Delhi excise policy scam: SC rejects bail pleas of ex-Dy CM Manish Sisodia

The Supreme Court on Monday rejected the regular bail pleas of former deputy chief minister Manish Sisodia in corruption and money-laundering cases related to the alleged Delhi excise policy scam. A bench of Justice Sanjiv Khanna and Justice SVN Bhatti said it has recorded the statements of the probe agencies that the trial in these cases will conclude in six to eight months. But if the trial proceeds in a "sloppy manner", then Sisodia will be at liberty to apply for bail in these cases in three months, the bench said. The top court pronounced its verdict on Sisodia's two separate regular bail pleas filed in corruption and money-laundering cases related to the now-scrapped Delhi excise policy. It had on October 17 reserved its verdict on both the pleas. Sisodia was arrested by the Central Bureau of Investigation (CBI) on February 26 for his alleged role in the "scam". Finolex Cables case: NCLAT bench wilfully defied our order, says SC

The Supreme Court on Monday held that a National Company Law Appellate Tribunal (NCLAT) bench comprising judicial member Rakesh Kumar and technical member Alok Srivastava wilfully defied its October 13 order by going ahead with the pronouncement of their verdict in the Finolex Cables case. A bench headed by Chief Justice D Y Chandarchud and Justices JB Pardiwala and Manoj Misra, however, closed the contempt proceedings against Kumar and Srivastava. It took note of the fact that the judicial member has resigned from his post and Srivastava, who only followed the direction of Kumar, tendered an unconditional apology. We are of the view that there was an attempt to defy the orders of this court, the bench said. Expedite steps to fill the vacant posts in CIC, SICs: SC asks Centre

Taking serious note of vacancies in the Central Information Commission (CIC) and state information commissions (SICs), the Supreme Court on Monday asked the Centre and the state governments to take steps to fill the posts, saying otherwise the 2005 law on right to information will become a dead letter. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra also asked the Department of Personnel and Training (DoPT) to collect information from all states on aspects including the sanctioned strength of information commissioners in the SICs, vacancies at present and the total number of pending cases there. SC to hear Raghav Chadha's plea challenging suspension from Rajya Sabha

The Supreme Court is scheduled to hear on Monday a petition filed by Aam Aadmi Party (AAP) leader Raghav Chadha challenging his indefinite suspension from the Rajya Sabha. A bench headed by Chief Justice D Y Chandrachud had on October 16 sought a response from the Rajya Sabha Secretariat on Chadha's plea. The apex court had also sought assistance of Attorney General R Venkataramani in adjudicating the issue. The bench had taken note of the submissions of senior advocate Rakesh Dwivedi and lawyer Shadan Farasat, representing Chadha, that the suspension cannot extend beyond the particular session during which the decision to suspend the member was made. The top court had also taken note of Dwivedi's submissions that the case raised an "important national issue" and noted as many as seven issues for adjudication. SC bench to hear pleas challenging electoral bond scheme from Oct 31

A five-judge constitution bench of the Supreme Court is scheduled to commence hearing from October 31 a batch of pleas challenging the validity of the electoral bond scheme for political funding of parties. The scheme, which was notified by the government on January 2, 2018, was pitched as an alternative to cash donations made to political parties as part of efforts to bring in transparency in political funding. According to the provisions of the scheme, electoral bonds may be purchased by any citizen of India or entity incorporated or established in India. An individual can buy electoral bonds, either singly or jointly with other individuals. The bench headed by Chief Justice DY Chandrachud is scheduled to take up the batch of four pleas including those filed by Congress leader Jaya Thakur and the CPI(M).
