The Supreme Court on Friday adjourned former Union minister Maneka Gandhi's plea challenging Samajwadi Party's Ram Bhual Nishad's election from the Sultanpur Lok Sabha seat till September 30. Gandhi lost to Nishad by a margin of 43,174 votes in the 2024 Lok Sabha elections. A bench of Justices Surya Kant and Ujjal Bhuyan gave senior advocate Siddharth Luthra, appearing for Gandhi, time to file a detailed submission analysing the provision of limitation in other special statutes. Gandhi in a separate petition has challenged the limitation of 45 days imposed for filing an election petition. In her appeal, Gandhi challenged the August 14 order of the Allahabad High Court dismissing her election petition challenging the election of Nishad for being time-barred. The high court's Lucknow bench held the petition was filed after the deadline of 45 days, the statutory period for filing election petition before the high court, and hence the plea cannot be heard on merit. Gandhi contended th

SC refuses to transfer trial in 2015 cash-for-vote case involving T'gana CM

The Supreme Court on Friday refused to transfer the trial in the 2015 cash-for-vote case, involving Chief Minister A Revanth Reddy and others, from Telangana to Bhopal. The apex court directed Reddy not to interfere in any way with the functioning of prosecution in the case. A bench of Justices B R Gavai and K V Viswanathan directed that the Director General of the anti-corruption bureau (ACB) would not report to the Telangana CM with regard to the prosecution of the case. The counsel appearing for Reddy told the court that the plea seeking transfer of trial in the case was filed with a "political motive". The apex court, which had earlier voiced strong displeasure over Reddy's comments on the top court granting bail to rival Bharat Rashtra Samithi (BRS) leader K Kavitha in cases linked to the alleged Delhi excise policy scam, said it was expected that all the three wings of the Constitution showed mutual respect for functioning of each other. The bench took note of an affidavit f

Giving anticipatory bail in NDPS Act case 'very serious' issue: SC

Granting anticipatory bail in a case registered under the Narcotic Drugs and Psychotropic Substances (NDPS) Act is a "very serious" issue and "unheard of", the Supreme Court said on Thursday. A bench headed by Justice B R Gavai and also comprising Justices Aravind Kumar and K V Viswanathan was hearing a plea filed by an accused seeking regular bail in a case lodged for alleged offences under provisions of the NDPS Act in West Bengal. The bench directed the West Bengal government to consider whether the state proposes to file an application seeking cancellation of anticipatory bail granted to four accused in a case. It issued notice to the state of West Bengal on the accused's bail plea and posted it for hearing after four weeks. The petitioner's counsel told the bench that four of the six accused in the case were granted pre-arrest bail while one of them was on regular bail. "In NDPS matter, anticipatory bail?" the bench wondered. "In NDPS matter, anticipatory bail is unheard of,"
