HC asks Centre to respond to plea on non-regulation of deepfake technology

The Delhi High Court on Wednesday sought the Centre's response on a PIL by veteran journalist Rajat Sharma against non-regulation of deepfake technology in the country and seeking directions to block public access to applications and software enabling creation of such content. A bench of Acting Chief Justice Manmohan and Justice Manmeet PS Arora issued notice to the Union Ministry of Electronics and Information Technology on the petition. Deepfake technology facilitates creation of realistic videos, audio recordings and images that can manipulate and mislead viewers by superimposing the likeness of one person onto another, altering their words and actions, thereby presenting a false narrative or spreading misinformation. The bench said it was a major problem and sought to know from the central government if it was willing to act on the issue. Political parties are complaining about this as well. You are not taking any action, the court said. Rajat Sharma, the Chairman and ...

Delhi HC dismisses PIL seeking facilities for CM Kejriwal in jail

The Delhi High Court on Wednesday dismissed with Rs 1 lakh costs a public interest litigation by a lawyer seeking appropriate arrangements for Chief Minister Arvind Kejriwal to run the government from jail. The petitioner also sought to restrain Delhi BJP president Virendra Sachdeva from exerting any "undue pressure" for resignation of Kejriwal. A bench headed by Acting Chief Justice Manmohan observed that since the AAP leader has already approached the Supreme Court against his arrest, "no orders were called for" with regard to providing him any facilities while in judicial custody. The bench, also comprising Justice Manmeet PS Arora, further said the court cannot impose censorship on the media or stop political rivals from making statements. "Do we impose emergency? We impose censorship? We impose martial law? How do we gag the press? The political rivals?" the court said. "Keep bank draft of Rs 1 lakh ready," the court told the petitioner. The petitioner argued that although i

Children need to be taught about dangers of 'virtual' world: Delhi HC

Teaching minors about good touch' and bad touch' is not enough in today's virtual world and children must be educated on the emerging concept of virtual touch' and its potential dangers, the Delhi High Court has said. This involves teaching them appropriate online behaviour, recognising warning signs of predatory behaviour and understanding the importance of privacy settings and online boundaries. This court is constrained to note that in today's virtual modern world where virtual space has also become a breeding ground of alleged virtual affections between teenagers, they are not equipped to deal with the potential dangers of human trafficking for prostitution and other side of crimes which exists in the virtual world, Justice Swarana Kanta Sharma said on Monday. The high court's observations came while dismissing a bail plea by a woman, Kamlesh Devi, accused of helping her son in sexually assaulting a minor girl after kidnapping her and forcing her into prostitution. HC gives 3 mths to trial court to conclude Haryana judicial paper-leak case

The Delhi High Court has granted three more months to a trial court to conclude the proceedings in a case relating to the alleged leak of the 2017 Haryana Civil Services (Judicial) preliminary examination paper. It was earlier directed that the hearing in the matter be taken up on a daily basis. Justice Dinesh Kumar Sharma said the court would appreciate if the principal district and sessions judge, before whom the trial is going on, posts the matter on a day-to-day basis and grants adjournments to the parties only for unavoidable reasons. The high court had, in January, asked the trial court to expedite the proceedings in the case and take it up on a daily basis. Pursuant to the last order, the trial court judge submitted a letter to the high court, stating that the case record is voluminous as seven chargesheets have been filed against the accused who are facing trial. There are 19 accused and 85 witnesses in the case, which is at the stage of defence evidence, the trial court j

The Delhi High Court on Friday sought response of the CBI and ED on former deputy chief minister Manish Sisodia's pleas seeking bail in the corruption and money laundering cases lodged in relation to the alleged excise policy scam. Justice Swarana Kanta Sharma issued notices to the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) on Sisodia's pleas challenging a trial court's April 30 order by which his bail petitions were dismissed. The high court listed the matter for further hearing on May 8. Umar Khalid's lawyer asks court whether sharing messages is terror act

Rebutting the Delhi Police's argument that former JNU student Umar Khalid was creating social media narratives to influence bail hearings, his lawyer on Wednesday asked the court whether sharing WhatsApp messages is a criminal or terror act. Khalid is an accused in the alleged larger conspiracy behind the 2020 northeast Delhi communal riots. He has been booked under the stringent Unlawful Activities (Prevention) Act (UAPA). Additional Sessions Judge Sameer Bajpai was hearing the second bail plea of Khalid before the special court. "The special public prosecutor (SPP) says I created narratives. Is sharing messages (on WhatsApp) a criminal or terror act?... Is the court able to see the ridiculousness of their (prosecution's) attempts to keep someone in jail? Is it wrong for me to forward a message saying someone is wrongly incarcerated? No," Khalid's counsel senior advocate Trideep Pais said. SPP Amit Prasad had earlier said the data from Khalid's mobile phone revealed that he was in
