However, the top priority of the investigative agency is to ascertain the genuineness of the audio CD received from an anonymous source through a forensic study, CBI sources said. Both Singh and Chandra have denied any links with the CD.
A senior CBI official said that a team was looking into the damage that may have been caused to the prosecution on account of the tapped conversation. CBI is also seeking legal advice on collecting voice samples of the suspects since according to CrPC it cannot seek any evidence from an accused.
CBI is also suspecting the timing of the release of tape, just two days before the joint parliamentary committee (JPC) meeting, though officials said the recording was made in September 2012. CBI will also investigate the source of the audio CD to find out the intentions behind the recording.
The investigative agency said that it cannot take any action based on an audio tape whose authenticity is yet to be established. CBI will also find out if the said conversation took place on telephone or in a face to face meeting.
CBI quizzed Singh and Unitech’s Sanjay Chandra in connection with this case yesterday. CBI has registered a preliminary enquiry against Singh for allegedly revealing the “prosecution strategy” to one of the 2G accused, suspected to be Chandra on February 6.
CBI has removed Singh from the 2G case trial team and informed the court about the developments. CBI has meanwhile appointed another prosecutor in Singh's place.
