India's SC verdict on Art 370 would further complicate Kashmir issue: Imran

Pakistan's jailed former prime minister Imran Khan has said that India's Supreme Court verdict upholding the abrogation of Article 370 would "further complicate" the Kashmir issue. The Supreme Court on Monday unanimously upheld the Centre government's decision of August 2019 to abrogate Article 370, which bestowed a special status on the erstwhile state of Jammu and Kashmir. Khan, who has been incarcerated in the Adiala jail of Rawalpindi, in a message said that the Indian top court's ruling was a sheer violation of the UNSC resolutions, his Pakistan Tehreek-e-Insaf party said in a post on X. Khan made it clear that the controversial and unlawful decision of the Indian top court would further complicate the Kashmir issue instead of helping to solve the decades-long conflict, it added. He vowed that his party would continue to provide full diplomatic, moral and political support to the Kashmiri people.

The Supreme Court on Wednesday said Chief Justice of India D Y Chandrachud will take a call on the listing of Trinamool Congress (TMC) leader Mahua Moitra's plea challenging her expulsion from the Lok Sabha. Moitra's plea was mentioned for urgent listing before a bench of Justice Sanjay Kishan Kaul and Sudhanshu Dhulia. "The CJI will take the call," Justice Kaul told senior advocate Abhishek Singhvi, who mentioned the plea. CJI Chandrachud is heading a five-judge Constitution bench that assembled on Wednesday to hear a matter. The TMC leader has approached the top court, challenging her expulsion from the Lok Sabha, after the House adopted the report of its ethics committee that held her guilty of accepting gifts and illegal gratification from a businessman to further his interests. SC defers hearing on CBI plea against bail to Chanda Kochhar in fraud case

The Supreme Court on Tuesday deferred until January 3, 2024 the hearing on CBI's plea challenging the Bombay High Court order granting bail to former ICICI Bank CEO and MD Chanda Kochhar and her husband Deepak Kochhar in a loan fraud case. A bench comprising Justices Bela M Trivedi and Satish Chandra Sharma took note of the submissions of senior advocate Amit Desai, appearing for the Kochhars, that he would like to appear physically before it to argue the case. Desai, who was appearing virtually from Mumbai, said there were some connectivity issues, and sought an adjournment. Additional Solicitor General S V Raju, who represented the CBI, opposed Desai's plea for adjournment, saying the hearing be held on Wednesday and not adjourned for a long period. The bench then fixed it for hearing on January 3 next year. The bench had on October 16 sought a response from the Kochhars on the CBI's petition challenging the interim bail granted to them in the case by the Bombay High Court. ASG

Not possible to collect data on illegal migrants living in country: Govt

The Centre has told the Supreme Court that it is not possible to collect data of illegal migrants living in various parts of the country as entry of foreign nationals is clandestine and surreptitious. In its affidavit filed in the top court which is examining the constitutional validity of section 6A of the Citizenship Act relating to illegal immigrants in Assam, the Centre said 17,861 people have been granted citizenship under the provision. Answering the court's query posed on December 7, the Centre said 32,381 people have been detected as foreigners under the orders of foreigners tribunal with reference to the period of 1966-1971. Replying to the court's query about the estimated inflow of illegal immigrants into India, including but not confined to Assam after March 25, 1971, the Centre said illegal immigrants enter the country without valid travel documents in a clandestine and surreptitious manner. Govt likely to move amendment to bring CEC, ECs on par with SC judges

Amid protests by opposition parties and former chief election commissioners, the government has decided to retain the status of CEC and other election commissioners on par with judges of the Supreme Court. At present, the CECs and ECs enjoy the status of a Supreme Court judge. The Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023 introduced in the Rajya Sabha in August this year had proposed to bring the status of the CEC and other ECs on par with the Cabinet Secretary. The opposition parties and some former CECs had opposed the move, saying it will go against the independence of the institution. According to sources, the official amendment says "The CEC and other commissioners shall be paid a salary which is equal to the salary which is equal to the salary of a judge of the Supreme Court." SC takes note of end of suspension of Raghav Chadha from RS, closes plea

The Supreme Court on Monday took note of the supervening development about revocation of the indefinite suspension of AAP MP Raghav Chadha from the Rajya Sabha on December 4 and disposed of his plea contesting it. The Rajya Sabha had on December 4 adopted by a voice vote the motion moved by BJP member GVL Narasimha Rao to end the suspension of Chadha, a member of the upper house from Punjab. The MP was held guilty by the Privileges Committee of presenting "misleading" facts to the media, and was allowed to attend the House proceedings after his suspension was withdrawn. As soon as a three-judge bench headed by Chief Justice D Y Chandrachud took up Chadha's plea, his counsel Shadan Farasat submitted that his suspension stands revoked.
