HC issues bailable arrest warrant to GM

The Madras High court today issued a bailable arrest warrant against a General Manager of the Tamil Nadu State Transport Corporation, Tirunelveli Division, for not implementing a court order to reinstate a driver of the TNSTC and not appearing as per its direction.

Justice S.Nagamuthu of the High Court's Madurai Bench issued the bailable arrest warrant against General Manager Dharmaraj on a contempt petition filed by Kalipandian, a driver of TNSTC Tirunelveli division.

Kaliappan was appointed as a temporary driver on January 11,2004. As per a settlement with the union,it was decided to regularise 1375 temporary workers. However Kalipandian was not made permanent as per the settlement.
 

The labour court dismissed his plea to make him permanent. But the High court ordered the General Manager to regularise his service with 25 per cent back wages as he was a permanent employee as per labour act and he could not be dismissed.

But the GM did not implement the order,which was issued on August 20,2014, it was submitted. On a contempt petition filed by the driver,the court directed Dharmaraj to appear in court today.

The Judge was told that the court notice sent to him had returned as he had gone on transfer.The notice should have been issued to the place where he had been transferred.But that also was not done,the Judge said and issued bailable arrest warrant against the GM.

The Tirunelveli ADSP should arrest him and get an assurance from him that he would appear in court on June 22, the judge said, adding, after getting the written assurance,he could be released.
