Firing outside Salman Khan's house: Family of deceased accused moves HC

The family of Anuj Thapan, who died while in police custody following his arrest in the case related to firing outside Bollywood superstar Salman Khan's house here, has moved the Bombay High Court seeking a CBI probe into his death. While the police claim Thapan killed himself in the lock-up, his mother Rita Devi in her petition filed in the HC on Friday alleged foul play and claimed he was killed. In the plea, which will come up for hearing in due course, Devi sought the HC to direct the Central Bureau of Investigation (CBI) to probe the death of her son. The petition alleged Thapan was physically assaulted and tortured by police in custody. It also sought the high court to direct the police to hand over CCTV footage of the police station and the lock-up where Thapan was held. The petitioner requested for the preservation of call data records (CDR) of police officials, who are probing the firing incident, from April 24 to May 2. It also sought directions for a fresh post-mortem

CBI not controlled by Union of India, Centre tells SC on Bengal govt's suit

The CBI is not under the "control" of the Union, the Centre on Thursday told the Supreme Court while raising preliminary objections on a lawsuit filed by the West Bengal government on the agency going ahead with its probe in several cases without the prerequisite nod from the state. The West Bengal government has filed an original suit in the apex court against the Centre under Article 131 of the Constitution, alleging that the CBI has been filing FIRs and proceeding with its investigation, despite the state having withdrawn the general consent to the federal agency to probe cases within its territorial jurisdiction. Article 131 deals with the Supreme Court's original jurisdiction in a dispute between the Centre and one or more states. Solicitor General Tushar Mehta, appearing for the Centre, told a bench of Justices B R Gavai and Sandeep Mehta that Article 131 of the Constitution is "one of the most sacred" jurisdiction conferred upon the apex court and this provision can't be ...

Excise case: Why no bail plea in trial court, SC asks Delhi CM Kejriwal

The Supreme Court on Monday asked Delhi Chief Minister Arvind Kejriwal, who has been arrested in a money-laundering case stemming from the alleged excise policy scam, why has he not filed a bail application before the trial court. A bench of Justices Sanjiv Khanna and Dipankar Datta was hearing the Aam Aadmi Party (AAP) leader's plea challenging his arrest by the Enforcement Directorate (ED). "You did not move any application for bail before the trial court?" the bench asked senior advocate Abhishek Singhvi, who appeared in the court on behalf of Kejriwal. "No", Singhvi replied. "Why did you not file any application for bail?" the bench asked. The lawyer said there are several reasons, including that Kejriwal's arrest was "illegal". The hearing in the matter is underway. The ED arrested Kejriwal on March 21, after the Delhi High Court refused to grant him protection from coercive action by the federal anti-money laundering agency. CBI 'might have brought' seized arms in Sandeshkhali, alleges CM Banerjee

West Bengal Chief Minister Mamata Banerjee on Saturday said there was "no evidence" of arms seizure in Sandeshkhali, asserting that CBI teams conducted searches without informing the state police. She expressed skepticism regarding the operations, stating that the recovered items "might have been brought by officials of the central agency". Even if a firecracker goes off in Bengal, the NIA, CBI, NSG are coming to investigate. It seems that a war is going on. The state police were not informed. It is not known what was found. There was no evidence. The seized items might have been brought by them (CBI) in a car," Banerjee said here. She was addressing an election rally for TMC's Asansol Lok Sabha candidate Shatrughan Sinha. The CBI on Friday seized arms and ammunition, including a police service revolver and foreign-made firearms, during searches at two premises of an associate of now-suspended TMC leader Shajahan Sheikh in Sandeshkhali, officials said. The searches were conducted

WB moves SC against cancellation of appointment of 25,000 staff in schools

The West Bengal government has moved the Supreme Court against the Calcutta High Court order invalidating the appointment of 25,753 teachers and non-teaching staff made by the state's School Service Commission (SSC) in state-run and state-aided schools. Challenging the high court order, the state government, in its appeal filed before the top court, said the HC cancelled the appointments "arbitrarily". "The high court failed to appreciate the ramification of cancelling the entire selection process leading to straightaway termination of teaching and non-teaching staff from service with immediate effect, without giving sufficient time to the petitioner state to deal with such an exigency, rendering the education system at a stand-still," the plea said. The Calcutta High Court had on Monday declared the selection process as "null and void" and directed the CBI to probe the appointment process. It had also asked the central agency to submit a report within three months. The high court

Senior advocate Kapil Sibal appeared for the West Bengal government.
