. A trap was laid and Shakthi was caught red-handed while accepting a bribe of Rs 25,000 from the complainant, the release said. Special Judge for CBI cases, A Thiruneela Prasad, sentenced Shakthi to undergo three years' RI and also imposed a fine of Rs 50,000, it said.

86-year old, on bail in murder case, jailed as SC upholds

An 86-year-old man, sentenced to life for a Hindu Munnani activist's murder 27 years ago and granted bail later, was arrested here and sent to jail Tuesday after the Supreme Court recently upheld his conviction, police said. Bilal Hajiyar was produced before 5th Additional District Judge T Malarvalantina who ordered him to be lodged in the central jail for serving the sentence. Hajiyar, who was 59 then, and 10 others had been arrested on the charge of killing the Munnani activist, Shiva, on September 5, 1991. The trial court had in 2000 sentenced eight of them, including Hajiyar, to life imprisonment and acquitted two others. The eight filed appeals in the Madras High Court, which in 2008 rejected them and upheld the sessions court order. Challenging this, they moved the Supreme Court. Maoist leader arrested in Jharkhand

A Maoist leader, who was a part of a firing squad in the state, has been arrested in Jharkhand's Giridih district, a senior police officer said here Tuesday. Three US-made pistols and nine bullets were recovered from his possession, SP Surendra Jha said. "Charkha Hembram, a member of a Maoist firing squad, has been active in the state for over 15 years. He was arrested Monday night at Balothan in Pirtand police station area," he told reporters here. Acting on a tip-off about Hembram's presence at Balothan, a police team, headed by Assistant Superintendent of Police Deepak Kumar, raided the village Monday night and arrested him, the SP said. Hembram was wanted in eight cases, including the killing of four security personnel, firing on Pirtand police station and an encounter with the police on the Grand Trunk road, he added.

Malegaon blast: Purohit, Sadhvi, 5 others charged under UAPA

A special court here Tuesday framed charges in the 2008 Malegaon blast case against Lt Col Prasad Purohit, Sadhvi Pragya Singh Thakur and five others for terror activities, criminal conspiracy and murder, among others. Judge Vinod Padalkar, presiding over the special National Investigation Agency (NIA) court, framed charges against all the seven accused under sections of the stringent Unlawful Activities Prevention Act (UAPA) and the Indian Penal Code (IPC). After framing of the charges, the court posted the case on November 2 for the trial to commence. Framing of charges is a process after which the trial in a criminal case starts. The accused were charged under sections 16 (committing terrorist act) and 18 (conspiring to commit terrorist act) of the UAPA. 3 Iran nationals held for stealing USD 2,100 from money changer in Aur

Three Iran nationals have been arrested for allegedly stealing USD 2,100 from a money changer in Aur here, police said Tuesday. DSP Mukhtiar Rai said the trio had stolen the amount from the Western Union branch of one Pankaj Kumar near Aur Bus Stop on October 9. He said a case had been registered under sections 380, 34 of the IPC. The force investigated the case using CCTV footage monitoring the shop premises.
