A woman, who strangulated her infant daughter after being disturbed over her husband's move of sending divorce papers, has been convicted for murdering the kid by a Delhi court which termed the case "unfortunate".
Additional Sessions Judge Sanjay Sharma held the woman, an East Delhi resident, guilty of the offence of murder under section 302 of the IPC. The quantum of sentence would be pronounced later in the week.
"This is an unfortunate case. A mother is accused of causing death of her nine-month-old daughter by strangulation ... The woman was under mental strain after receiving legal notice from her husband," the judge said.

"Her husband sent a notice to her for divorce and she was disturbed after receiving it. On the fateful day, she was alone with her daughter in a room on the first floor of her parents' house and no one had the opportunity for causing the injuries, but her," the court said, adding, "It is proved that she killed her daughter with the intention of causing death."
While holding the woman guilty of murdering her child, the court said the death of the minor was not caused by accident or misfortune.
The court noted that the woman's mother, who was an eyewitness to the incident and had told the police that her daughter killed the child in a disturbed state of mind, later resiled from her statement.
It said the "case which was based on an eyewitness account had turned into a case of circumstantial evidence".
The judge also observed that the woman, in her statement before the court, had admitted to have strangulated her daughter in a disturbed state of mind after receiving the divorce notice from her husband.
According to the prosecution, on March 28, 2012, the woman received the legal notice for divorce from her husband, whom she had married in 2009. Disturbed by the notice, she strangulated her child when she was alone in a room with her at her parental house.
