Couple convicted for injuring man, released on probation

A Delhi court has held a couple guilty of injuring a man but took a lenient view and released them on probation citing their "clean antecedents".
Additional Sessions Judge Gautam Manan released Satender Pandey and his wife Savita, who were convicted for the offence under section 324 (voluntarily causing hurt by dangerous weapon) of the IPC, on probation for one year while noting that they were not involved in any criminal activities.
"The accused persons are husband and wife and are not involved in any criminal activities. The incident in question happened in a spur of moment. Keeping in view of the clean antecedents of the accused persons, a lenient view is taken against them," the judge said.

The court released them on probation on furnishing a personal bond and surety of Rs 10,000 each with the condition that they would keep peace and maintain good behaviour.
It, however directed them to pay compensation of Rs 30,000 to the victim and complainant Rajender Kumar.
The court, diluted the charge of attempt to murder against the couple, residents of Dwarka here, while noting that the injuries inflicted on Kumar did not show that they could have caused his death.
According to the prosecution, on September 6, 2011, Kumar went to Pandey's pan shop and asked him to repay Rs 50,000 which he had borrowed.
Instead of repaying the money, Pandey started hitting him with an iron rod. Pandey's wife Savita joined him and tried to stab Kumar with a knife, it said.
