J-K HC to hear case challenging LG's power to nominate MLAs on March 20

The Jammu and Kashmir and Ladakh High Court has scheduled the final hearing on March 20 for a PIL challenging the authority of the J&K Lieutenant Governor to nominate five members to the Legislative Assembly of the Union Territory. A division bench comprising Justice Sanjeev Kumar and Justice Rajesh Sekhri directed both parties to complete the pleadings, including replies and counter-replies, by March 20 when the final hearing takes place. During the proceedings, Solicitor General Tushar Mehta appeared for the respondents, while Senior Supreme Court lawyer Dr Abhishek Manu Singh, along with D K Khajuria, represented the petitioner Ravinder Sharma. The court said that the bench will be available for the entire day on March 20. Chief Justice Tashi Rabstan had last October constituted a special division bench to hear the public interest litigation concerning the nomination of the five MLAs. Delhi Assembly polls: 7 AAP MLAs quit party after being denied tickets

With less than a week before the assembly polls in Delhi, at least seven outgoing AAP MLAs have resigned from the party. Sources said these MLAs were disgruntled after being denied tickets for the February 5 polls and were touch with other parties. Most of the MLAs shared their resignation letters on social media and slammed AAP over corruption and other issues. Madan Lal, the outgoing MLA from Kasturba Nagar, claimed on Friday that he and six other party legislators had resigned from AAP's primary membership. Lal said they had also sent their resignation letters to Delhi Assembly Speaker Ram Niwas Goel. The AAP MLAs who have resigned also include Bhavna Gaud (Palam), Naresh Yadav (Mehrauli), Rohit Mehraulia (Trilokpuri) and Pawan Sharma (Adarsh Nagar). Elections to the 70-member Delhi Assembly will be held on February 5 and the votes counted on February 8.

BJP issues 'chargesheets' against AAP MLAs, alleges strong anti-incumbency

The BJP on Tuesday issued chargesheets against 10 AAP MLAs, accusing them of non-performance and claiming they face strong anti-incumbency in their respective constituencies. Leader of Opposition in outgoing Assembly Vijender Gupta, who heads the BJP's chargesheet committee formed to bolster the party's campaign for the assembly polls, said the AAP dropped its 18 sitting MLAs in its second list of 20 candidates announced on Monday. Two other MLAs -- former deputy chief minister Manish Sisodia and Deputy Speaker of Assembly Rakhi Birla -- "deserted" their seats and chose "safer" options, he charged. Jharkhand Chief Minister Hemant Soren on Monday took oath as a member of the Jharkhand Assembly on the first day of the four-day session of the House. MVA members decide against taking oath as MLAs to protest EVM 'misuse'

Opposition Maha Vikas Agahdi (MVA) members in Maharashtra on Saturday decided not to take oath as MLAs on the first day of the special three-day assembly session, alleging misuse of EVMs in the recently-held state polls. SC quashes Telangana's preferential land allotment to 'privileged' class

In a significant judgment, the Supreme Court on Monday quashed the government orders facilitating preferential land allotments to MPs, MLAs, bureaucrats, judges and journalists within the Greater Hyderabad Municipal Corporation limits, saying the distribution of state largesse was "capricious" and "irrational". A bench comprising Chief Justice Sanjiv Khanna and Justice Dipankar Datta held the policy to be "unreasonable, arbitrary, discriminatory", and violative of Article 14 (right to equality) of the Constitution. "The allocation of land at basic rates to select privileged groups reflects a 'capricious' and 'irrational' approach. 89% of newly elected MLAs in Jharkhand are 'crorepatis': ADR report

Eighty-nine per cent of the newly elected MLAs in Jharkhand are 'crorepatis', and Rameshwar Oraon of the Congress is the richest legislator with total assets worth Rs 42.20 crore, according to a report released on Monday. The Jharkhand Election Watch and the Association for Democratic Reforms (ADR) analysed the affidavits of 80, out of 81 winning candidates, and found that 71 newly elected MLAs in 2024 are crorepatis', which is 20 per cent higher than the number of such legislators elected in 2019. Of the 81 MLAs elected five years ago, 56 were crorepatis', and there were 41 in 2014, according to the report. Of the 71 'crorepati' MLAs this year, 28 are from JMM, 20 from BJP, 14 from Congress, four from RJD, two from CPI(ML) Liberation and one each from LJP (Ram Vilas), JD(U) and AJSU Party. Attack on MLAs' residences: 2 more arrested in Manipur for vandalism, arson

Two more persons were arrested in Manipur for allegedly being involved in vandalism and arson at residences of legislators in Imphal Valley on November 16, police said on Saturday. With these arrests, the number of people apprehended for arson at the residences of MLAs reached 34, a senior officer said. Police also said that they are examining inputs and looking for additional suspects in various localities of Imphal Valley for arson incidents on November 16. An investigation into the incidents of vandalism and arson at the residences of legislators is underway, the officer said. BJP retains 71 sitting MLAs in 1st list of 99 nominees for Maha elections

The BJP has retained 71 sitting MLAs in the first list of 99 candidates for the forthcoming Maharashtra assembly polls and also fielded kin of some regional satraps including Congress-turned-BJP politician Ashok Chavan's daughter. HC to hear plea against LG's power to nominate 5 MLAs in J&K Assembly

A special division bench of the Jammu and Kashmir and Ladakh High Court will hear next week a plea challenging the power vested in the J&K lieutenant governor to nominate five members to the Legislative Assembly of the Union territory. Chief Justice Tashi Rabstan agreed to constitute a special division bench on Monday to hear the public interest litigation (PIL) with regard to nomination of the five MLAs, petitioner Ravinder Sharma said. On October 14, the Supreme Court refused to entertain the plea and asked the petitioner to approach the high court. As Sharma's counsel D K Khajuria moved the high court and sought early listing of the petition, Chief Justice Rabstan agreed to constitute a special bench for Monday to hear the matter. Sharma, a former member of legislative council and senior vice president of Pradesh Congress Committee, was also present in the court. A ruling Trinamool Congress MLA on Sunday courted controversy by lashing out at the movement of doctors and people on the RG Kar issue, saying that "mere clapping and dancing to slogans accompanied by music beat will not lead to success". Himachal Assembly passes Bill, bars defected MLAs from receiving pension

The Himachal Pradesh Assembly on Wednesday passed a Bill which will bar the members of the House who are disqualified under Tenth Schedule of the Constitution (anti-defection law) from drawing pension. The Himachal Pradesh Legislative Assembly (Allowances and Pension of Members (Amendment) Bill, 2024 will affect six former Congress MLAs, who were disqualified by the Speaker for defying the whip and abstaining from the House during discussion on cut motions and passing of Budget in February. The opposition BJP objected to the Bill stating that it smacks of "political revenge" and it cannot be implemented with retrospective effect. Sikkim CM Tamang announces minimum monthly pension of Rs 50,000 for ex-MLAs

Sikkim Chief Minister Prem Singh Tamang announced that former MLAs would now receive a minimum monthly pension of Rs 50,000. Tamang made the announcement at the 22nd Foundation Day of Former Legislators Federation of Sikkim (FLFS) on Saturday. The chief minister said former legislators who had served a single term as MLA will now receive a monthly pension of Rs 50,000. At present, they are getting Rs 22,000 as monthly pension. Former legislators who have served two terms or more as MLA will now get Rs 55,000 as pension from Rs 25,000, Tamang said. The CM also announced that the Sikkim government will provide an annual grant-in-aid of Rs 20 lakh to the Former Legislators Federation of Sikkim. This fund is meant to meet the emergency and medical needs of former legislators and to enhance their support system, he said.

Law ministry invites proposals to 'comprehensively evaluate' MP-MLA courts

The Union law ministry has invited proposals from top institutes, including IIMs, IITs, law universities and judicial academies, to carry out a "comprehensive evaluation" of special courts set up to hold expeditious trial of criminal cases involving MPs and MLAs to assess their functionality, efficacy and overall impact. The proposals have been invited under 'Scheme for Action Research and Studies on Judicial Reforms' of the Department of Justice which functions under the law ministry. Following the directions of the Supreme Court in 2017, the central government had facilitated setting up of 12 special courts in states for expeditious trial of criminal cases involving MPs and MLAs. Accordingly, 12 special courts -- two in Delhi and one each in Uttar Pradesh, Bihar, West Bengal, Madhya Pradesh, Maharashtra, Karnataka, Andhra Pradesh, Telangana, Tamil Nadu and Kerala -- were constituted.
