Court directs police to lodge FIR on senior citizen's plea

The court also asked the station house officer (SHO) of Tilak Marg police station here to give "strict direction" to the investigating officer (IO) to fairly investigate the case.

The court's order came on a petition filed by 63-year-old Vijay Kapoor, a resident of Fateh Nagar here, seeking lodging of an FIR against property dealer Gopi Chand alleging that the accused had snatched the original papers of the property from him and threatened to kill him when he had came to Patiala House court complex in April this year.

"The complaint of the complainant (Kapoor) prima facie discloses cognizable offence because as per the complainant, the accused (Chand) had caused hurt to him to extort valuable security/original property papers from him and also threatened to kill him.

 

"Therefore, SHO police station Tilak Marg is directed to register an FIR in the present case and give a strict direction to the IO to fairly investigate the matter and file a status report on January 17, 2013," Metropolitan Magistrate Navita Kumari Bagha said.

Kapoor had alleged Chand had forged the documents and got the property/shop in East Patel Nagar Market here mutated in his name after which he had filed a complaint against the accused in a court here.

He said that on April 20, the matter was fixed for filing of action taken report by the police and when he went outside the court room along with his original record, Chand, along with one unknown person, came and snatched the original documents of the property and also threatened to kill him.
