Centre, Gujarat govt should apologise to Bilkis Bano, demands Owaisi

AIMIM president Asaduddin Owaisi on Monday demanded that the BJP governments at the Centre and in Gujarat apologise to Bilkis Bano in the wake of the Supreme Court judgment quashing the Gujarat government's decision to grant remission to 11 convicts in the Bilkis Bano case. Accusing the Gujarat government of abusing its power, the Supreme Court on Monday quashed the remission to 11 men convicted of gangraping Bilkis Bano and murdering seven of her family members during the 2002 riots and ordered that they be sent back to jail within two weeks. The Gujarat government's remission order was without application of mind, a bench of Justices B V Nagarathna and Ujjal Bhuyan said and asked whether "heinous crimes against women permit remission" whatever faith she may follow or creed she may belong to. Reacting to the ruling, the Hyderabad MP said "I welcome this judgement and I hope it acts as a precedent against all the rapists in the future." Speaking to reporters here, Owaisi said thi

Bilkis Bano case: SC to deliver verdict on convicts' remission on Monday

The Supreme Court is scheduled to pronounce on Monday its verdict on the petitions challenging the remission granted to 11 convicts in the case of gangrape of Bilkis Bano and murder of seven of her family members during the 2002 Gujarat riots. A bench of Justices B V Nagarathna and Ujjal Bhuyan had on October 12 last year reserved its verdict after an 11-day hearing on the petitions, including the one filed by Bano. While reserving the judgement, the apex court had directed the Centre and the Gujarat government to submit by October 16 the original records related to the remission of sentence of the 11 convicts. While hearing the matter in September last year, the top court had asked whether convicts have a fundamental right to seek remission. During the earlier arguments, the apex court had observed that state governments should not be selective in granting remission to convicts and the opportunity to reform and reintegrate with society should extend to every prisoner. Besides the

SC questions convict of Bilkis Bano rape case for depositing fine

The Supreme Court on Thursday questioned one of the convicts in the Bilkis Bano gangrape case and the murder of seven of her family members during the 2002 Gujarat riots for depositing the fine imposed on him when the hearing on the pleas challenging his remission was underway before it. Senior advocate Sidharth Luthra, appearing for convict Ramesh Rupabhai Chandana, told a bench of justices BV Nagarathna and Ujjal Bhuyan that convicts have approached the trial court in Mumbai and have deposited the fine imposed upon them. "Does non deposit of fine has a bearing on the remission? Did you apprehend that non deposit of fine would have a impact on the merits of the case. First you ask for permission and now without permission you have deposited," the bench said. Responding to the court's query, Luthra said non-deposition of fine does not affect the decision on remission but he had advised his clients to deposit the fine to "reduce the controversy". "According to me, this has no legal

Bilkis Bano case: SC says state govt should not be selective in remission

State governments should not be selective in granting remission to convicts and the opportunity to reform and reintegrate with society should be given to every prisoner, the Supreme Court Thursday told the Gujarat government which defended its decision of premature release of all 11 convicts in the Bilkis Bano gang-rape case during the 2002 riots. The top court's observation came in response to the submission by Additional Solicitor General S V Raju, appearing for the Gujarat government, that law says a chance must be given to even the hardened criminals to reform themselves. The law officer submitted the crime committed by the 11 convicts was "heinous" but does not fall in the rarest of rare category. "Therefore, they deserve the chance of reformation. Person may have committed the offence...Something may have gone wrong in a particular moment. Later, he can always realise the consequences. "This can largely be determined from their conduct in jail, when released on parole, or ..

Bilkis case: SC defers till hearing on pleas against remission to convicts

The Supreme Court on Tuesday deferred till July 11 the hearing on a batch of pleas challenging the remission granted last year to all the 11 convicts in the case of gang rape of Bilkis Bano and murder of her family members during the 2002 post-Godhra riots. A bench of justices KM Joseph, BV Nagarathna and Ahsanuddin Amanullah directed the issuance of notices to the convicts, who remained unserved even now. The bench also directed the publication of notices in local newspapers, including in Gujarati and English, against the convicts who could not be served notices, including one whose house was found by the local police to be locked and his phone was switched off. It directed that the next date of hearing of the matter - July 11 - shall also be published in the notices to be carried in the newspapers. "We are adopting this process so that time is not wasted on the next date of hearing of the matter and the matter could proceed," the bench said. On July 11, a new bench is likely to

SC to hear pleas challenging remission of convicts in Bilkis Bano to May 9

The Supreme Court on Tuesday deferred to May 9 the hearing on a batch of pleas challenging the remission granted last year to all the 11 convicts in the case of gang rape of Bilkis Bano and murder of her family members during the 2002 post-Godhra riots. Several counsel appearing for the convicts raised objections on not being served the notice on Bano's plea, which made the top court observe, "It is obvious, rather more than obvious, that you all do not want the hearing to be conducted by this bench." A bench of Justices K M Joseph and B V Nagarathna was told by Solicitor General (SG) Tushar Mehta, who appeared in the court on behalf of the Centre and the Gujarat government, that they are not claiming any privilege and not filing any plea for a review of the court's March 27 order, asking for the production of the original records with regard to the remission granted to the convicts. The SG raised preliminary objections with regard to the petitions filed in the matter other than the

Bilkis case: Govt may seek review of order on production of remission files

The Centre and the Gujarat government on Tuesday told the Supreme Court that they may file a plea seeking a review of its March 27 order asking them to be ready with original files on the grant of remission to the convicts in the Bilkis Bano case. A bench of Justices K M Joseph and B V Nagarathna questioned the paroles granted to 11 convicts during their incarceration period and said the gravity of the offence could have been considered by the state. It said, "A pregnant woman was gang-raped and several people were killed. You cannot compare victim's case with standard section 302 (murder) cases. Like you cannot compare apples with oranges, similarly massacre cannot be compared with single murder. Crimes are generally committed against society and the community. Unequals cannot be treated equally." "The question is whether government applied its mind and what material formed the basis of its decision to grant remission," the bench said, adding, Today it is Bilkis but tomorrow it can

Bilkis Bano's plea: SC seeks response from Centre, Gujarat government

The Supreme Court on Monday sought a response from the Centre, Gujarat government and others on a plea filed by Bilkis Bano, who was gang-raped and seven members of her family were killed during the 2002 post-Godhra riots. Bano has challenged remission of sentence of 11 convicts in the case. While posting the matter for hearing on April 18, a bench of Justices K M Joseph and B V Nagarathna said there is a gamut of issues involved and it needs to hear the matter in detail. The top court issued a notice to the Centre, the Gujarat government and the convicts. It also directed the Gujarat government to be ready with the relevant files granting remission to the parties on the next date of the hearing. During the hearing, the bench observed that it would not be overwhelmed by emotions in the case and would only go by the law. On January 4, a bench comprising Justices Ajay Rastogi and Bela M Trivedi took up the petition filed by Bano and other pleas. However, Justice Trivedi recused fro
