GST officers must explain 'grounds of arrest', obtain acknowledgment: CBIC

GST officers will now have to explain to offenders about the "grounds of arrest" and obtain a written acknowledgement from them, the CBIC said on Monday. Modifying the guidelines for arrest and bail in relation to offences punishable under the GST Act, the Central Board of Indirect Taxes and Customs (CBIC) said: "The grounds of arrest must be explained to the arrested person and also furnished to him in writing as an Annexure to the Arrest Memo. Acknowledgement of the same should be taken from the arrested person at the time of service of the Arrest Memo." As per the earlier guideline issued in August 2022, GST officers were required to explain to the arrested person the grounds of arrest, and note the same in the arrest memo. The instructions follow the Delhi High Court order in the case of Kshitij Ghildiyal versus DGGI (Delhi). Delhi HC refuses to grant bail to alleged ISIS associate in terror case

The Delhi High Court has refused to grant bail to an alleged member of ISIS in a terror case by NIA over radicalisation of youths using cyber space. A bench of Justices Prathiba M Singh and Amit Sharma dismissed the bail plea by Md Heydaitullah, who allegedly used Telegram groups to propagate the ideology of the terrorist group in India and recruit other persons. The accused challenged a trial court order declining any relief on the ground that mere association or support to a terrorist organisation would not constitute an offence under the Unlawful Activities Prevention Act (UAPA). The court rejected the contention, and said Heydaitullah, a qualified MBA graduate working at an IT company in Gurugram, was not a "passive" supporter as material showed that he advocated "Jihad in order to establish Khilafat" even through violent means. Delhi HC sets aside CIC order asking Trai to demand service provider info

The Delhi High Court has set aside an order of the Central Information Commission directing the Telecom Regulatory Authority of India (TRAI) to demand information from the phone service provider and give it to a customer under the RTI Act. Justice Sanjeev Narula said TRAI requesting information from telecom service providers (TSP) was confined to fulfilling its regulatory functions and did not extend to addressing individual grievances or accessing customer-specific information solely for dissemination under the RTI framework. The high court, in its order, said the CIC's observation requiring a customer to seek redressal before the consumer disputes redressal forum was misplaced and beyond its statutory mandate. Delhi HC asks RBI to expedite system to verify receiver name in RTGS, NEFT

In a significant ruling, the Delhi High Court has asked the Reserve Bank of India to expeditiously activate the process of verifying the receiver's name in RTGS and NEFT payment methods Justice Pratibha M Singh said such a system was crucial to prevent cyber frauds and a delay could likely impact thousands of innocent consumers who made payments without realising who the beneficiary was. Delhi HC says endless incarceration without trial violates Article 21

Endless incarceration without trial in near future falls foul of Article 21 of the Constitution, the Delhi High Court said recently and granted bail to a man held in a cheating case in 2022. Justice Amit Mahajan said if an accused was suffering a prolonged incarceration without a timely trial in the case, courts would ordinarily be obligated to release them on bail. Article 21 of the Indian Constitution deals with the right of life and personal liberty. Delhi HC seeks Patanjali stand on lawsuit by Dabur over 'disparaging' ad

The Delhi High Court has sought Patanjali Ayurved's stand on a lawsuit by Dabur over advertisements allegedly disparaging its product Chyawanprash. On December 24, Justice Mini Pushkarna issued summons on the lawsuit to the defendants -- Patanjali Ayurved and Patanjali Foods Ltd -- for a reply in the matter. "Accordingly, let the plaint be registered as suit. Issue summons.. Let the written statement be filed by the defendants within thirty days from today," the order said. The Delhi High Court has directed the city government to take expeditious steps for filling up posts of non-official members of the Delhi Mental Health Authority. A bench of Acting Chief Justice Vibhu Bakhru further said once the authority is constituted, it would take expeditious steps for the constitution of review boards according to the Mental Health Care Act. The bench, also comprising Justice Tushar Rao Gedela, clarified that the process of constituting the authority and the boards shall not be impeded by imposition of the Model Code of Conduct in view of the upcoming Delhi Assembly elections. The Delhi High Court on Tuesday refused to intervene in an order directing the Consortium of National Law Universities to revise the result of CLAT-2025 over errors in the answer key. A bench comprising Acting Chief Justice Vibhu Bakhru and Justice Tushar Rao Gedela while dealing with an appeal by the consortium against the decision of a high court single judge opined no case for an interim order was made out. The bench prima facie found no error in the view taken by the single judge with respect to two questions and clarified the consortium was free to declare the results in terms of the single judge's decision. Delhi High Court on Monday refused to grant anticipatory bail to former IAS probationer Puja Khedkar in the criminal case lodged against her for alleged cheating and wrongly availing of OBC and disability quota benefits in the civil services examination. "Anticipatory bail plea is dismissed. Interim protection from arrest is vacated," Justice Chandra Dhari Singh said while ruling on the plea.
